TERMS & CONDITIONS:
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in the “Werther’s Original Win a Trip To Japan, Hawaii or Tuscany” promotion (Promotion) is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1 Smail Street, Ultimo NSW 2007, telephone: 1800 225 417 (Promoter), participating retailers and agencies associated with the Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promotion commences at 09:00am AEST on 27/06/2016 and ends at 11:59pm AEST on 30/09/2016 (Promotion Period).
To be eligible to enter, individuals must purchase any Werther’s Original product from a Participating Retailer (“Qualifying Purchase”). For the purposes of this Promotion, a (“Participating Retailer”) is any Australia Post shop, independent supermarket or convenience store in Australia that stocks Werther’s Original products and displays promotional advertising material for this Promotion during the Promotional Period. Participating Retailers EXCLUDES all Coles, Woolworths/Safeway and Aldi branded supermarkets and convenience stores e.g. Coles Express and Woolworths Petrol. For clarity, if an individual purchases any Werther’s Original product from a retailer that is not displaying the promotional advertising material during the Promotional Period then that product will not be eligible for entry into the promotion under the Qualifying Purchase requirement.
To enter, individuals must then complete one (1) of the following two (2) mechanics during the Promotional Period:
a) Enter by Mail: Complete the official entry form, found in any Participating Retailer, in full including their full name, date of birth, residential address, contact telephone number, a valid email address and the last 6 digits of the product barcode found on the back of the Werther’s Original bag or roll product, and then send to: “Werther’s Original Win a trip to Tokyo, Hawaii or Tuscany” Promotion, PO Box 6361, Frenchs Forest NSW 2086; or
b) Enter Online: visit www.werthersdreamholiday.com and input the requested details including their full name, date of birth, residential address, contact telephone number, a valid email address and the last 6 digits of the product barcode found on the back of the Werther’s Original bag or roll product, and submit the fully completed online entry form.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a Prize. Purchase receipt(s) must clearly specify the Participating Retailer of purchase, that an eligible product(s) was purchased and that the purchase was made during the Promotional Period but prior to the date of entry into the Promotion.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Purchase made; (b) each entry must be submitted separately in accordance with entry requirements; and (c) unrecognised barcode numbers will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Handling Matters, Unit 1/3 Green Street, Brookvale NSW 2100 on 17/10/2016 at 12:00pm (noon) AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 31/10/2016.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn from all entries received will win a trip for two (2) adults to the winner’s choice of either Japan, Hawaii or Tuscany valued at up to AUD$21,000 depending on destination chosen, travel dates and point of departure (“Prize”). The Prize inclusions for each destination are for two (2) adults and are as follows:
Japan
Return economy airfares for two (2) adults from the winner’s nearest Australian state capital city to Tokyo, Japan;
Return airport to hotel transfers;
Six (6) nights superior accommodation in Tokyo (4 star or equivalent) in a twin/double room;
A full day group guided tour of the Cherry Blossoms (only available if the winner chooses to travel during the Cherry Blossom season which varies from year to year, however is generally March/April/May and advance booking is mandatory). In the event a winner elects to take the prize outside of the Cherry Blossom Season, this component of the prize will be substituted for a different tour (up to the value of the Cherry Blossom tour) and selection of this substituted tour will be at the Promoter’s discretion;
A four (4) hour guided tour of Tsukiji Fish Market and Sushi Making at Local Home;
A three (3) hour guided ‘Tokyo by night’ tour including an evening with an hour in a private karaoke booth;
A two (2) hour Tokyo Rickshaw tour through the streets of Asakusa;
A Hakone Mt Fuji National Park Full Day Tour; and
AUD$1,000 spending money (for the winner only).
Hawaii
Return economy airfares for two (2) adults from the winner’s nearest Australian state capital city to Honolulu, Hawaii
Return airport to hotel transfers;
Six (6) nights superior accommodation (4 star or equivalent) in a twin/double room;
A private sunset fireworks cruise including hors d'oeuvres and complimentary boat beverages;
A 30 minute Helicopter tour of Hawaii (max weight limitations per person apply); and
AUD$1,000 spending money (for the winner only)
Tuscany
Return economy airfares for two (2) adults from the winner’s nearest Australian state capital city to Florence, Italy;
Return airport to hotel transfers;
Seven (7) nights superior accommodation in Florence (4 star or equivalent) in a twin/double room;
A five (5) hour group wine tasting tour of the Chianti region;
A Hot Air balloon flight over Tuscany;
A Cooking Class and Lunch at a Tuscan Farmhouse with Local Market Tour from Florence, including a market visit and cooking class, and a 4-course lunch, a cooking diploma and a souvenir apron and recipe book;
A small group wine and truffle tour; and
AUD$1,000 spending money (for the winner only).
The Winner will be required to sign a Prize acceptance form including a liability and publicity waiver within six (6) weeks of being successfully notified as the winner to formally accept the Prize. The winner’s companion will also be required to sign a Prize acceptance form including a liability and publicity waiver before the Prize booking can be made. The winner must finalise the Prize booking within 12 weeks of the prize draw and all travel must be completed within 12 months of the prize draw and is subject to booking and flight availability. Winner must book at least 90 days prior to intended travel departure.
The Prize winner and companion must travel together. Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $150 including GST plus supplier charges which is payable by the winner. Prize travel tickets are not transferable, not redeemable for cash and their validity cannot be extended.
Prize is a single event holiday and cannot be separated into different holiday vacations. All passengers must travel together on the same flights and stay at the same property and in the same room. No compensation or alternative travel plans will be arranged should the Prize winner and/or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner. A credit card imprint may be required from the winner at check-in to the hotel for all incidental charges. Travel suppliers/airlines to be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency). Comprehensive travel insurance is strongly recommended and at the expense of the winner. If the winner chooses not to purchase travel insurance they will be required to complete a travel insurance waiver form acknowledging that they understand the benefits of travel insurance but decline to take out a policy. Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the Prize winner and their companion/s including but not limited to additional meals, additional spending money, incidentals, mini-bar, laundry, room service, telephone calls, taxes (excluding airline and airport taxes, if applicable), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, and all other ancillary costs. The winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation. The Prize winner cannot upgrade any travel or accommodation element of the Prize using cash or frequent flyer points. Frequent flyer points will not form part of the Prize.
If for any reason the winner chooses not take the Prize (or an element of the Prize) at or by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.
If a Prize (or part of the Prize) is unavailable due to circumstances beyond the Promoter’s control (including due to seasonal availability), the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority. It is the Prize winner’s responsibility to enquire whether particular Prize elements (eg the Cherry Blossom tour) are only seasonally available.
The Prize winner acknowledges that the Prize may be subject to additional terms and conditions imposed by third party Prize suppliers. The Prize winner must become acquainted with any such additional terms and conditions before taking the Prize. The Promoter does not accept any responsibility, and is not liable for, any additional conditions imposed on the taking of the Prize, or for the breach of those conditions by any person.
Prize travel is subject to fare rules and other carriers’ conditions of carriage. Tickets will not be exchanged for another destination. The Prize winner must stay at the nominated place of accommodation. The Prize winner must book Prize travel and Prize accommodation directly with the Promoter or the Promoter’s nominated contractor, unless advised otherwise at the time of claiming the Prize. All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. Availability cannot be guaranteed during Christmas, Easter, holidays and special event periods. Travel must be booked at a minimum of 90 days prior to requested departure date. All bookings and documentation regarding the Prize must be made via the Promoter or the Promoter’s nominated contractor. Redeeming the Prize is conditional on acceptance of the terms and conditions of travel as detailed by the suppliers of the Prize and the airline carriers in accordance with normal travel practices. Winner and companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure for travel to international destinations. Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Insurance and any applicable insurance excesses, not listed in the travel Prize package descriptions above are the responsibility of the travel Prize winner and his/her nominated traveling companion as incurred. Flight schedules and accommodation arrangements are subject to change without notice.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a Prize, subject to any written directions from a relevant regulatory authority.
If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total Prize pool value is up to AU$21,000. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash.
A draw for the Prize if unclaimed may take place on 18/01/2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner (if any) will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 01/02/2017.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with entering the Promotion, including accessing the Promotion website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any Prize tour or activity is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use/taking of the Prize.
As a condition of accepting the Prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.stuartalexander.com.au/privacypolicy.php. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
