Any cost associated with accessing the promotional website is the Eligible Business’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Business to automatically enter repeatedly is prohibited and will render all entries submitted on behalf of that Eligible Business invalid. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion. As a condition of accepting the prize, the prize taker must sign any legal documentation as and in the form required by the Promoter and/or the Prize Supplier in their absolute discretion, including but not limited to a legal release and indemnity form. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act (Cth) 1988. To request access to, or to update or correct, personal information the Promoter holds about them, authorised representatives of Eligible Businesses can contact the office of the Promoter at the address set out in clause 2 or view the Privacy Policy for instructions. The Privacy Policy also contains information about how authorised representatives can complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize Supplier and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may also, if the opt-in box is ticked at the time of Registration, for an indefinite period, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia. With an Eligible Business’ express consent to do so, the Prize Supplier will handle entrant’s Personal Information (as defined in the Privacy Act 1988 (Cth)) (e.g. first name, last name, address, suburb, state, postcode, phone number, email address, gender, date of birth) in accordance with their Privacy Policy which can be accessed at https://www.jayco.com.au/promo/privacy-policy. Jayco Caravans’ Privacy Policy may be updated from time to time and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. An Eligible Business may at any time, opt out of receiving contact from the Prize Supplier by submitting an enquiry on the Contact Us page of the website jayco.com.au.
