8 You will receive one entry into the promotion by performing the activities listed in clause 7. You may not enter the promotion more than once. 9 All entries become the property of the Promoter. Judging 10 This promotion is a game of skill. Chance plays no part in determining the winners. 11 All valid entries will be judged individually on their merits. The entry that is judged as the most creative will be the winner. 12 Judging will take place at 10:00 AEST on 12 April 2021 at Queensland Museum, Corner Grey and Melbourne Streets, South Brisbane Qld 4101. Entries will be judged by a panel of judges from Queensland Museum. 13 The Promoter may decline to accept any entry which, in its reasonable opinion, does not comply with these Terms and Conditions. 50569467_4 2 14 The Promoter’s decision in relation to any aspect of the promotion is final and the Promoter will not enter into any correspondence regarding the result of the promotion. Prize 15 The winner will receive: (a) a travel voucher with an airline nominated by the Promotor for economy flights for four people from the Australian capital city nearest to the winner to Bundaberg, Queensland up to a maximum value of $4000; (b) an accommodation voucher for four people for two nights at a four-star hotel in Bundaberg, Queensland up to a maximum value of $1000; and (c) a voucher for entry for four people to the Mon Repos Turtle Encounter Tour at a value of $100. 16 The prize is valid for use between 1 November 2021 and 31 March 2022 (excluding 24 December 2021 to 1 January 2022). Travel is to be arranged by the winner contacting the service provider identified on the relevant voucher. 17 Any unused element of the prize remaining after 31 March 2022 will be forfeited. 18 Prizes are not transferable or refundable and cannot be taken as cash. 19 The Promoter will select the airline for the travel aspect of the prize at its sole discretion. Economy tickets cannot be upgraded. The winner and their travel companions must travel on the same flights. Changes cannot be made to travel arrangements after the time of booking. Any changes to travel arrangements after the time of booking will be at the sole cost of the winner. Flights are not eligible for any frequent flier program benefits. 20 Travel is subject to availability at the time of booking. Queensland Museum is not liable for any loss, delay or other impact on travel caused by COVID-19 travel restrictions. 21 No compensation will be payable if the winner, or any of the winner’s travel companions, are unable to use any element of the prize for any reason. 22 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter will use reasonable endeavours to provide a comparable substitute prize of equal or greater value. However, once travel vouchers have been redeemed by the winner with the relevant service provider, the prize is subject to that relevant service provider’s standard terms and conditions and the Promoter is not required to provide substitute prizes. 23 The prize does not include any of the following: travel insurance, meals, personal spending money, applicable government taxes, levies, airport charges, freight costs, excess baggage, travel costs to and from the point of departure, compliance with any health or other government requirements, and any other items not explicitly mentioned in the prize description. Notification of winner 24 The winner will be contacted by phone or email using the phone number or email address provided on their entry form on or by 16 April 2021. The winner’s name, suburb and response will be published on the World Science Festival Brisbane website at www.worldsciencefestival.com.au. 25 To claim the prize, the winner must have made contact with the Promoter (either by phone or by responding to the Promoter’s email by 30 April 2021. 50569467_4 3 26 If the Promoter is unable to contact the winner by 30 April 2021, that winner will forfeit the prize and the prize may be awarded to the next best entry (as determined by the judges). The new winner will be contacted by phone or email using the phone number or email address provided on their entry form on or by 3 May 2021. 27 The prize will be delivered to the winner by via email or postage within 14 days after the prize being claimed. 28 If any prize becomes unavailable for any reason, the Promoter may substitute a prize of equal or greater value. 29 The Promoter accepts no responsibility for any tax implications that may arise for any prize. Intellectual property 30 You confirm and promise that your entry is original and does not infringe the intellectual property rights of any third party. You grant the Promoter an unrestricted, irrevocable, transferable right and licence to use and modify your entry including for promotional purposes without the payment of any further fee or compensation or further reference to you, and you agree that the Promoter can authorise other people to do any of these things. If requested by the Promoter, you agree to sign any further documentation required by the Promoter to give effect to this arrangement. 31 To the extent permitted by law, you unconditionally and irrevocably consent to the Promoter modifying your entry as described in this clause, agree that the Promoter is not required to attribute you as author of the entry, and consent to any other act or omission that would otherwise infringe any moral rights in your entry. Withdrawal from promotion 32 You may withdraw from the promotion at any time before notification of the winners by notifying the Promoter on 07 3153 7816. If you withdraw from the promotion, the Promoter will remove your entry and will not use your details or entry for media or promotional purposes. If you withdraw from the promotion, you will no longer be eligible to win a prize. Miscellaneous 33 Entries which, in the opinion of the Promoter, are incomplete, incorrect or incomprehensible, contain defamatory or offensive content or infringe intellectual property rights are not eligible to win and may be removed from the promotion and the relevant entrant will be disqualified. 34 The Promoter may, in its absolute discretion, disqualify you if, in the opinion of the Promoter, you breach these Terms and Conditions, engage in dishonest or unethical conduct in relation to the promotion, manipulate, tamper or interfere with the conduct of the promotion, do not comply with the entry process, or conspire with others to gain an unfair advantage. The Promoter may audit you if it suspects you of having engaged in such breach or conduct. 35 The Promoter may request information from you relevant to entry or participation in the promotion, such as proof of residency. The Promoter may, in its absolute discretion, disqualify you if you provide insufficient information, false information or fail to provide information. 36 The Promoter is not responsible for any late, lost or misdirected entries. 37 The Promoter is not responsible for any delays, problems or technical malfunction of any, computer systems, computer equipment or software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from entering this promotion. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the promotion. 50569467_4 4 38 To the extent permitted by law, the Promoter is not be liable for any loss, damage or injury whatsoever (including, but not limited to, indirect or consequential loss) resulting from this promotion, including the taking of prizes. 39 If, for any reason, this promotion is not capable of running as planned, including pandemic, war, terrorism, state of emergency or disaster, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter which corrupt of affect the administration, security, fairness, integrity, or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion. 40 All costs associated with entering to the promotion are your responsibility. 41 The law in force in Queensland governs these terms and conditions and, to the extent the law permits, all matters in connection with these terms and conditions including any noncontractual matters. Each party submits to the non-exclusive jurisdiction of the State courts in Queensland and the Federal Court of Australia.
