RE:WARD AUTUMN COMPETITION
1. Information on how to enter and the prize(s) form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms and
Conditions.
2. Entry is only open to Australian residents.
3. Entrants under 18 years old must have parental/guardian approval to enter.
4. Employees (and their immediate families) of the Promoter, Foodco Group Pty Ltd
and other agencies associated with this promotion are ineligible to enter.
5. Promotional periods as below:
Entries open 6:00am (AEST), Thursday the 1
st June, 2017 and entries close 11.59pm
(AEST) Thursday 31st August, 2017.
6. To be eligible to enter, individuals must during the Promotion Period enter the
following way;
a) Fill out the entry form on the website www.muffinbreak.com.au/news/refresh/.
b) Entry must be typed within 25 words or less and answer why they want to win
their nominated prize. Full name, e-mail address and delivery address must
be provided to be a valid entry.
c) The code word from the Refresh magazine must be selected in the drop down
list to show which prize is being entered into to win.
d) Entrants can enter only once through the competition entry form.
e) Code words for respective prizes are advertised as the list noted below:
a. Muffin Break = a six pack of muffins and coffee
b. Tea Set = Tea for One tea set from Royal Albert
c. Massage = A gift voucher to Endota Spa
f) The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant's identity, age and place of residence) and
to disqualify any entrant whose entry is not in accordance with these Terms
and Conditions, or who tampers with the entry process. The judges reserve
the right to remove entries that are deemed to be offensive, inappropriate,
discriminatory or defamatory, or in poor taste. These entries will not be
eligible for the Prizes.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right,
in its sole discretion, to determine the identity of the entrant.
9. This is a game of skill and judged on 50% creativity and 50% written expression.
10. The prize pool has a total value of $964.00 AUD (RRP) inclusive of GST.
12. There will be a total prize pool of nine (9) prizes. Prizes include:
 1 of 4 Muffin Break vouchers – muffin six-pack and a free coffee
 1 of 3 Royal Albert tea sets
 1 of 2 Endota Spa vouchers
Winners chosen can only win one prize each.
14. The winners will be selected from the valid entries starting from 9am, Tuesday
5th August 2017 (AEST).
15. Winners will be notified via phone and/or email within twenty four (24) hours of
prizes being drawn.
16. If any prize is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize with a prize to the equal value and/or specification, subject to any
written directions from a regulatory authority.
17. Prizes are not transferable or exchangeable and cannot be taken as cash.
18. Entrants consent to the Promoter using their name, likeness, image, submitted
entry and/or voice in the event they are a winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without remuneration
for the purpose of promoting this promotion (including any outcome), and
promoting any products manufactured, distributed and/or supplied by the Promoter.
19. If this promotion is interfered with in anyway or is not capable of being conducted
as reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised
intervention or fraud, the Promoter reserves the right, in its sole discretion, to the
fullest extent permitted by law:
(a) to disqualify any entrant;
or (b) subject to any written directions from a regulatory authority, to modify,
suspend, terminate or cancel the promotion, as appropriate.
20. Any cost associated with accessing the promotional website is the entrant's
responsibility and is dependent on the internet service provider used.
21. Nothing in these Terms and Conditions limits, excludes or modifies or purports to
limit, exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act, as well as any other implied warranties under the
ASIC Act or similar consumer protection laws in the State and Territories of Australia
(“Non-Excludable Guarantees”). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way
out of the promotion.
22. Except for any liability that cannot by law be excluded, including the NonExcludable
Guarantees, the Promoter (including its respective officers, employees
and agents) is not responsible for and excludes all liability (including negligence), for
any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not
under the Promoter's control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and
Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) use of a prize.
23. The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including but
not limited to agents, contractors, service providers, prize suppliers and, as required,
to authorities. Entry is conditional on providing this information. The Promoter may,
for an indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the entrant. Entrants should direct any
request to opt out, access, update or correct information to the Promoter.
24. All entries become the property of the Promoter who may wish to use photos,
images and written words in marketing communications.
