Citroën EuroPass ‘Win a European Holiday’ Competition Terms and Conditions
1. By entering the Citroën EuroPass "Win a European Holiday" competition ("Competition"), each entrant agrees to
accept and be bound by:
(a) these Terms and Conditions;
(b) Citroen EuroPass booking terms and conditions – available at this link:

(c) Facebook Rules - available at this link: https://www.facebook.com/policies.
2. The promoter is Sime Darby Motors Wholesale Australia Pty Ltd, trading as Citroen EuroPass Australia ABN 58
116 052 754 of 326 Church Street, Granville, NSW 2142 (“Promoter”).
3. The Competition is open between 8 November 2017 and 11:59pm AEST on 20 December 2017 ("Competition
Period").
4. The Competition is open to Australian residents aged 18 or over who hold a full Australian drivers licence and
have Facebook and Facebook Messenger accounts during the Competition Period but excludes employees,
immediate families of employees, management or contractors of the Promoter, travel agencies and agencies
associated with this Competition or the Promoter ("Eligible Entrant").
5. To enter the Competition, an Eligible Entrant must during the Competition Period complete the following steps:
(a) tag a Facebook friend in the comments on any of the Citroën Euro Pass competition Facebook posts
entitled , “Tag a friend and tell us where you would drive through Europe together & why”; or
(b) access our competition page via this link http://www.citroeneuropass.com.au/competition which also
includes subscribing to our mailing list and follow the steps explained on the page.
and in 20 words or less specify in the comment or where provided in our competition entry page, where and why
you would drive through Europe with that friend,
(an “Entry”).
6. Only one (1) Entry is permitted per person during the Competition Period.
7. The Entries will be judged by a panel of judges from the Promoter. Each entry will be individually judged and the
winner will be determined on creative merit and perceived authenticity of the Entry by the judges ("Winner"). The
judging will take place at Citroën EuroPass, 326 Church Street, Granville, NSW 2142, at 12:00pm AEST on
Thursday 21 December 2017. The judges may chose additional reserve Entries which they determine to be the
next best, and record them in order, in case of an invalid entry or ineligible Entrant.
8. The judges’ decision is final and no correspondence will be entered into.
9. Incomplete, indecipherable or illegible entries will be deemed invalid. The Promoter accepts no responsibility for
any Entries not received for any reason during the Competition Period.
10. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s
identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Entrant who the
Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry
process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct
of the Competition.
11. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to
determine the identity of the Entrant.
12. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13. The Winner will win:
(a) return flight/s between Australia and Paris in 2018 to the value of $4,000 and receive any balance leftover
on a travel card to be spent during the Winner's trip to Europe; and
(b) a 21 day Citroen EuroPass in a Group 1 - Citroen C3 petrol manual with GPS, to be collected and
returned to the Promoter's specified location in Paris before the end of 2018,
("the Prize").
14. The Winner will be notified by Facebook Messenger by a representative of the Promoter by 22 December 2017. If
the prize has not been claimed by the winner by 5pm AEDST on 31 January 2018, the Prize will be forfeited by
the Winner and awarded to the next-best valid entry selected under clause 107 ("Alternative Winner"). The
Alternative Winner will then be notified by phone and email by a representative of the Promoter within two (2)
business days of the Winner's forfeiture. If the Alternative Winner has not claimed the Prize after seven (7) days
from the day of notification that Alternative Winner will forfeit the Prize and a new Alternative Winner will be
selected. If the Prize is not claimed before 28 February 2018, the Promoter may, in its absolute discretion, retain
the prize.
15. Total prize value is worth up to AUD$5,499. The Promoter will provide the prize winner with advice on how to
book the Citroen EuroPass.
16. By entering the Competition, an Eligible Entrant:
(a) agrees that if they are the Winner, they will provide the Promoter with at least ten (10) high quality digital
photos of their Prize driving holiday (some of which must include the Winner and the vehicle) and
authorises the Promoter to use those photos for Citroen EuroPass Promotional purposes;
(b) consents to the Promoter using the Entrant’s name, likeness, image and/or voice in the event they are the
Winner (including exclusive use of the photographs referred to in 16(a)) in any media including social
media sites for an unlimited period without remuneration for the purpose of promoting this competition
(including any outcome), and promoting any services supplied by the Promoter;
(c) agrees and acknowledges that any cost associated with accessing the Competition website is the
Entrant’s responsibility and is dependent on their internet service provider used; and
(d) agrees and acknowledges that all Entries submitted become the property of the Promoter.
17. The Winner is responsible for spending money or meals beyond the balance of the $4,000 prize, additional
transport, visas, passports, fuel, insurance, taxes and all other ancillary costs.
18. The Prize must be used during the 2018 calendar year.
19. The Winner of the Prize is responsible for assessing their ability to safely participate in the Prize. It is a condition
of accepting the prize that the winner may be required to sign a legal release form determined by the Promoter in
its absolute discretion.
20. To the extent permitted by law, if the Prize (or part of the Prize) is unavailable for whatever reason, the Promoter,
in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize of equal value or
greater value.
21. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash,
unless specified otherwise.
22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due
to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in their sole
discretion, to the fullest extent permitted by law to cancel, terminate, modify or suspend the Competition.
23. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the
Competition and Consumer Act 2010 (Cth) or any other legislation which may not be excluded, restricted or
modified by agreement.
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents)
excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition,
including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment
malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party
interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after
their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation
in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the Winner or Entrant;
(f) use of the Prize.
25. The Promoter collects your personal information for the purposes of assisting with the administration of the
Competition and contacting Entrants for marketing purposes by phone or email. The Promoter may, for this
purpose, disclose such information to third parties, other agents, contractors and prize suppliers. If the Promoter
sends personal information out of Australia, they will require that the recipient of the information complies with
privacy laws and contractual obligations to maintain the security of the data. Entry is conditional on providing this
information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or
telephoning the Entrant. Entrants should direct any complaints, requests to access, update or correct information
to the Promoter. Use and disclosure of information shared with the Promoter as part of this Competition will be
handled in accordance with the Promoter’s Privacy Policy which can be located at:
https://www.citroeneuropass.com.au/home/privacy-and-legal/. The Privacy Policy also contains information
about how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law.
26. By entering this Competition, the Entrant agree to release Facebook and its associated companies from all liability
arising in respect of the Competition and acknowledges that:
(a) this Competition is in no way sponsored, endorsed or administered by, or associated with Facebook.
(b) they are providing their information to the Promoter and not to Facebook.
(c) the information the Entrant provides will only be used for the purposes outlined in these Terms and
Conditions.
(d) any questions, comments or complaints about this Competition must be directed to the Promoter and not
to Facebook.
27. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an Entrant,
as a result of participating in the Competition (including taking/use of a prize), except for any liability which cannot
be excluded by law.
