Quiksilver Valiant Giveaway TERMS AND CONDITIONS OF ENTRY 1. Information on how to enter and prizes form part of these Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions. The Promoter reserves the right to modify the content of these Terms & Conditions with retroactive effect should modification be required to ensure the good execution of the competition. 2. The Promoter is Ug Manufacturing Co Pty Ltd of 27 Baines Crescent, Torquay Victoria 3228 Australia, ABN 63 005 047 941, Telephone 03 5261 6000 (‘Promoter’). 2. Entry is open to Australian residents aged 16 years or over. Employees of the Promoter and their immediate family members are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or 1st cousin. Entrants under 18 years old must have parental/guardian consent to enter and the parent/guardian of the entrant must read and consent to all terms and conditions. 3. The competition commences on 06/03/2018 at 12.01am (AEDT) and closes on 15/06/2018 at 11.59pm (AEDT) (“Competition Period”). To be eligible, all entries must be received by the Promoter prior to the end of the Promotion Period. 4. To enter the competition participants must, during the Competition Period, visit www.quiksilver.com/thevaliant and enter their name, email address, age, phone number and answer, in 25 words or less, to the question “Why should you win the Quiksilver Valiant” (“Submission”) (“Entry” / “Entries”). Each entrant will only be permitted to submit one (1) Entry. In the event an entrant submits multiple Entries, only the first Entry will qualify. By entering the competition Entrants automatically consent to receive communications from the Promoter and agree to the reasonable use of their name and Submission and grant the Promoter and its affiliates, a royalty-free, worldwide, irrevocable, and perpetual right to use the Submission in any manner as the Promoter may choose, including on its websites, products and in promotional materials produced by or on behalf of the Promoter. 5. All Submissions will be assessed by Mikey Wright (“Judges”) on 15/06/2015 and the Entrant who submitted the most creative Submission, as determined by Mikey Wright, will win a black 1978 Valiant valued at $8,250, Mikey Wright surfboard valued at $850 and 5 pairs of Quiksilver boardshorts valued $79.99 each (“Prize”). Total Prize value is $9499.95. The Promoter takes no responsibility for any variation in the Prize value. This competition is a game of skill and chance plays no part in determining the Winner. The decision of Mikey Wright will be final and no correspondence will be entered into in relation to the competition. Prize Conditions: ? The Prize will be delivered to the winner on or before 31 July, 2018 to the address nominated by the winner. ? The Promoter may require the winner to provide proof of identity, residency and all other required and requested documentation prior to the awarding of the Prize vehicle. Identification considered suitable for verification is at the Promoter’s discretion. ? To be eligible to claim the Prize vehicle, the winner must be able to lawfully take possession of the Prize vehicle and comply with all registration requirements in the winner’s state/territory of residence. If the winner is, through any legal incapacity or otherwise, unable to register the Prize vehicle in their own name, then the winner may assign the Prize vehicle to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. ? Once the winner has taken possession of the Prize vehicle, all risk and responsibility inherent in the Prize vehicle passes on to the winner, and the Promoter will in no way take any responsibility or assume any liability for, or in connection with, the Prize vehicle, or the use thereof. ? The Promoter accepts no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages relating to the Prize vehicle, from date of delivery. Winner is solely responsible for all taxes and expenses which are not included in the Prize description including, but not limited to: registration and licence fees, insurance and other costs incurred in claiming, registering or using the vehicle. ? It is a condition of accepting the Prize vehicle that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion. ? Prize is “AS IS” without any warranty of any kind, express or implied. No substitution, exchange or transfer of prize will be made or is permitted. ? In accepting the Prize, the winner agrees, upon the reasonable request of the Promoter and without remuneration, to participate in all promotional activities (such as interviews and photographs) surrounding the winning of the Prize and consents to the Promoter and its related bodies corporate using their name and image in promotional material. 6. The winner will be notified by email within 24 hours of being selected. The name of the winner will also be announced on the Website on 16/06/2018 (for 30 days). All reasonable efforts will be taken to contact the winner. If the Prize remains unclaimed on 16/09/2018, the Entries will be reassessed and a new winner will be selected (the original winner will have no claim to the Prize). 7. The Promoter reserves the right to disqualify any Entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Entrant who tampers with the entry process, who submits an Entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging. 8. The Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter will not be responsible if the Prize become unavailable for reasons beyond the Promoter’s control. 9. If for any reason this competition is not capable of running as planned, whether caused by infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the Promoter’s control which corrupt or affect the administration, security, fairness or integrity of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition and, subject to any directions from a regulatory authority, select a winner from among all valid Entries received up to such time of cancellation, termination or suspension. 10. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation. 11. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents), excludes all liability (including negligence), for any personal injury or any loss or damage (including, without limitation, indirect, special or consequential loss or loss of profits), which is suffered or sustained in connection with this competition or accepting or using the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law. 12. By entering this Competition, entrants consent to the storage of their personal information in the database of the Promoter and the Promoter may use this information for future promotional and marketing purposes. Without limiting the foregoing, any information Entrants' provide in connection with this Competition will be handled in accordance with the Promoter's Privacy Policy which can be viewed at www.quiksilver.com.au/privacy-policy. 13. This competition shall be governed by the laws of Victoria, Australia and subject to the exclusive jurisdiction of the Victorian courts. This competition shall be void where prohibited by law.
