The promoter is Reader's Digest (Australia) Pty Ltd, (ABN 81000565471), 80 Bay Street, Ultimo, NSW Australia, (www.readersdigest.com.au) (www.readersdigest.co.nz), ph: Aust 1300300162, NZ 0800540048 (“Promoter”).
Entry is only open to Australian and New Zealand residents aged 19 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 19/04/2016 and ends at 11:59pm AEST on 30/06/2016 (“Promotional Period”).
To be eligible to enter, individuals must receive or access marketing communications from/by the Promoter advertising this promotion, via email, mail, telephone, online or any other method during the Promotional Period.
To enter, eligible individuals must order or renew/extend a paid twelve (12) issue subscription to the Reader’s Digest magazine during the Promotional Period via one (1) of the following methods:
ONLINE – by visiting readersdigest.com.au/cruise and following the prompts on screen to provide all of the requested details, including delivery and payment details; or
PHONE – by calling 1300 300 030 (Mon - Fri, 8.30am - 5.30pm AEST. Local call cost applies from landline. Higher cost applies from mobiles), and following the prompts of the operator to provide all of the requested details, including delivery and payment details, and quoting the code word “CRUISE”.
Incomplete or indecipherable entries will be deemed invalid.
Only one (1) entry is permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Reader’s Digest, 80 Bay Street, Ultimo, NSW 2007 at 10.30am AEST on 12/07/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winner will be notified in writing within two (2) business days of the draw, and their name will be published in The Australian on 19/07/2016.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win a 13-night New Zealand Cruise for two (2) people, on board Princess Cruises’ Emerald Princess, valued at AU$5,918. The cruise departs from Sydney, NSW, on 15/11/2016 and includes the following components:
thirteen (13) nights accommodation in an obstructed Oceanview stateroom for two (2) people;
all on-board main meals for two (2) people (with the exception of those restaurants which have an additional cover charge); and
selected on-board daily activities and entertainment (with the exception of those activities and entertainment which have an additional cover charge).
Prize must be taken from 15/11/2016 to 28/11/2016. If the winner’s companion is under the age of 18 years, he/she must be accompanied by the winner at all times during the cruise, and the winner must be the legal guardian (or provide written permission to the Promoter from the minor’s legal guardian) to take a minor on the cruise. The prize does not include flights and/or transfers to/from the winner’s home to the departure port of Sydney, NSW. Any costs associated with transport to/from the departure port will be the responsibility of the winner and will not be borne by the Promoter. Shore excursions, cruise upgrades, spending money, additional meals, taxes, travel insurance, passports, visas, vaccinations, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in the prize. Itinerary to be determined by the Promoter in its absolute discretion. A credit card imprint or cash deposit may be required from the winner at check-in in order to board the cruise ship, for all incidental charges. Standard terms and conditions of travelling with Princess Cruises will apply. The Promoter reserves the right to refuse to allow the winner and/or his/her travelling companion to take part in any or all aspects of the prize if the Promoter determines in its absolute discretion that the winner and/or his/her travelling companion are not in the mental or physical condition necessary to be able to safely participate in the prize, or if they pose a risk to the safety and wellbeing of any other passenger.
Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is AU$5,918.
The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
If the prize remains unclaimed by 9am AEDST on 12/10/2016, a re-draw may take place at 10.30am AEST on 12/10/2016 at the same place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing by email within two (2) business days of the re-draw, and their name will be published in The Australian on 19/10/2016.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in the prize.
As a condition of accepting the prize, the winner (and his/her companion or the companion’s parent/legal guardian if they are a minor) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize supplier (Cruise Megastore) and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policies, which can be viewed at http://www.readersdigest.com.au/privacy-policy (for Australian residents) and http://www.readersdigest.co.nz/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the Promoter's Privacy Policies, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Australian Privacy Policy also contains information about how Australian entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All New Zealand entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose entrants’ PI collected in Australia to entities outside of Australia (for a list of the countries, see the Promoter's Privacy Policy).
The information entrants provide will be collected and used by Cruise Megastore for the purpose of conducting this promotion. Cruise Megastore may disclose entrants' personal information to its agents to assist in conducting this promotion or communicating with entrants. Cruise Megastore may also use details for its promotional and marketing purposes, including to contact entrants via direct mail, electronic marketing, SMS or telemarketing. Cruise Megastore is bound by the Australian Privacy Principles in the Privacy Act 1988. Entrants can request access or correction to the personal information Cruise Megastore holds about them by contacting Cruise Megastore Consumer Services on 1300 657 948. Cruise Megastore's privacy policy is available on the Cruise Megastore's web site www.cruisemegastore.com.au/privacy and contains full details on how personal information will be handled, including how individuals can complain and how such complaints will be handled. Cruise Megastore will not disclose personal details collected in Australia to any entities outside of Australia.
