The promoter of this Travel Moments Competition (?Competition?) is Columbus Direct Travel Insurance Pty Ltd, a company registered in Australia, whose registered address is at Level 13, 124 Walker Street, North Sydney NSW 2060, Australia, Tel: 1300 669 999, with registered company number ABN 99 107 050 582 ("Promoter").
The Competition is only open to Australian and New Zealand residents aged 18 or over. Internet access is required. Entrants are required to be members of Facebook and can only enter and participate via Facebook. If you need to set up a Facebook account, visit https://www.facebook.com and follow the instructions and read and comply with the Facebook Terms and Conditions.
The Competition will run on Facebook from 11:30am on the 31st March 2016 to 10:59am on the 6th May 2016 Sydney, Australia time only (the ?Competition Period?). Entries submitted after the Competition Period will not be accepted. All times are in AEDST/AEST as applicable.
Information on how to enter and the prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
To enter this Competition entrants must, during the Competition Period:
read these Terms and Conditions;
either (i) write a short description of their favourite travel moment (in fifty (50) words or less) (?Description?); or (ii) take a photo that showcases their favourite travel moment (?Photo?);
add the Description or Photo (Photos must include a caption) as a comment to the Travel Moments Competition post on the Columbus Direct Travel Insurance Australia and NZ Facebook page at https://www.facebook.com/ColumbusDirectAusNZ.
The First Prize (defined below) will be awarded to the entrant with the most creative and original Description and/or Photo as determined by the Promoter's judging panel, which will have at least one (1) independent person. The Second Prize (defined below) will be awarded to the entrant whose Description or Photo received the most 'likes' during the Competition Period. This is a game of skill and chance plays no part in determining the winner/s. Each entry will be individually judged based on the criteria listed above. In the event of a tie between two (2) or more entrants for the Second Prize, the Promoter?s judging panel will judge all tied entries and select the best entry in its absolute discretion.
The first prize is a GoPro Hero Sports Camera GPCHDHA-301 and one (1) set of ten (10) idTagit baggage tags valued at $229 (?First Prize?). The second prize is a FUJIFILM Instax Mini 8 Camera Bundle and one (1) set of ten (10) idTagit baggage tags valued at $129 ("Second Prize"). Both the First Prize and the Second Prize ("Prize","Prizes","Prize/s") will be posted to the winner/s by pre-paid post within thirty (30) days of the winner/s accepting the Prize/s. Winner/s can accept the Prize/s by following the instructions in the Facebook message the Promoter will send to notify the winner/s that they have won. Any additional costs incurred by the winner/s will be at their own expense. Any further details of prize delivery or collection will be shared with the winner/s when they are notified they have won. The Promoter accepts no responsibility and no liability will be accepted by the Promoter if a Prize is lost or damaged whilst in transit to the winner.
Total prize pool value is $358.
The judging will take place at 13:00 on 6th May 2016 at the Columbus Direct Travel Insurance Pty Limited office, Level 13, 124 Walker Street, North Sydney, NSW 2060. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The winner/s will be notified within seven (7) days of this date via a private Facebook message. While the Promoter will make reasonable efforts to notify the winner/s, the Promoter does not accept responsibility for winners not receiving notification for any reason. It is the entrant's responsibility to maintain access to their Facebook message inbox. Entrants who have not won a Prize will not be notified. The judges? decision is final and no correspondence will be entered into.
Only one (1) entry per person is permitted per Facebook account. All entries by anyone found to use multiple Facebook accounts to enter will be declared invalid and disqualified from this Competition. The Promoter reserves the right, at any time to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
No purchase necessary to enter. No entries from agents, third parties, organised groups, syndicates or applications automatically generated by computer will be accepted. No incomplete, delayed in transit, automatically generated by computer, illegible, corrupted entries or entries from multiple accounts will be accepted. In the event of this clause being breached, the entrant will be disqualified and any Prize/s awarded will be void. Any malicious or manipulative attempt to influence the Competition outcome will result in disqualification at the sole discretion of the Promoter. If there is any reason to believe that there has been a breach of these Terms and Conditions or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may, at its sole discretion, refuse to fulfil the Prize/s.
The Competition is not open to: employees of the Promoter or its holding or subsidiary companies or their families, or anyone else who is connected to this Competition, including third party promotional partners.
Photos and/or Descriptions used to enter into this Competition must be the original independent work of the entrant and must not have been previously published. Entries must not have won prizes or awards in other competitions or be restricted in any way. Entrants confirm they have all necessary consents and releases in order to enter their Photo and/or Description into this Competition. For clarity, the Photo does not need to have been taken during the Competition Period itself.
The Promoter reserves the right to verify the validity of entries and entrants (including an entrant?s identity, age, Facebook account and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Entries which are not or appear not to be in accordance with these Terms and Conditions may be disqualified.
Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, Photo?s and Descriptions (?Content?). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that entries (including but not limited to Descriptions and Photos) for this Competition cannot:
Infringe the copyright or other intellectual property rights of any third party;
Be violent, negative or/and discriminative of any ethnic, racial, gender, religious, professional or age group, or be profane or obscene;
Promote or be about the use of illegal drugs, tobacco, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message;
Be offensive or be about hate;
Defame, misrepresent or contain negative remarks about the Promoter or its products, other people, products or companies;
Contain trademarks owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
Contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media or musical "samples") without permission;
Contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead;
Communicate messages or images inconsistent with the positive images and/or goodwill to which the Promoter wishes to associate;
Depict, and cannot itself be in, violation of any law.
The Promoter reserves the right to remove entries from the Columbus Direct Travel Insurance Australia and NZ Facebook page for any reason and without notice.
Any inappropriate or offensive material may be reported to the appropriate authorities.
If for any reason a winner does not take/redeem a Prize (or an element of a Prize) then the Prize (or that element of the Prize) will be forfeited.
Entrants will retain copyright in their submitted entries, however, by entering, all entrants licence the Promoter an exclusive worldwide perpetual licence to edit, publish, reproduce, distribute, make available, modify and use the entries, in whole or in part, in any and all media (including print and online) without any further reference, payment or other compensation to the entrant. The Promoter reserves the right to publish entries (including parts of entries) although publication does not necessarily mean the entrant has won the Prize.
Entry is free but entrants should be aware that they may be subject to local call charges depending on their own individual arrangements for Internet access. Any costs associated with an individual entering the Competition are the responsibility of the entrant and are dependent on the Internet service provider used.
There is no other alternative to the Prizes stated and neither of the Prizes are transferable or exchangeable and no part or parts of the Prize/s may be substituted for other benefits, items or additions.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
By entering, entrants agree to allow the free use of their names, photographs and general locations for publicity and news purposes and any other reasonable and related promotional purposes during this and future promotions by the Promoter but under no circumstances, will the participants? personal data be published without prior written permission from the participants.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (?Non-Excludable Guarantees?). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter?s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of or taking a Prize.
The Promoter accepts no responsibility or liability for loss or damage arising from an inability to enter the Competition due to computer failure, viruses, bugs and other such similar causes, lost, delayed or incomplete entries howsoever arising.
Entry to the Competition is dependent upon the entrant entering the Competition via online access not under the ownership or control of the Promoter. The entrant accepts and acknowledges that the Promoter has no liability for loss or damage arising from the entrant interacting with those third party computer systems or similar or any failure, bug, error, corruption or virus in or caused by those third party computer systems or similar.
By entering, all entrants agree to abide by each and all of these Terms and Conditions. The Promoter reserves the right, with or without cause, to exclude entrants and withhold Prizes for violating any of these Terms and Conditions.
In entering this Competition, entrants confirm that they are eligible to do so and eligible to claim the Prize/s. The Promoter may require the winner/s to provide proof that they are eligible to enter the Competition.
The Promoter reserves the right at any time to cancel, modify or supersede the Competition, to the fullest extent permitted by law, (including altering Prizes) if, in their sole discretion, a Competition is not capable for being conducted as specified or is interfered with in any way. The Promoter reserves the right to substitute a prize of equal value and or specification in the event of any unforeseen circumstances beyond their control making this unavoidable.

This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook. The entrants agree that they are providing their information to the Promoter, not to Facebook. By entering the Competition, all participants agree to a complete liability release for Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. If any provision of these Terms and Conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforce-ability of any other provisions not held to be invalid.
