The Promotion commences at 11.00am AEST on 15 September 2016 and closes at 17.00pm AEDT on 24 October (Promotion Period).
Entry is open to any Australian resident aged 18 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
To enter the Promotion, Entrants must visit the Nad’s Facebook page at https://www.facebook.com/nads then accurately complete an online entry form on the Nad’s Facebook page, and submit it so that it is received during the Promotion Period (Entry).
Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
On the Thank You Page of the entry form Entrants have the option to refer a friend to obtain an extra entry into the draw. Entrants can receive up to a maximum of 6 entries – one for sharing the competition on Facebook and up to five by referring five friends via email. Entrants will need to enter the names and email addresses of up to 5 friends via email to obtain the additional entries. Before referring friends, the entrant must first ensure they have the consent of the friend/s prior to nominating them to receive the details of the promotion. Extra entries will only be valid for referrals made via the entry form. Liking the Nad’s Facebook page and / or follow the Nad’s Instagram account will be part of the competition steps, however not mandatory for the entrants. The Promoters will not use the information received in the record of referral for any ongoing marketing communications. The Promoters will only use this information the one time in conjunction with the contest. Referred records will not be entered into the Promoter’s database.
By accepting the terms and conditions upon entering the promotion you are automatically entered into the Promoter’s email database.
No purchase is necessary to enter. Purchasing products will not help your chances of winning.
The total Prize Pool is valued at up to $4919.78. There is one (1) Major Prize valued at up to $4719.98 and twenty (20) Runners’ Up Prizes valued at $9.99 each. The Major Prize includes a five (5) night stay at Elements of Byron, daily yoga, daily breakfast, and 2 x spa treatments (RRP $2500), return economy flights to Ballina Airport from any capital city in Australia (valued up to $1200), $1000 spending money, 2 x Nad’s Sensitive Hair Removal Cream (RRP $9.99 each). Each Runners’ Up Prize includes 1 x Nad’s Sensitive Hair Removal Cream (RRP $9.99 each). Prizes are not exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes. Please allow up to 30 days for delivery of prizes from being notified as a winner.
Major Prize Conditions:
i. The prize must be taken prior to 1 October 2017.
ii. Prize includes return economy flights for 2 persons from any capital city Australia.
iii. Travel by both parties must be undertaken on the same flights and dates.
iv. Prize is for two people for five nights at Elements of Byron.
v. The prize may not be taken between 24 and 31 December 2016 or 14 and 18 April 2017.
vi. Travel dates are based on availability on the day of booking.
vii. Additional expenses are at prize winners’ expense.
viii. Travel Insurance: It is strongly recommended that travellers hold current and valid travel insurance.
ix. The prize is non‐transferable and cannot be used in conjunction with any other special offer.
x. An unused prize cannot be assigned to another party, refunded, exchanged or redeemed for cash.
xi. All bookings are subject to the terms and conditions of the operators.
xii. Entry is to be completed in accordance with the terms and conditions of the competition and these terms and conditions to be eligible.
xiii. The promoter’s decision on entries and winners is final and no correspondence will be entered into.
xiv. By accepting a prize, winners consent to the promoters using his/her details and photographs for promotional and media publicity purposes.
xv. The prize is as stated in the promotion copy. Bookings are subject to availability.
xvi. In the event of the auction winner wanting a stay of greater value than specified above (for example, requesting an extended length of stay, the difference shall be met by the prize winner and no claims for excess shall be made to Elements of Byron or any of its affiliated or associated agencies.
xvii. The winner takes the prize entirely at his/her own risk and indemnifies the promoter or any of its affiliated or associated agencies in respect of any claim for any accident injury, property damage or loss of life that may occur in connection with the prize.
The Prize Draw will be conducted at 17.00pm AEDT on 26 October 2016 at The Defectors 3/145 William Street, Darlinghurst, Sydney 2010. The Major Prize Winner will be the first valid Entry drawn. The Runner Up Prize Winners will be the subsequent 20 valid entries drawn. Prizes are not transferable or exchangeable, and cannot be taken as cash.
Each Winner will be notified by email within five (5) business days of the Prize Draw, and will receive written confirmation within twenty-one days and their name will be published on the Nad’s Facebook Page (https://www.facebook.com/nads) on 27 October 2016. In their written confirmation, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 31 January 2017 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Draw, receive written confirmation within twenty-one days and their names will be published on the Nad’s Facebook page at https://www.facebook.com/nads on 31 January 2017.
By submitting content you authorise that it is your own content and that you are permitted to distribute such content.

Supplying your valid contact details are part of the conditions of entry to this promotion. All contact details entered incorrectly shall be deemed invalid.
The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and/or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Promotion.
This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to Nad’s Pty Ltd and not to Facebook.
In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Nad’s Pty Ltd database. The Promoter and Nad’s Pty Ltd may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Nad’s Pty Ltd Privacy Policy. i. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
ii. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
