Terms and Conditions
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition (including by accepting a prize) is deemed acceptance of these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.
2. The promoter is Dynamix Pty Ltd of 23-27 Shepherd Street Marrickville NSW, ABN 15 090 434 718 (“Promoter”).
3. Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) and contractors of the Promoter and its related bodies corporate or eBay Inc. and its related bodies corporate (“eBay”) and any agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The competition commences at 06.00 (AEDT) on 4 November 2016 and ends at 23.59 (AEDT) on 11 November 2016 (“Competition Period”).
5. No responsibility is accepted for any entries that are late, lost, incomplete, misdirected or not received by the Promoter by 23.59pm (AEST) on 11 November 2016. Incomplete, indecipherable or illegible entries will be deemed invalid.
6. In order to enter the competition and be in with the chance to win one of the available prizes, entrants must click on the corresponding eBay competition post relating to that prize on Facebook and fully complete and submit the entry form by providing their first and last name and a valid email address. Only one entry per person is permitted.
7. Entrants who click on an eBay competition post on Facebook post relating to one of the prizes and complete an entry form will be eligible to win the corresponding prize mentioned in the Facebook post.
8. By entering the competition, entrants agree to join eBay’s mailing list and consent to receiving marketing communications from eBay.
9. There will be 4 winners as selected by the Promoter in accordance with these Terms and Conditions. One winner will be selected in respect of each prize.
10. The prizes on offer as part of this competition are:
• 1 x Fitbit Charge 2 Fitness Wristband in Plum valued at $249
• 1 x Milan Direct Easy Lounge Chair valued at $329
• 1 x GHD Azores in Atlantic Jade valued at $270
• 1 x A Luxe Blush Pack that includes a personalised leather women’s clutch in taupe colour valued at $59 from Olive & Co + Oak & Jackal rose gold and peach colour watch valued at $119 + Women’s Quay Rose Vivienne sunglasses valued at $60 (three items value total $238).
11. The total prize pool is valued at AUD $1086 as at the time of publishing.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
14. The Promoter and eBay accept no responsibility for any variation in the value of any prize. If any prize element is out of stock at the time of redemption, the Promoter may substitute the prize with another of equal or greater value, subject to any written directions from a regulatory authority.1
15. Any operating, repair or ancillary costs associated with redeeming a prize is the sole responsibility of the winner.
16. One draw will be conduct for each prize. Only those who have completed the entry form for the respective prize, will be entered into the draw for that prize. The draws will take place at Plexus, Level 2, 35 Little Bourke Street, Melbourne VIC 3000 at 11am AEDT on 16 November 2016. The first valid entry drawn from each of the four (4) draws will win the relevant prize for that draw (i.e. one (1) of the four (4) prizes listed in clause 10 above). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
17. The Promoter and eBay’s decision regarding prize winners is final, and no correspondence will be entered into regarding the outcome.
18. Prize winners will be notified by email within two (2) business days of the draw. Winners will be published at www.dynamix.com.au/ebayfound on 2 December 2016.
19. If a prize winner selected is ineligible to receive a prize, forfeits the prize, does not provide their mailing address on request, the Promoter or eBay may select a new winner in their discretion, subject to any written directions issued by any regulatory authority.
20. eBay and the Promoter reserve the right, at any time, to verify the validity of entries, entrants and winners (including an entrant’s or winner’s identity, age and place of residence) and reserve the right, in their sole discretion, to disqualify any individual who they have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by eBay or the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. eBay and the Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
21. eBay and the Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this competition, except for any liability which cannot be excluded by law.
22. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
23. Draws for any unclaimed prizes may take place on 16 February 2017 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winner/s will be notified by email within two (2) business days of the draw and their names will be published at www.dynamix.com.au/ebayfound on 24 February 2017.
24. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25. To the maximum extent permitted by law, entrants release eBay and the Promoter from all or any claims that may arise in connection with this competition.
26. eBay and the Promoter assume no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the eBay website, Facebook and/or participation in the competition. If for any reason the competition is not capable of being run as planned, due to causes beyond the reasonable control of eBay and/ or the Promoter, the Promoter may modify, suspend, terminate or recommence the competition, subject to the approval of any regulatory authority.
27. At the request of eBay or the Promoter, entrants agree (without charge) to participate in any promotional activities planned and consent to their name being used in eBay or the Promoter’s marketing materials. By participating in this competition, entrants consent to the use of their personal information as set out in these Terms and Conditions. eBay or the Promoter may collect and use personal information submitted with each entry for the purpose of running the competition, contacting winners, and sending prizes. Personal information may be provided to third party organisations that assist in maintaining the eBay.com.au Website and/or running the competition. If entrants do not provide the required personal information they will not be eligible to participate in the competition.
28. These Terms and Conditions are governed by the laws of New South Wales and entrants submit to the exclusive jurisdiction of the New South Wales courts in relation to any disputes arising under these Terms and Conditions or in relation to the competition.
29. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
30. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
31. The Promoter, eBay and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or willful misconduct) in connection with this competition or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
32. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
33. As a condition of entering this competition, each entrant consents to the Promoter sharing the entrants’ personal details with eBay for the purposes of administering the competition. eBay may also use the entrants’ information collected on an aggregated basis for analysis. The Promoter and eBay collect personal information ("PI") in order to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter and eBay will also use and handle PI as set out in their respective Privacy Policies, which can be viewed at www.dynamix.com.au/privacy (for the Promoter) and http://pages.ebay.com.au/help/policies/privacy-policy.html (for eBay). The Privacy Policies also contain information about how entrants may opt out, access, update or correct their PI held by each respective entity, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter and eBay. Personal information collected from entrants may be disclosed to entities outside of Australia.
34. Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
