TERMS & CONDITIONS:
Information on how to enter this Promotion and Prize details form part of these Terms and Conditions of entry (Terms). These Terms apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
The promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of Level 14, 40 Mount Street, North Sydney NSW 2060, Australia (Promoter).
The outlets participating in the Promotion are selected Woolworths stores nationally which display Promotion materials during the Promotion Period (Participating Outlets). Participating Outlet locations are available at http://www.woolworths.com.au/wps/wcm/connect/website/tools/store+locator
The Promotion will be open from 12.01am Australian Eastern Daylight Time (AEDT) on 02/11/2016 and will close at 11.59pm AEDT on 06/12/2016 (Promotion Period).
Entry is open to Australian residents aged 18 years and over, excluding:
(a) management, employees, directors and contractors of the Promoter, its related entities, and other agencies, firms or companies associated with the Promotion (including suppliers of Prizes);
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms;
(c) persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
(d) persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
(e) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrants).
The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion. By entering this Promotion you represent that you are eligible to enter.
To enter the Promotion and be eligible to win, Eligible Entrants must, during the Promotion Period:
(a) Purchase any one (1) or more of the below listed eligible Coca-Cola products in any size (Eligible Product) in one (1) transaction from a Participating Outlet during the Promotion Period and retain a copy of their purchase receipt (Qualifying Purchase):
(i) 'Coca-Cola';
(ii) 'Coca-Cola Zero';
(iii) 'Diet Coca-Cola';
(iv) 'Coca-Cola Life';
(v) ‘Fanta’;
(vi) ‘Sprite’; and/or
(vii) ‘Hard Hitting Lemon Lift’; and
(b) complete their entry in accordance with these Terms,
(Eligible Entry).
By submitting an Eligible Entry in this Promotion, Eligible Entrants agree that if they are drawn as a Winner they, or a nominated friend or family member, will return to the Participating Outlet where they made the Qualifying Purchase associated with their winning Eligible Entry to collect their Prize within 10 days of notification, otherwise they will forfeit the Prize and the Prize will be awarded to a reserve winner who can meet this requirement. All costs associated with collection of a Prize are the responsibility of the respective Winner.
Eligible Entrants can complete their Eligible Entry during the Promotion Period by sending an SMS to 1977 5555, containing:
(a) the last five (5) digits of their Eligible Product barcode;
(b) their first name;
(c) their surname;
(d) the store number of the Participating Outlet where they made their Qualifying Purchase (Store Number),
(SMS Entry).
For an SMS Entry to be valid:
(a) it must be sent from an SMS enabled mobile handset (SMS entries sent via the internet are ineligible) that is connected to a service provider and service plan (if applicable) that permits the Eligible Entrant to send SMS to premium SMS numbers (some handsets are incompatible and some service providers and/or some service plans do not permit premium SMS);
(b) it must be identifiable by a MSISDN (unique mobile SIM number);
(c) the Eligible Entrant submitting the SMS Entry must have the bill payer's permission to enter the Promotion prior to submitting their SMS Entry; and
(d) it must be in the following format (Required Format): Last five (5) digits of Eligible Product barcode + First Name + Space + Surname + Space + Participating Outlet’s Store Number

Maximum cost of each SMS Entry is 55 cents (including GST), and is the responsibility of the entrant.

If an Eligible Entrant submits a valid SMS Entry which complies with the Required Format they will receive an SMS response confirming that their SMS Entry has been successfully submitted (SMS Response).
If an Eligible Entrant submits an SMS Entry which does not comply with the Required Format and/or otherwise does not comply with these Terms, they will receive an SMS response informing them of the error in their SMS Entry and that their SMS Entry has not been successfully submitted (Error SMS Response).
SMS Response and/or Error SMS Response (as applicable) receipt times may vary and are subject to network coverage and availability, the number of entries received by the Promoter, the available memory on the entrant's mobile SIM card and other technical factors.
If the Eligible Entrant receives an Error SMS Response and chooses to submit a new SMS Entry in the Required Format, they will be charged an additional 55 cents (including GST).
Eligible Entrants can also complete their Eligible Entry during the Promotion Period by:
(a) Visiting www.SummerCoolerPromo.com and following the links to the Promotion entry page (Online Entry Site);
(b) fully completing and submitting the online Promotion entry on the Online Entry Site (Online Entry Form), including:
(i) all personal details required on the Online Entry Form, including but not limited to their first name, surname, email address, state, postcode and phone number;
(ii) the Participating Outlet where they made their Qualifying Purchase,
(iii) the last five (5) digits of their Eligible Product barcode;
(iv) the last three (3) digits of the receipt number corresponding to the Qualifying Purchase; and
(v) indicating their acceptance of these Terms,
(Web Entry).
If an Eligible Entrant submits a Web Entry:
(a) which complies with these Terms, they will receive an onscreen notification confirming that their Web Entry has been successfully submitted; or
(b) which does not comply with these Terms, they will receive an onscreen notification that their Web Entry has not been successfully submitted, whichever is applicable in the circumstances.
Each Qualifying Purchase/receipt counts towards one (1) Eligible Entry only.
A maximum of one (1) Eligible Entry may be received:
(a) per mobile phone number per day in the case of SMS Entries; and
(b) per household per day in the case of Web Entries, subject to a limit of 20 Eligible Entries per mobile phone number and/or per household during the Promotion Period.
For the avoidance of doubt, if an Eligible Entrant purchases more than one (1) Eligible Product in a single Qualifying Purchase, they may only submit one (1) Eligible Entry.
An entrant may win a limit of one (1) Prize in the Promotion (excluding residents of South Australia).
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.
Eligible Entrants can only enter the Promotion in their own name. Entrants who enter using multiple aliases (i.e. multiple names, addresses and/or email addresses) will be disqualified.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries or entries not received for any reason. The Promoter is not responsible for technical difficulties with the entry mechanisms and does not warrant that the entry mechanisms will be available at all times. Entrants acknowledge that SMS is not a guaranteed delivery communication tool.
Incomplete, illegible, indecipherable or incorrect entries, entries which are not in the Required Format (in the case of SMS Entries), entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights (including intellectual property rights) are invalid.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism/s in any way, or who does not properly comply with the entry process, will be ineligible to win. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms.
All computerised draws (Draws) will take place at 12 noon AEDT on 07/12/2016 (Draw Date) at Prime Focus, Level 1, 500 Chapel Street, South Yarra, VIC 3141 (Draw Location).
The Promoter may draw reserve entries in each Draw and record them in order in case an invalid entry or ineligible entrant is drawn, or if a Prize is not claimed in accordance these Terms (Reserve Entries).
The Draws will be conducted by a representative of the Promoter.
There will be one (1) Draw conducted for each of the 993 Participating Outlets. Entries into each Draw will be allocated based on the Participating Outlet referenced as part of each Eligible Entry.
The first Eligible Entrant with a valid Eligible Entry drawn in each Draw will win a Prize (Winners).
Each Prize is a Coca-Cola Branded Retro Metal Cooler (capacity - 28L; size - 36cm long x 29cm wide x 45.7cm; weight - 4.8kg) valued at $249.95 RRP (including GST) (Prize). Prize awarded will be the Prize that is featured in each Participating Outlet.

The Promoter accepts no responsibility for any variation in the value of a Prize, or for any tax liabilities that may arise from winning a Prize.
Prizes are not transferable and cannot be exchanged as cash. Prizes must be taken as offered and may not be varied. All other costs associated with a Prize are the responsibility of the Winner.
The Winners will be notified via text message (SMS entrants) or email (WEB entrants).
The Promoter reserves the right to request that a Winner provides proof of his/her Qualifying Purchase, identity, residency and/or age prior to awarding a Prize. Proof of Qualifying Purchase, identification, residency and/or age considered suitable for verification is at the discretion of the Promoter. In the event that the Winner cannot provide suitable proof, in the timeframe required by the Promoter, the Winner will forfeit the Prize and no substitute will be offered.
If the Promoter is unable to contact a Winner to claim fulfilment of the Prize by 11.00am AEDT on 07/03/2017 or the Winner cannot provide suitable proof as required by paragraph 35, and there are no Reserve Entries remaining, a computerised re-draw for the Prize will take place at 12 noon AEDT on 07/03/2017 (Re-draw Date) at the Draw Location, subject to any written directions given by State and Territory gaming departments. The re-draw Prize winner/s will be notified via text message (SMS entrants) or email (WEB entrants).
The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches a Winner.
If more than one person attempts to claim a particular Prize, the Promoter has sole and absolute discretion to determine which of those persons the winning Eligible Entrant is.
In the event that the Promoter is unable to supply a Prize, the Promoter reserves the right to supply an alternative prize of the same or greater value, subject to any written directions given by State or Territory gaming departments.
The Promoter’s decision is final on all matters and no correspondence will be entered into.
Winners must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of a Prize, free of charge, and they consent to the Promoter using their name and image in promotional material for an unlimited time and without remuneration.
Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.
The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award a Prize. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the relevant authorities in the relevant States, the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes) for the following purposes:
(a) conducting the Promotion;
(b) contacting the entrant in relation to the Promotion;
(c) publishing the winners' names and State / Territory of residence in accordance with these Terms and as required under relevant legislation (if applicable);
(d) improving the Promoter's or the Promoter's related entities' goods and services;
(e) in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available at http://www.ccamatil.com/en/privacy-policy or by writing to the Promoter at the address set out in paragraph 2 of these Terms).
The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by contacting the Promoter at the details listed in paragraph 2 of these Terms. The Promoter's privacy policy also contains information about how Eligible Entrants can make a complaint. All personal information will be stored at the office of the Promoter.
Eligible Entrants who submit a Web Entry, at the time of entering the Promotion, may consent to receive commercial electronic messages and CCA Marketing Communications (as defined in this paragraph) by checking the tick box on the Online Entry Form next to the following message: "I would like to sign up to receive information on special offers, exclusive competitions, new products and more from the Coca-Cola Amatil group of companies and its related entities" (Express Consent). Where an Eligible Entrant provides Express Consent, the Promoter will use the information provided by the Eligible Entrant on the Online Entry Form to send the Eligible Entrant further communications in relation to special offers, exclusive competitions, news and event information in relation to the Promoter's product range (CCA Marketing Communications). Eligible Entrants who do not provide Express Consent will not receive CCA Marketing Communications. Eligible Entrants may unsubscribe from the CCA Marketing Communications at any time. For the avoidance of doubt, an Eligible Entrant does not have to provide Express Consent in order to enter the Promotion.
The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion, including injury or damage to a participant’s or any other person’s computer related to participation in this Promotion and problems with transmission of entries over the internet/via SMS, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.
Acceptance and use of the Prizes is subject to any terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the Prizes (Third Party Terms). Each Winner is responsible for complying with all applicable Third Party Terms, and bears all risk associated with failure to comply with any of them. The Promoter assumes no liability (and will provide no compensation) as a result of any failure to comply with any Third Party Terms.
All costs associated or arising in connection with participating in the Promotion and the Prize are the responsibility of the Eligible Entrants. Any costs associated with accessing the internet are the Eligible Entrant's responsibility, and depend on the internet service provider used. All costs associated with sending an SMS are the Eligible Entrant's responsibility.
The Promoter, the Promoter's related entities, the Participating Outlets, and all agencies associated with the Promotion; and the employees, agents, directors and contractors, of all entities referred to in this paragraph, will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with this Promotion or as a result of accepting or using a Prize, except for any liability which cannot be excluded by law.
If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from any applicable regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
