Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Administrator and Promoter, participating retailers, companies and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The promotion will be conducted in BP Service Stations nationally that display material advertising this promotion (“Participating Stores”). Entries into the promotion open at 9:00AM AEDST on 25/10/18 and close at 11:59PM AEDST on 21/11/18 (“Promotional Period”).
To be eligible to enter, eligible individuals must purchase any Voss Water product from a Participating Store (“Qualifying Transaction”) during the Promotional Period. Upon making their Qualifying Transaction, individuals will be handed a promotional card by a member of staff that contains a unique code (“Unique Code”), while stocks last. In the event a Unique Code is not automatically handed to them, it is the individuals responsibility to request one. For the sake of clarity, one (1) Unique Code will be provided for every Voss Water product purchased in a Qualifying Transaction.
To enter, individuals must then during the Promotion Period visit winwithvoss.com.au and follow the prompts to the promotion entry page, input the requested details (including their full name, residential address, email, mobile number and date of birth) and the Unique Code and submit the fully completed online entry form.
Each entrant will be notified immediately online whether or not they are an instant winner. There are two hundred (200) instant prizes to be won, each a Voss Turkish Towel valued at AUD$40 (inc GST). All valid entries received from winners and non-winners of an instant prize will be automatically placed in the major prize draw (“Major Prize Draw”).
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; b) each entry must be submitted separately and in accordance with entry requirements; (c) only one unique code per entry is permitted; (d) the same unique code cannot be used more than once and (e) unrecognised codes will be deemed invalid.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Administrator or the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
The Administrator and Promoter reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who fails to provide identifying documents within the timeframe requested, or who the Administrator or Promoter have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Administrator or Promoter's discretion. Failure by the Administrator or Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. The Administrator or Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Administrator or Promoter reserve the right, in their sole discretion, to determine the identity of the entrant.
All entries received during the Promotional Period will be entered into the Major Prize Draw. The Major Prize Draw will take place at Tactics Marketing Support, 6/106 Old Pittwater Road, Brookvale, NSW, 2100 on 28/11/18 at 12 noon AEDST. The Administrator may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winner of the Major Prize (defined below) will be notified in writing within two (2) business days of the draw and all winners will have their names published online at winwithvoss.com.au from 12/12/18.
The Administrator or Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn in the Major Prize Draw will win a trip for two (2) adults to Byron Bay NSW, valued at up to $5,733 (inc GST) depending on date and point of departure (“Major Prize”). Major Prize includes:
Two (2) x return economy airfares from winner's nearest Australian capital city to the Gold Coast and destination airport to accommodation transfers. If the winner resides within a 300km radius of Byron Bay then the prize does not include airfares and transfers and the airfare/transfer component of the prize is not redeemable for cash;
Three (3) nights twin share accommodation in a Deluxe Spa Suite at The Byron at Byron, including full buffet breakfast at The Restaurant and complimentary yoga, daily;
One (1) bottle of Bollinger NV Champagne, a cheese platter and chocolates in suite on arrival;
One (1) gourmet dining voucher to the value of $130 to use at The Restaurant;
One (1) 60 minute relaxation massage for the winner and their companion in The Spa; and
Two (2) Byron at Byron Spa vouchers to the value of $150 to use during the stay.
The following conditions apply to the Major Prize: Spending money, meals, insurance, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by November 2021 (no extension will be permitted) and is subject to booking and flight availability. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Any alterations to confirmed Major Prize details will be at the expense of the winner and will only be permitted with the Promoter's prior consent. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. Travel Insurance is not included, however it is strongly recommended that the winner and participant acquire adequate travel insurance.
As a condition of accepting the Major Prize, the winner agrees to provide the Promoter with two (2) images whilst participating in the Major Prize at Byron Bay, that the Promoter may use at their discretion for promotional purposes, including but not limited to posting on social media.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize (or an element of a prize) at/by the time stipulated by the Adminitrator or the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $13,733 (inc GST).
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. If the Administrator or the Promoter have reason to believe that the winner has transferred a prize or any element of a prize to another person (other than as allowed by these Terms and Conditions of entry) without the permission of the Promoter, the winner’s entry will be deemed invalid and the prize will be forfeited by both the winner and transferee.
A draw for any unclaimed prizes may take place on 01/03/19 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published online at winwithvoss.com.au from 14/03/19.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Administrator or Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Administrator or Promoter reserve the right, in their discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Administrator and Promoter (including their respective officers, employees and agents) and the companies and agencies associated with this Promotion, exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Administrator and Promoter (including their respective officers, employees and agents) and the companies and agencies associated with this Promotion are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the control of the Administrator or Promoter, or the companies and agencies associated with the Promotion); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Administrator or Promoter) due to any reason beyond the reasonable control of the Administrator or Promoter or the companies and agencies associated with the Promotion; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
As a condition of accepting the Major Prize, the Major Prize winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://vosswater.com/voss-water-privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
