WHO CAN ENTER?
• To be eligible to Win one (1) Softball Holiday Package (competition) you must: • be aged 18+; and • reside in Australia • Employees of Softball Australia and TFE Hotels, their immediate families and any agencies associated with this competition are ineligible to enter. HOW TO ENTER • The Competition Period commences on Monday 30 November 2020 at 10:00AM and ends on Monday 21 December 2020 at 5:00PM (Competition Period), and Softball Australia reserves the right to extend the competition end date at any time (subject to regulatory approval, if required). • To enter the competition, you must submit an online entry by providing your full name, state of residence, telephone number, email address, opt in to Softball Australia, TFE Hotels eclub, East Coast Car Rentals and American Tourister communications and accept these Terms and Conditions where required on the competition landing page at softball.sponsorship-hub.com/holiday-kickstarter-package during the Competition Period. • The competition will be advertised on the Softball Australia website, Softball Australia Facebook and Instagram pages Travelodge Hotels Australia Facebook and Instagram pages, East Coast Car Rentals Facebook and Instagram pages and American Tourister Facebook and Instagram pages and will include a link or instructions to the competition landing page. • No late entries will be accepted. • A limit of one entry to the competition per person applies. SELECTION OF WINNERS • One (1) winner will be chosen by random draw which will take place on Tuesday 19 January 2021 at 10:00AM at Softball Australia head office, Level 2, La Trobe Sports Stadium, La Trobe University Melbourne Campus, Bundoora, VIC 3086, Australia. The first valid entry drawn will win the prize as described below. • The winners will be notified by email and posted on Softball Australia website, Softball Australia Facebook and Instagram pages and Travelodge Hotels Australia & New Zealand Facebook and Instagram pages by 5pm AEDT on the day of the draw. • The results of the draw will be final, and binding and no correspondence will be entered into in relation to the results of the draw. This is a game of chance. • Publish on Website: https://www.softball.org.au/ UNCLAIMED PRIZE DRAW • If the winner does not respond within 3 months of being notified by Softball Australia that they have won the competition, the winner is not readily identified and reasonable efforts have been made by Softball Australia to identify that winner were unsuccessful, they will automatically forfeit their prize and Softball Australia reserves the right to select another winner through an unclaimed prize draw. • If necessary, an unclaimed prize draw will be held on Tuesday, 19 April 2021 at 10:00AM at the same time and place as the first draw. The first valid entry drawn will win any unclaimed prizes. The unclaimed prize draw winner will be notified by email on the day of the draw and posted on the Softball Australia website by 5pm AEDT on the day of the draw. • The results of any unclaimed prize draw will be final, and binding and no correspondence will be entered into in relation to the results of the draw. • Publish on Website: https://www.softball.org.au/ PROMOTION AND MARKETING • By entering the competition, the winners agree to participate in such promotional activity and material as Softball Australia may require without remuneration. • The winner also gives consent for the use and publication of their name and any other details provided by the winners in any marketing material without any further reference or payment to the winners. PRIZE • A total of one (1) prize winner will each receive: 1. Three (3) nights’ accommodation at a TFE hotel anywhere in Australia valued at AUD $600. Valid for 12 months after winner is drawn. 2. Four (4) day car hire from East Coast Car Rentals valued at AUD $400. Valid for 12 months after winner is drawn. 3. One (1) American Tourister suitcase up to the value of AUD $1,000 RRP § American Tourister Australia prize must be redeemed by 19th February 2021. § If for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited. § If any prize (or part of any prize) is unavailable, American Tourister Australia, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. § American Tourister Australia Prize, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. § The winners agree not to sell, offer to sell or use the Prize for any commercial or promotional purposes (including placing the Prize on an internet auction site). § The winner will be contacted by American Tourister’s representative to redeem the American Tourister prize. One (1) Signed Softball Australia Summer Slam Jersey from the team of your choice valued at AUD $59.99 • The total prize pool value is up to AUD $2,059.99 • Post entry, the entrant may choose to complete an additional survey for ten (10) bonus entries. Following completion, the entrant will be eligible for eleven (11) entries into the promotion. • The prize does not include any costs associated with redeeming the prize such as travel, meals, accommodation, spending money or taxes. • The prize will not be transferable to another person. • No part of a prize is exchangeable or redeemable for cash or any other prize. • If the prize is not available for any reason, Softball Australia reserves the right to substitute the prize with another item of equal or greater value if the winners agree in writing and subject to any written directions from any applicable regulatory authority. If the winners do not agree despite reasonable attempts by Softball Australia to reach an agreement and the prize is not available due to circumstances beyond Softball Australia control Softball Australia may substitute the prize with another item or items determined by Softball Australia to be of equal or higher value. • Softball Australia will take reasonable steps to distribute the prize to the winner within 28 days of the draw. If you enter the competition, we will assume that you have read these terms and conditions and that you agree to them. • Softball Australia reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval (if required) and will notify entrants of any such amendments as soon as reasonably practicable on the competition landing page at softballau.sponsorship-hub.com/competition. It is the entrant's responsibility to regularly check the competition landing page for any amendments. Any amendments will be applied and interpreted at the sole discretion of Softball Australia. • If the competition is not capable of running as planned to include by reason of technical failure, fraud or any cause beyond Softball Australia control, Softball Australia may cancel or suspend the competition or invalidate any affected entries, to the extent permitted by law. • Softball Australia does not accept responsibility for any entries that are delayed, or which are not received for any reason during the Competition Period. • To the extent permitted by law, Softball Australia shall not be liable for any loss, damage or injury suffered in connection with the conduct of the competition or the redemption or use of the prize (including but not limited to direct loss) including: • technical or telecommunications problems (such as security breaches, technical website malfunctions or glitches); or • acts or omissions (including negligent acts of omissions) of Softball Australia servants or agents involved in the conduct of this competition who are acting outside their authority as agent of Softball Australia. • Please read Softball Australia privacy policy available on the Softball Australia website at https://www.softball.org.au/wp-content/uploads/2019/11/Privacy-Policy-FINAL-1.pdf which tells you how we use any personal information we may collect about you by entering a competition. • Softball Australia collects personal information in order to conduct the competition and may, for this purpose, disclose such information to subsidiary and related companies, third parties, including but not limited to agents, contractors, service providers, and any company with whom we are running the competition. • By participating in this competition, entrants release and hold harmless Facebook and Instagram from any and all liability associated with this competition, to the extent permitted by law (in which case that liability is limited to the maximum extent permitted by law). • Softball Australia and entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. • Entrants acknowledge that they are providing information to Softball Australia and not to Facebook or Instagram. • Softball Australia is not liable for any tax implications arising from prize winnings, including fringe benefits tax.
