1. STANDARD TERMS 1.1 Information on how to enter forms part of the terms of entry. 2. WHO CAN ENTER? 2.1 Subject to clause 2.2, entry is open to all residents of Australia aged 18 and over, where the Channel Seven (and affiliates) signal is received. 2.2 Employees and their immediate friends and families of the Seven Network (Operations) Limited (“The Promoter”), Ansible Pty Ltd, Mars Wrigley Australia (“The Sponsor”), Fetch TV Management Pty Ltd (“The Sponsor”) and their associated agencies and companies are not eligible to enter. 3. HOW TO ENTER 3.1 The Competition commences Saturday 26th December 2020 and concludes on Tuesday 26th January 2021 (“the Competition Period”). 3.3 COMPETITION ENTRY: In order to enter the Competition, viewers must take a photo or video of their best backyard or mini golf course trick shot and then: a) Head to, complete all required entry details which may include (but not limited to) full name, e-mail address, phone number and full address, and upload their photo or video. 3.4 Entries that meet the requirements of clauses 3.3 and adhere to these Terms and Conditions will be deemed a valid entry (“valid entry”). 3.5 Entry is limited to one (1) valid entry per person. If a person makes more than one (1) entry that meets the requirements of a valid entry listed in clause 3.3, the first valid entry made chronologically will be taken as the one (1) valid entry for this person. 4. PRIZES 4.1 There will be four (4) winners, judged from all entries received (online) selected on the judging date stipulated in clause 5.1 who will each receive the prize detailed in clause 4.2 . 4.2 Prize Number Full Details Prize Value Four (4) x Prizes Each winner will receive the following prize: ? The opportunity to have their winning feature in Channel Seven’s national broadcast of Holey Moley (“the Program”) in February 2021. This will involve Channel Seven creating edited video packages featuring vision provided by the prize winners. ? Program episode dates and times are subject to change at the Promoter’s discretion. Holey Moley Competition 2 / 4 4.4 In accepting the prize, the winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner grants the Promoter and Sponsors a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use. 4.5 The winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 4.6 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize, the Promoter’s and the Sponsors’ requirements. 4.7 The Promoter and Sponsors are entitled to use any of the entries submitted in any manner and for any purpose at their absolute discretion, including promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter and Sponsor’s are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry. 4.8 In the event that an element of the prize outlined in the above is not available for any reason, the Promoter reserves the right to substitute with a similar product of equal or greater value, subject to state regulations. 4.9 The winner may be required to provide valid identification to the Promoter. 4.10 The Promoter may require prize winners to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion. 4.11 The promoter may vary these terms and conditions at its discretion, subject to state government legislation 4.12 The prizes cannot be redeemed for cash and are not transferable, assignable or exchangeable. 5. HOW TO WIN 5.1 There will be four (4) prize winners in total selected on or around Wednesday 27th January 2021 who will win the prize package detailed in clause 4.2. 5.2 This is a game of skill; chance plays no part in determining the Winners. Each entry will be individually judged to determine the most creative, difficult and impressive trick shot as determined by the judges. The judges’ decision in relation to any aspect of the competition will be final. No correspondence will be entered into. 5.3 Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period (“Qualifying Entrant”) will be entered into the prize judging. Entries that do not comply with any of the terms and conditions, may be deemed invalid and a re-judging will be conducted in its place. The prize judging will take place at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills, NSW 2010 on the judging date stipulated in clause 5.1. 5.4 The winner will be notified by email from the Promoter on the day of the prize judging from 16:00 AEDT. All winners will be featured on national broadcast television during the Program from Monday 1 February 2021 (episode dates subject to change at the Promoter’s discretion). Winning entries and each entrants name will also be published on 5.5 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result. 5.6 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional prize judging will be conducted. 5.7 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 6. NO LIABILITY 6.1 Entrants warrant to the Promoter and Sponsor that the entry submitted is an original work of the entrant that does not infringe the rights of any third parties. Entrants warrant that any people featured in the images have consented to their image being used as part of the entry. Entrants posting images of people under 18 years of age acknowledge they have acquired parental or guardian consent and take full responsibility for all content uploaded as a part of their competition entry. 6.2 Entries must not include any third-party intellectual property (such as a logo). If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants they have obtained the relevant copyright permission to submit the entry for the purposes of Holey Moley Competition 3 / 4 this promotion. The entrant agrees to indemnify the Promoter and the Sponsor against all claims and costs by third parties arising from a breach of the warranty set out in this condition. 6.3 Entrants must not submit an entry that could be considered offensive, insensitive, defamatory or racist. Entries must not include inappropriate behaviour, MA or R rated images. Any entry which the judges, at their discretion, deem inappropriate, incomprehensible and incomplete will be invalid. The entrant agrees to indemnify the Promoter and the Sponsor. 6.4 Entrants must not submit an entry that involves harmful use of Mars Wrigley Australia products including (but not limited to) choking hazards, eating while playing and excessive consumption. Any entry which the judges, at their discretion, deem harmful will be invalid. The entrant agrees to indemnify the Promoter and the Sponsor. 6.5 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, pandemic, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation. 6.6 Seven Network (Operations) Limited and its associated agencies and companies assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation. 6.7 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation. 6.8 Seven Network (Operations) Limited and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) in the acceptance, participation or use of any element(s) of the prize; c) as a consequence of late, lost or misdirected mail; d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; or e) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion. 7.
