Terms and Conditions of Entry
1. The promotion is called “Win the best seats in the house!” (Promotion). Information on how to enter and the prizes to be won form part of these Terms and Conditions.
2. By participating in this Promotion, you agree to be bound by these Terms and Conditions.
3. The Promotion is conducted by People’s Choice Credit Union, the trading name of Australian Central Credit Union Ltd ABN 11 087 651 125, Australian Financial Services Licence 244310 and Australian Credit Licence 244310 of 50 Flinders Street, Adelaide SA 5000 (People’s Choice or we or us or our). The Promotion is conducted in South Australia under the following licence number: T18/2195.
4. The Promotion commences at 10:00am Australian Central Daylight Time (ACDT) on 17/12/2018 and closes at 5:00pm Australian Central Daylight Time (ACDT) on 28/01/2019 (Promotional Period).
5. To enter the Promotion, you must be a resident in South Australia and be aged over 18 years of age, complete the online entry form by visiting peopleschoicecu.com.au/win, input the requested details (including, but not limited to, your full name, date of birth, address, a valid email address and valid contact number), accept these Terms and Conditions and submit the fully completed entry form during the Promotional Period. A person who submits a valid entry for the Promotion will be an 'Entrant' for the purposes of these Terms and Conditions.
6. There is a limit of one (1) entry per Entrant.
7. Officers and employees of People's Choice or its related bodies corporate, or any agencies associated with the Promotion, or the immediate family of such persons, are ineligible to enter this Promotion. "Immediate family" means any of the following: spouses (including de facto partners), parents, children or siblings.
8. There are 100 prizes to be won and used at the five Adelaide Strikers home games described in clause 9. The total recommended retail price (RRP) of all prizes (both Major Prizes and Minor Prizes) is $28,000 comprising both:
a. Major Prizes which consist of 25 x VIP ‘People’s Choice Pavilion’ double pass tickets to gain access to an exclusive area at the Adelaide Oval designated by People's Choice for five (5) winners and their guests during each Adelaide Strikers home game described in clause 9, including a food and beverage package determined by People's Choice. These five (5) double pass tickets available for each Adelaide Strikers home game have a RRP of $500 per person; and
b. Minor Prizes which consist of 75 x General Administration double pass tickets (being 15 double passes available for each Adelaide Strikers home game described in clause 9) with a RRP of $20 per person based on a minimum Adult Ticket Price,
(each a Prize, and together, the Prizes).
Prizes are not transferable, exchangeable or redeemable for cash. Any food and beverage purchased by the Major Prize winners (and/or their guests) at the Adelaide Oval in addition to the food and beverage package supplied as part of the above relevant Prize must be paid for by the Major Prize winner or their guests (as applicable) immediately at the time of purchase.
An individual must be aged over 18 years to gain access to the ‘People’s Choice Pavilion’.
9. Prize draws will be conducted at 11:00am Australian Central Daylight Time (ACDT) at Level 14, 50 Flinders Street Adelaide SA 5000 on the following days:

10. Five (5) Major Prize winners and fifteen (15) Minor Prize winners for each of the Adelaide Strikers home games described in clause 9 will be determined by way of random selection from a computer database containing all entries submitted by Entrants prior to the date and time of the relevant Prize draw. The first five Entrants drawn will win the Major Prizes and the second 15 Entrants drawn will win the Minor Prizes (the Prize winners).
11. People’s Choice reserves the right to verify the validity of entries (including an Entrant's identity, age and place of residence). People's Choice reserves the right, subject to applicable legislation, to disqualify any Entrant who People's Choice determines has tampered with the entry process or has submitted an entry that is not in accordance with these Terms and Conditions.
12. In the event of any dispute as to the identity of an Entrant, People’s Choice reserves the right, in its absolute discretion, to determine the identity of the Entrant.
13. If People's Choice determines that a winning entry does not comply with these Terms and Conditions, and therefore the Entrant is ineligible to win the relevant Prize, an immediate redraw for the Prize will take place at the same location.
14. Entries will be validated by People’s Choice.
15. The Prize winners will be notified via telephone and email on the day of the draw using the contact details provided by the Prize winner as required under clause 5. If People’s Choice is unable to contact the Prize winner by 11:00am (ACDT) on the next business day following the day of the draw or the Prize winner does not want the Prize, a redraw will take place at 3.00pm (ACDT) on that date, and this process will be repeated until the relevant Prize winner has been contacted or the Prize has been accepted by the Prize winner. The Re-Draw Prize Winner will be published on People’s Choice website 1 hour after redraw at 4:00pm (ACDT).
16. All Prizes must be collected by Prize winners in person using photo identification within two business days of the date of the draw, or the date of any redraw as described elsewhere in these Terms and Conditions, from People's Choice at Level 14, 50 Flinders Street, Adelaide SA 5000. Where this is not reasonably possible, we will make reasonable alternative arrangements with the Prize winner for the delivery or collection of the Prize.
17. The names and addresses of each Prize winner who won a Major and Minor Prize as described in clause 8 will be published on People's Choice's website, peopleschoicecu.com.au/winners, on each of the Prize Draw Dates at 12:00pm (ACDT).
18. Except where otherwise required by law, People's Choice's decisions in relation to each Prize draw (including any redraw) and all other aspects of the Promotion are final.
19. You will be required to submit certain personal information to enter this Promotion, which may include (but is not limited to) your name, phone, address and email contact information, and date of birth. All submitted personal information will be collected and used by People’s Choice to administer this Promotion. The terms of People’s Choice’s Privacy Policy, available at https://www.peopleschoicecu.com.au/legal/privacy/, apply to all personal information collected by People's Choice as part of this Promotion. We will not use or disclose your personal information for any purpose other than a purpose described in these Terms and Conditions or the People’s Choice Privacy Policy. By entering the Promotion, you agree that People's Choice can send you marketing material from time to time (subject always to your right to request not to receive such material, as described in People's Choice's Privacy Policy). We may disclose your personal information to other organisations including any external service providers or contractors (who may be located overseas) to enable us to administer this Promotion, operate our business, or as otherwise contemplated by People's Choice's Privacy Policy. By accepting the Prize, Prize winners agree to participate in reasonable promotional activities requested by People's Choice, for no fee or consideration apart from the Prize, and consent to the use of their name, city of origin and image by People’s Choice for promotional and marketing purposes. If you do not want to participate in such promotional activities, or do not agree to provide such consent, you must not enter the Promotion, or if you do enter and win, must decline the Prize.
20. To the maximum extent permitted by law, People's Choice (including its respective officers, employees and agents) is not responsible or liable for, and you release People’s Choice from, any actual or potential liability for any loss suffered or sustained to or by you or any person or property including, but not limited to, indirect or consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by People's Choice, or its officers, employees or agents in connection with this Promotion including, without limitation, loss suffered or sustained as a result of:
a. you or another person being deemed ineligible to win the Prize in the Prize draw;
b. you or another Entrant winning, receiving or using the Prize;
c. any problems or technical failures in respect of the Prize draw or entry in the Prize draw of any kind;
d. unauthorised human intervention or interference in any part of this Promotion; or
e. electronic or human error which may occur in the administration of this Promotion.
21. The Prize winner acknowledges and agrees that they release People’s Choice (including its respective officers, employees and agents) from, and indemnify People’s Choice against, any liability which may otherwise arise to them directly or indirectly from any illness, injury or death suffered by the Prize winner or any other person, or for any loss or damage to the property of the Prize winner or any other person as a result of or in connection with this Promotion or redeeming or using the Prize.
22. To the fullest extent permitted by law, People's Choice provides the Prize 'as-is', and makes no representations, warranties or guarantees regarding the quality, suitability, merchantability or any other aspect of the Prize.
23. The above Terms and Conditions do not affect, and are not intended to affect, any rights you may have under applicable legislation, including but not limited to the Competition and Consumer Act 2010 (Cth), which cannot legally be limited or excluded by People's Choice.
24. If for any reason this Promotion is not capable of being run as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of People's Choice which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, People's Choice reserves the right in its sole discretion but subject to the approval of those government authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend this Promotion.
25. These Terms and Conditions constitute the entire agreement of the parties relating to the conduct of this Promotion.
26. If any term of these Terms and Conditions or any part thereof is or becomes or is declared illegal, invalid or unenforceable for any reason whatsoever in any jurisdiction and such term or part is severable, it is deemed deleted from these Terms and Conditions in the relevant jurisdiction.
27. The Terms and Conditions shall be governed by and interpreted in accordance with the laws in force in South Australia.
