General 1.1 The “Promoter” of the “MotoMe Electric Toy Car Competition” (the “Promotion”) is Macquarie Leasing Pty Limited ABN 38 002 674 982, of Level 9, 1 Shelley Street, Sydney, NSW 2000, Phone: 02 8232 7013. 1.2 The “Promotion Period” commences at 9.00am AEDT on 3 December 2018 and closes at 9.00pm AEDT on 20 December 2018. 1.3 Instructions on how to participate in the Promotion and prize details form part of these Terms and Conditions. An entry not complying with these Terms and Conditions is invalid. 1.4 Entry to the Promotion deems acceptance of these Terms and Conditions. 1.5 No correspondence will be entered into. The Promoter’s decision is final. 1.6 The Promotion is authorised under NSW Permit No. LTPS/18/30229. 2. Participation and Eligibility 2.1 To be eligible to enter the Promotion you must be: 2.1.1 an individual resident in Australia; and 2.1.2 18 years or over; and 2.1.3 hold a valid current Australian drivers licence. Each such person eligible is an “Eligible Participant”. 2.2 To enter the Promotion an Eligible Participant must complete the competition entry form in the MotoMe Hornsby store before 9.00pm AEDT on 20 December 2018. 2.3 Entries not received during the Promotion Period will be invalid and not eligible for the Promotion Prize. 2.4 Only one (1) entry will be submitted on behalf of an Eligible Participant. In the event that more than one entry to the Promotion is made, each entry subsequent to the first lodged entry is invalid and not eligible for the Promotion Prize. 2.5 Any entry deemed by the Promoter to have been made through or involving misleading and / or deceptive conduct is invalid and not eligible for the Promotion Prize. 2.6 Each valid entry made by an Eligible Participant shall be in the draw to win a Promotion Prize, other than a valid entry which, at the time of the draw, has already won a Promotion Prize. 2.7 The Promoter will not be held responsible for any lost, incomplete or incorrectly entered entries during the Promotion Period. 3. Promotion Prize 3.1 The “Promotion Prize” is the award of one (1) 6 Volt ride-on Maserati GranCabrio toy car for children valued at RRP $760 AUD. The Promotion Prize is available for winning by Eligible Participants who lodge a valid entry. There will be one (1) Promotion Prize winner only. 3.2 The Promotion Prize is not transferrable or redeemable for cash or other goods or services, must be taken as stated and no compensation will be paid or payable if a winner is unable to receive, use or redeem a Promotion Prize. 3.3 Any winner must make their own arrangements in respect of the use of the Promotion Prize at their own cost, and is responsible for all associated costs and expenses. 3.4 The draw for the winner of the Promotion Prize will be conducted at 11:00am AEDT on 21 December 2018 at the Level 9, 1 Shelley Street, Sydney, NSW 2000. 3.5 One (1) winner will be randomly selected from all valid entries made by Eligible Participants and received by the Promoter, and will be the first valid entry made by an Eligible Participant to be drawn. There is no requirement for Eligible Participants to attend the draw. 3.6 For the purposes of any redraw, the stipulated time shall mean that the Promotion Prize will be kept for two (2) months from the prize draw date, and the redraw (if any) will take place on 21 February 2019 at 11:00am (AEDT), subject to approval from the Promoter. The redraw will take place at the Level 9, 1 Shelley Street, Sydney, NSW 2000. 3.7 The winner of the Promotion Prize will be notified by email, telephone and/or mail within two (2) days of the draw or redraw date (as the case may be), and a notice of the winner will be published on the date being two (2) days after the draw or redraw (as the case may be) on the ‘MotoMe Facebook Page'. 4. No Liability 4.1 The Promoter and its related companies and agencies will, to the extent permitted by law, not be liable for any misadventure, accident, injury, loss (including consequential losses), liability, damage, claim, cost and expense that may occur in connection with: 4.1.1 The Promotion at any time, before, during or after the Promotion Period; 4.1.2 The use or redemption of the Promotion Prize, or an inability to do so for any reason; 4.1.3 A computer or telephone malfunction. 4.2 If for any reason this Promotion is not capable of running as planned, including for reasons of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or other causes beyond the control of the Promoter or its related companies and agencies which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may disqualify from eligibility any individual who tampers with the entry process, cancel, terminate, modify or suspend the Promotion in its absolute discretion - subject to any required approvals of relevant State and Territory Lottery Departments. 5. Promotion Decisions 5.1 The Promoter reserves the right to validate and check the authenticity of entries and to disqualify any participant for tampering with the entry process. 5.2 Any and all decisions of the Promoter in relation to any aspects of the Promotion offer are final and binding on every person who participates in the Promotion. 5.3 The Promoter reserves the right in its sole discretion to disqualify any person who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the offer / promotion. 5.4 The Promoter collects and uses personal information of the Eligible Participants to enable it to conduct the Promotion and for other marketing and promotional activities. 6. Personal Information and Privacy 6.1 Entry details will be retained by the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter, at the time of accepting the Promotion Prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any Promotion Prizes (including to third parties involved in the promotion and applicable statutory authorities) and to conduct marketing activities.
