Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. This offer is not valid for any policies cancelled during the cooling off period.
The promoter is Allianz Australia Insurance Limited (ABN 15 000 122 850, AFS Licence No. 234708) of Level 12, 2 Market Street, Sydney, NSW, 2000 telephone number 132 664 (“Promoter”).
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 12:00am on 18 August 2019 and ends at 11:59pm on 28 September 2019 (“Promotional Period”). All references to times recorded throughout these Terms and Conditions are a reference to the local time AEST/AEDT (as applicable) in Sydney, New South Wales.
To receive an automatic entry into a draw, individuals must purchase an Allianz Comprehensive Car Insurance Policy during the Promotional Period directly via the Allianz Website or Allianz Direct Contact Centre, excluding policies purchased or held with any Allianz Partners or intermediaries (“Eligible Policy”). For each Eligible Policy purchased directly via the Allianz website or Allianz Direct Contact Centre during the Promotional Period, individuals will receive one (1) entry into the draw. The policy will be deemed purchased when the Promoter receives full payment of the annual policy premium or the first instalment of premium if paying by the month. Polices cancelled or not renewed after the Promotional Period starts will be excluded.
Individuals who already hold an existing Comprehensive Car Insurance Policy that was purchased directly via the Allianz website or Allianz Direct Contact Centre (excluding policies purchased or held with any Allianz Partners or intermediaries), prior to the Promotional Period will also receive one (1) automatic entry into the draw for each Eligible Policy they hold. Polices cancelled or not renewed after the Promotional Period starts will be excluded.
For the purposes of this Promotion, an Eligible Policy is as follows:
an Allianz Comprehensive Car Insurance policy.
In the case of a single Eligible Policy which is held by multiple persons, only one (1) named policy holder may enter the draw. Any entry or attempted entry which is not properly associated with an Eligible Policy in accordance with these Terms and Conditions will cause all entries by that entrant to be deemed invalid. The Promoter may deem any entry invalid if it determines at its sole discretion that entries are not made in accordance with these Terms and Conditions.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and policy) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 16 October 2019 at 10am. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified in writing or by telephone within two (2) business days of the draw. The major prize winner, and any minor prize winners from ACT, will have their names published online at https://www.allianz.com.au from 25 October 2019. In the event the major prize winner is from South Australia, their name will also be published in The Australian on 25 October 2019.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win the major prize prize, valued at up to $54,240.00 Major prize includes:
Mazda CX-5 H Akera 2.5 L Turbo petrol with automatic transmission. Total value of the vehicle is up to $52,740.00 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State).
Petrol, maintenance and servicing and all other ancillary costs are the responsibility of the winner. Delivery of prize will be determined by geographical location otherwise delivered to winner’s nearest authorised Mazda dealership.
The winner will also receive a twelve (12) month Allianz Comprehensive Car insurance policy for the above mentioned car up to the value of $1,500 (inclusive of all taxes and charges). Policy terms, conditions, limits, exclusion and underwriting criteria apply.
If the winner wants to add any extras to the current specs of the Mazda CX-5 , it will be at their own expense.
Colour of Mazda CX5 awarded is at the Promoter’s discretion and is subject to availability.
If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
The next one thousand and fourteen (1014) entries drawn will each win a minor prize of a $50 JB Hi Fi eGift Card:
Winners must ensure they have provided a valid email address. The JB Hi-Fi eGift Card will be sent directly by JB Hi-Fi to the email address provided when purchasing / or already purchased an Eligible Policy.
Any ancillary costs associated with redeeming the eGift Card are not included. Any unused balance of the eGift Card will not be awarded as cash. Redemption of the eGift Card is subject to any terms and conditions of the issuer including those specified above, on the eGift Card and at jbhifi.com.au/General/Help-Centre/Gift-Card-help/Gift-Card-Terms--Conditions/.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to the value of $104,940.00
Prizes, or any unused portion of a prize, are not transferable or exchangeable.
A draw for any unclaimed prizes may take place on 17 January 2020 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw. In the event the major prize is awarded, the winner’s name and any minor prize winners ‘ names from ACT will be published online at https://www.allianz.com.au/ from 24 January 2020. In the event the major prize winner is from South Australia, their name will also be published in The Australian on 24 January 2020.
Entrants consent to: (a) participate in reasonable promotional activities, including but not limited to interviews and photographic and recording sessions, in respect to their participation in the promotion (including any outcome); and (b) the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of / taking of a prize.
To the fullest extent permissible by law, each entrant in the promotion and the prize winners each releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by them in connection with the prize or their participation in the promotion. The Promoter, its related bodies corporate, officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential or economic loss) suffered or sustained by an entrant or the prize winner in connection with this promotion, the promotion of this promotion, or the use of or participation in any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in or down-loading any materials related to this promotion.
As a condition of accepting the major prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Privacy Notice: Entry is conditional on providing the requested personal information. By entering this Promotion, each entrant consents to the retention, use and disclosure of their personal information by the Promoter in the following ways:
for the purposes of conducting the Promotion and any matter connected to the Promotion;
if the entrant is the prize winner in this Promotion, for publicity purposes in any media for an unlimited period without remuneration, compensation or prior notice to the entrant;
in addition to any use that may be outlined above, sending the entrant publications and communications about events, promotions, products and services. This includes distributing marketing material for goods and services offered by the Promoter, its related bodies corporate and businesses which have arrangements with the Promoter or its related bodies corporate. Each entrant agrees that communications may be sent to them by post, email and SMS.
The Promoter may disclose personal information to third parties for the above purposes, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. For the purpose of conducting this Promotion and sending offers and information to each entrant, the Promoter will not disclose the entrant’s personal information to entities outside of Australia.
