Introduction
Information on how to enter and prizes available form part of these Terms and Conditions.
Entry into this Competition deems acceptance of these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

Who can enter
Entry is open to all Australian residents aged 18 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
How to enter
The Competition commences at 9am (AEDT) on Wednesday 21st December, 2016 and closes at 2pm (AEDT) Tuesday 10th January, 2017 (‘Promotion Period’).
To enter the Promotion, Entrants must enter into the draw competition, by providing the following details;

Entrants may enter the Competition as many times as they like during the Promotion Period, as long as each Entry is unique. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
No purchase is necessary to enter. Purchasing products will not help your chances of winning.
Prizes
There will be one (1) Prize in total to win.
The total Prize Pool is valued at $2,955. There is one (1) Prize in total which includes: Polk SB1+ Soundbar, 2 x Polk Omni S6 Wireless Speakers, 2 x Polk Omni S2 Wireless Speaker. Prizes are not exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes.
Prize notification, draw and delivery
The Promoter will make all reasonable attempts to identify and contact the winner.
The winner will be randomly drawn at 10am (AEDT) on 13th January at 72 Campbell St, Surry Hills 2010, by a representative of the Promoter. The winner will be announced by the 27th January 2017.
The draw will be witnessed by a member of the public.
The promoter will ensure that all entries have an equal chance of winning.
In the event that the winner cannot be identified or contacted by 13th April, 2017 despite all reasonable attempts to do so, or a winner does not accept the First Round Prize in accordance with the Promoter's instructions, or the First Round Prize is otherwise unclaimed by that time for any other reason whatsoever (whether because the winner is successfully identified and contacted but forfeits his or her right to the First Round Prize, it is discovered that the winner was not eligible to enter this Competition, the winner breaches these Terms and Conditions in a way that would render him or her ineligible to claim or avail of the First Round Prize, the winning entry does not comply with these Terms and Conditions or otherwise), then the Promoter will award the First Round Prize to the next drawn eligible winner.
The Second Round Prize draw will take place on 30th April 2017 at 11:00am (AEDT) at 72 Campbell Street, Surry Hills, 2010, Australia.
The winner of the Second Round Prize will be determined at random by a representative of the Promoter. An independent scrutineer will attend the Second Round Prize draw.
The Promoter will ensure that each entry to the Second Round Prize draw has an equal chance of winning.
The Promoter will make all reasonable attempts to identify and contact the winner of a Second Round Prize.
The Winner will be announced on the Polk Australia & New Zealand Facebook page at (https:// facebook.com/PolkAUNZ) by 10th April, 2017 and/or The Australian by 10th April 2017.
The Promoter will send confirmation of the Prize, including instructions on delivery of the Prize, to the winner by email by [27th January 2017] (or in the case of second chance winners, by {6th May 2017]). The winner of a Prize must accept the Prize in accordance with the Promoter's instructions by [27th January 2017] (or in the case of second chance winners, by [6th May 2017]), or the winner will be deemed to have forfeited his or her right to the Prize.

Supplying your valid contact details are part of the conditions of entry to this promotion. All contact details entered incorrectly shall be deemed invalid.
The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and/or New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c)any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.
If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Promotion.
This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to Sound United and not to Facebook.
In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Sound United database. The Promoter and Magnum and Co may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes asset out in the Sound United Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of Sound United. Upon the entrant’s request, all information provided will be removed from our active database. The collection, use and disclosure of personal information in connection with the Promotion is governed by the Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoter: using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion; using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including mail and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
