By participating in this competition (‘Promotion’), participants (‘Participants’) are deemed to agree with these terms and conditions.
Entry is only open to Australian residents aged 16 years or over. Entrants between the ages of 16 and 18 years must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
The promoter means the legal entity identified in the Maxxis Tyres Australia privacy policy found at https://maxxistyres.com.au/privacy/ (‘Promoter Privacy Policy’ and ‘Promoter’ respectively).
Employees (and their immediate family members) of the Promoter and agencies associated with the Promotion are ineligible to participate in the Promotion.
The Promotion Period is specified in promotional social media posts. The times are AEST. Any entries made after the Promotion Period will be disqualified.
To be eligible to win, participants must have ‘followed’ the Maxxis Tyres Australia Instagram Page, and performed the action specified in the promotional post (via the @maxxis.tyres.australia Instagram page).
The Promotion is a game of chance. The eligible Participants picked at random will win.
The Promoter reserves the right to (a) verify the validity of Participants and their entry, (b) reject any entry that is incomplete or illegible
All relevant details and updates in reference to this competition will only be delivered by this official Maxxis instagram account (@maxxis.tyres.australia). There is no other account affiliated with this competition; and no other account that has the authority to impersonate Maxxis Australia’s information. If an unusual account attempts to contact you, as an entrant, please report them and do not interact with them.
The winner(s) will be notified via a public post on the Maxxis Australia Instagram page: @maxxis.tyres.australia. The Promoter’s decision is final and no correspondence will be entered into.
All entries become and remain the property of the Promoter. The Promoter may use the Participant’s name and entry content for any commercial purpose, including future promotional marketing and publicity purposes.
All personal information about a Participant submitted as part of an entry will be protected in accordance with the Promoter’s Privacy Policy. All Participants who choose to ‘opt in’ consent to have their contact details released to the Promoter and to receive ongoing marketing material and communications from the Promoter and agencies associated with the Promotion.
If the winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.
If for any reason a winner does not take or claim the prize as of 5 days after the Promotion Period, the Promoter may either (a) award the prize to another valid Participant, or (b) treat the prize as forfeited.
The number of individual prizes to be won is specified in the promotional post.
The prize is not transferable, non-refundable and not redeemable for cash.
If for any reason the Promotion is interfered with or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant, or (b) modify, suspend, terminate or cancel the Promotion.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the prize, except for any liability which cannot be excluded by law.
The winner should seek independent financial advice related to the prize.
