This promotion is governed by these terms and conditions ("Terms and Conditions"). Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to Australian residents, aged 13 years and over. Entrants under 18 years old must have parental/legal guardian approval to enter and further, the parent/legal guardian of the entrant must read and consent to all terms and conditions. Parents/legal guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion.
Employees (and their immediate families) of the Promoter, participating Caltex stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 12:00am AEDT on 09/11/2016 and ends at 11:59pm AEDT on 06/12/2016 ("Promotional Period").
To be eligible to enter, individuals must purchase any 5 Gum or Hubba Bubba product from a participating Caltex store in Australia ("Qualifying Transaction") during the Promotional Period.
To enter, individuals must go to www.chewstowin.com.au and follow the prompts within the competition entry page, input the requested details including their full name, email address, postcode, contact phone number, product purchased and last 4 digits of product barcode, receipt number and submit the fully completed entry form during the Promotional Period.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid and will not be accepted.
Multiple entries are permitted subject to the following: (a) only 1 (one) entry permitted per Qualifying Transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of 1 (one) entry per person per day is permitted.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant and to disqualify any entrant whom the Promoter believes has either tampered with the entry process or has submitted an entry that is not in accordance with these Terms and Conditions. For the avoidance of doubt, should an entrant breach these Terms and Conditions (including, but not limited to, entering more times than permitted, using multiple emails accounts for a single entrant, use of circumvention or automated technology or otherwise interfering with the entry mechanism or the promotion site) all entries submitted by that entrant will be disqualified and no further entries will be accepted from that entrant. The Promoter’s decision is final and no correspondence will be entered into.
Entrants have the option to upload a photo of their purchase receipt for their Qualifying Transaction as proof of purchase at time of entry. If an entrant opts not to upload a photo of their purchase receipt, the entrant must retain their original purchase receipt. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipts must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
There will be 1 (one) draw conducted for the entries received each day of the Promotional Period, for a total of 28 (twenty eight) draws ("Daily Draws"). Entries into each Daily Draw will open and close each day at 12:00am AEDT and 11:59pm AEDT respectively. Each Daily Draw will take place at Prime Focus, Level 1, 500 Chapel Street, South Yarra VIC 3141 at 12:00pm AEDT on the business day after entries close for that Daily Draw, with the first Daily Draw taking place on 10/11/2016 and the last Daily Draw taking place on 07/12/2016. For the removal of doubt, no draws will be conducted during the weekend. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draws. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winners will be notified in writing and via phone within 2 (two) working days of the relevant Daily Draw taking place and their names will be published on chewstowin.com.au/Caltex from 24/11/16 for Daily Draws 10/11/2016 to 23/11/16 and 08/12/16 for daily draws 24/11/2016 to 07/12/2016
Prize Details
The first valid entry drawn in each Daily Draw will win a DJI Phantom 3 Standard drone with Integrated 2.7K UHD Stabilised Camera valued at $1,299.00. Prize is subject to the warranty terms and conditions of the manufacturer SZ DJI Technology co., Ltd and its affiliated companies. Prize must be used in accordance with all applicable laws and each winner is responsible for their own conduct in this respect.
If a prize winner is under 18 years of age ("Minor Winner"), the prize will be awarded to the Minor Winner’s nominated parent or legal guardian on the Minor Winner’s behalf. The parent or legal guardian may be required to sign a form provided by the Promoter confirming that the person is the Minor Winner’s parent or legal guardian, and may also be required to present valid identification (as determined by the Promoter in its sole discretion which may include a drivers licence or passport).
Subject to clause 20 below, if for any reason a winner does not redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Total prize pool value for this promotion is $36,372.00
A draw for any unclaimed prizes, may take place on 15/03/2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone within 2 (two) working days of the draw and their names will be published in The Australian newspaper on 17/03/2017.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, infection by computer virus, unauthorised intervention or fraud, which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant who the Promoter suspects has tampered with the entry process; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify the promotion.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
The Promoter reserves the right to reasonably amend or vary these Terms and Conditions at its sole discretion subject to the approval of the relevant regulatory authorities.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; and any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize.
As a condition of accepting a prize, winners must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner is under the age of 18, a nominated parent/legal guardian of that winner will be required to sign the legal documentation required under this clause on their behalf.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle the information as set out in its Privacy Policy, which can be viewed at. http://www.wrigley.com/aunz/privacy-policy.aspx. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
