5.    Delivery of goods is available for items redeemed via this promotion ;
6.    The Promoter reserves the right, at any time, todisqualify any orders that are not in accordance with these Terms and Conditions.Failure by the Promoter to enforce any of its rights at any stage does notconstitute a waiver of those rights.
7.    The Promoter’s decision is final and nocorrespondence will be entered into.
8.    The package is not transferable or exchangeable andcannot be taken as cash, unless otherwise specified.
9.    If the Promotions are interfered with in any way oris not capable of being conducted as reasonably anticipated due to any reasonbeyond the reasonable control of the Promoter, including but not limited totechnical difficulties, unauthorised intervention or fraud, the Promoterreserves the right, in its sole discretion, to the fullest extent permitted bylaw to modify, suspend, terminate or cancel any part of the Promotion, asappropriate.
10.  Nothing in these Terms and Conditions limit,exclude or modify or purports to limit, exclude or modify the statutoryconsumer guarantees as provided under the Competition and Consumer Act, as wellas any other implied warranties under the ASIC Act or similar consumerprotection laws in the States and Territories of Australia (“Non-ExcludableGuarantees”). Except for any liability that cannot by law be excluded,including the Non-Excludable Guarantees, the Promoter (including its respectiveofficers, employees and agents) excludes all liability (including negligence),for any personal injury; or any loss or damage (including loss of opportunity);whether direct, indirect, special or consequential, arising in any way out ofthe Promotion.
11.  Except for any liability that cannot by law beexcluded, including the Non-Excludable Guarantees,  the Promoter(including its respective officers, employees and agents) is not responsiblefor and excludes all liability (including negligence), for any personal injury;or any loss or damage (including loss of opportunity); whether direct,indirect, special or consequential, arising in any way out of: (a) anytechnical difficulties or equipment malfunction (whether or not under thePromoter’s control); (b) any theft, unauthorised access or third partyinterference; (c) any entry that is late, lost, altered, damaged or misdirected(whether or not after their receipt by the Promoter) due to any reason beyondthe reasonable control of the Promoter;
12.  The Promoter collects personal information in orderto conduct the Promotions and may, for this purpose, disclose such informationto third parties, including but not limited to agents, contractors, serviceproviders, and prize suppliers. Entry is conditional on providing thisinformation. The Promoter may, for an indefinite period, unless otherwiseadvised, use the information for promotional, marketing, publicity, researchand profiling purposes, including sending electronic messages or telephoningthe entrant. Entrants should direct any request to access, update or correct informationto the Promoter.
13.  The laws of Australia apply to these Promotions tothe exclusion of any other law.  Entrants submit to the exclusivejurisdiction of the courts of Australia.
