This competition is a promotion run by Paul Ivan Anthony Tonich (“Promoter”). The Promoter is a sales representative engaged by Realmark Urban, Subiaco: website http://urban.realmark.com.au and phone 08 9388 3911.

Realmark Urban, John Hughes MG and Capita Finance Solutions are Promotion Sponsors.

Entries and information on prizes and how to enter form part of these terms and conditions. Entries not completed in accordance with these Terms and Conditions are ineligible. Participation in this competition constitutes acceptance of these Terms and Conditions.

The competition is open to residents of Western Australia only and all entrants must be 18 years and over, one entry per person unless otherwise specified (i.e. there may be opportunities to submit additional entries offered during the course of the competition refer to conditions below).

The competition will run from 12.00pm AWST Friday 21nd of September 2018 to 9am AWST on Wednesday 19th of December 2018 (the “competition period”). With the draw taking place at 10.00am Saturday 22nd of December 2018 inside the John Hughes MG Dealership 181 Albany Highway Victoria Park WA 6100.

Employees and immediate family members of the Promoter or the Promotion Sponsors and associated persons and/or companies and related entities of the Promoter or the Promotion Sponsor are ineligible to enter.

One winner will be selected at random from the correctly completed entries collected during the competition period.

To qualify for the competition a person must submit their entry via the website address paultonich.com.au/competitions completing all required fields and agreeing to the terms and conditions of this competition the entry by 9am AWST Wednesday 19th December 2018.

All entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected entries.

The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the Entrant to access the website or social media platform of entry via their internet service provider.

If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, power or technical failure, acts of God, civil unrest, strike, war, act of terrorism or any other cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

The prize consists of a MG MG3 motor vehicle 2018 in a drive-away Licenced condition up to the value of $17,500 including on-road costs. Colour and dealer delivery subject to availability. The vehicle will have some mileage. The vehicle will be transferred from the Promoter to the winner and the winner agrees to do all actions necessary to affect the transfer of the vehicle from the Promoter to the winner.

The winner of a car prize must hold a current Australian (if Australian resident) or New Zealand (if New Zealand resident) driver’s licence. If the winner is unable to register the car in their own name, then they may assign the motor vehicle prize to another person (who consents to such assignment). The Promoter takes no responsibility for any such arrangements. The Promoter and prize supplier take no responsibility for petrol, comprehensive insurance, transport, damage from date of delivery. Car prize winner must collect the car as directed by the Promoter. The prize value includes on-road costs.

Without limiting the forgoing, unless expressly stated in the terms and conditions all other expenses are the responsibility of the winner. Prizes are subject to the standard terms and conditions of individual prize suppliers. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize.

Prize components may alter at the discretion of the Promoter. The Promoter reserves the right to substitute with an alternative vehicle of equal or greater value. Any change in the value of the prize between the publishing date and the date prizes are claimed is not the responsibility of the Promoter. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Except as otherwise stated in these terms and conditions, the prize is not transferable, exchangeable or redeemable for cash.

The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including the identity, email address, age and place of residence of the entrant) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The winner will be publicly announced via Facebook live video on Saturday 22nd December 2018 on facebook.com/perthproperty.

The winner will be notified by phone, email or mail. Competition results will also be published by both John Hughes MG and Realmark’s media, including but not limited to Facebook and Instagram. Should an Entrant’s contact details change during the Promotion, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

The winner will be required to visit John Hughes MG dealership on a date agreed upon, within 14 business days of the winner being announced (unless otherwise agreed), to be presented with the prize, sign documents, have photos taken, to be publicised across both John Hughes MG and Realmark’s media, including but not limited to Facebook and Instagram.

The winner’s name will also be publicised by the Promotion Sponsors in their social media, website and other media and publications.

If the winner is unreachable within 7 days of the announcement of the winner, the prize will be automatically forfeited, and another winner will be chosen.

In the event of any prize not being accepted or claimed within 7 business days of initial contact or the winner being unable to be contacted, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct a further draw on or before 31 January 2019.

The Promoter and the Promotion Sponsors does not accept responsibility for any accident, loss, injury or damage to any individual or property arising out of or in connection with the competition or prize, either during or after the competition.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use. Entrants must agree to make themselves available to any reasonable publicity requests made in relation to this competition without charge at a time specified by Realmark Urban and John Hughes MG, Realmark Urban and John Hughes MG has the right to use such publicity photos, voice recordings, winners name in any medium and in any reasonable manner it sees fit. In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winner (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

As part of the Promotion, the Promoter will collect Entrants’ personal information. If the Entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Submission of an entry is deemed to be consent by the Entrant to the Promoter collecting their personal information.

The Promoter will use the personal information to enable an Entrant to participate in the Promotion.

The Promoter may disclose Entrants’ personal information to third parties including its contractors and agents, prize suppliers, Promotion sponsors and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation.

The Promoter and Promotion Sponsors may use entrants’ personal information for future marketing purposes regarding its products, including contacting the entrant electronically. The privacy policies of the Promotion Sponsors are available on their respective websites. By entering their personal details the Entrant has given their consent to be contacted by the Promotion Sponsor.

Personal information will be stored by the Promoter on a database controlled by the Realmark Urban or by a third-party service provider of the Realmark Urban.

Other than as stated, we will otherwise collect, hold, use and disclose your personal information in accordance with the Realmark Privacy Policy, which sets out how you may access and correct the personal information that we hold about you and how to lodge a complaint relating to our treatment of your personal information. The Promoter of this competition will collect your name and contact details in order to include you in this promotion and may contact entrants for the purpose of this promotion.
