TERMS AND CONDITIONS APPLICABLE TO Expedition Giveaway
The Promoter is 5th Element Expeditions Ltd, [ABN: 69 147 308 290]
Promotional period: From November 2015 to 30 November 2016 to Day month year time.
Entry is open to all Australian and New Zealand Residents above
METHOD OF ENTRY
To enter, participants must provide required contact details and submit in 100words or less tell us what Adventure means to you.
a) Competition entries are to be submitted via the website and
b) Entries must also be posted on social media through the 5th Element Expeditions Facebook page All entries must tag their post #explorewith5th and #adventurewith5th
The Winner must agree to be contacted by 5th Element Expeditions and to provide their details including (but not limited to) name, email, address and phone number. The Winner must also acknowledge they have read and understood these terms of entry.
Reserves the right to request winners to provide proof of residency status at the nominated prize delivery address and/or proof of entry validity, in order to claim the prize. Acceptance of proof of identification, Residency status and entry considered suitable for verification is at the discretion of 5th Element Expeditions. In the event that a winner cannot provide proof, the winner will forfeit the prize in whole and no substitute will be offered.
Incomprehensible and incomplete entries will be deemed invalid.
All entrant details are logged in a database. Through the process of submission, entrants agree to subscribe to 5th Element Expedition communications via email and social media.
PRIZE AND NOTIFICATION
The Prize is: Invitation to join Geoff Wilson and the expedition team on a single expedition between the period of November 30 2016 and November 30 2017. The winner will receive a choice of two expeditions at two separate dates throughout the year. The full inclusions of the expeditions
The timing of the expedition is at the sole digression and availability of 5th Element Expeditions.
Should the winner not be available to join the expedition on the dates provided then they will forfeit any right to claim their prize.
Process of drawing a winner is via Judging and selection process up to the sole digression of the 5th Element team
The winner will be contacted via email and a notice will be advertised on the 5th Element website, social media and email communications.
If the Prize Winner cannot be contacted by the December 30 2016, the prize will be re drawn by the promoter in its absolute discretion. The second draw winner will be notified via email or telephone.
There may be circumstances in which the Promoter cannot provide the prizes as described for reasons beyond its reasonable control. In those circumstances, the Promoter will provide an alternative prize or prizes of equal or greater value to the promoted prizes.
Prizes are not transferable or exchangeable and cannot be taken as cash.
5th Element Expeditions accepts no responsibility for any loss, damages, or injury incurred to enter the competition or in connection with taking up the prizes.
Once prizes have left the prize supplier’s premises, we take no responsibility for prizes damaged, delayed or lost in transit.
TRAVEL & INSURANCE
Travel – flights or transport of any kind to the expedition starting point is not included in the prize. The winner is responsible for getting to the expedition starting point at there own cost.
The winner must arrange their own travel insurance to cover the full extent of the activities to be engaged during the expedition.
5th Element expeditions nor prize supplier/s or their associated companies will be held liable for any loss, damage or injury of the results directly or indirectly from the Winner taking part in any aspect of the prize. Where relevant, the Winner agrees that they take full responsibility for any activities engaged in while travelling and engaging in the prize package and will take out appropriate travel insurance.
Winners is responsible for all costs not expressly listed as being included in the Prize, including without limitation, meals, entertainment, other travel and accommodation, transfers, passports, visas, re-entry permits, spending money, freights, excess baggage, government taxes, departure taxes, ground transportation any tax liabilities, airport charges, any applicable surcharges and any other related costs. Travel insurance is not included in the Prize and will be the responsibility of the Winner. Travel insurance required to protect against the additional costs incurred in the event of unforeseen circumstances.
Travel arrangements to and from expedition start point do not form part of the prize and are the responsibility of the Winner.
It is the responsibility of the Winner to enquire about local issues and conditions at destinations before travel.
Neither 5th Element Expeditions nor the prize supplier or their associated companies is responsible, to the extent permitted by law, for acts of god, acts of terrorism or war (declared or undeclared) or other events beyond 5th Element Expeditions and prize supplier’s control which prevent awarding or acceptance of the prize in accordance with the prize description.
