Throughout the 2017 Australian Football League home and away season (“Season”) Eligible Participants are able to create one (1) user registration. There are no fees, charges, or purchases required to play THE GAME, other than relevant internet usage costs.
2. TERMS OF GAME
THE GAME commences at 12:01 am Australian Eastern Daylight Savings Time ("AEDST") on 23 February 2017 and closes at 11.59 pm Australian Eastern Standard Time ("AEST") on 287 August 2017 ("Promotion Period"), and will cover each of the 23 regular rounds in the Season ("Rounds"), as notified on thegame.com.au
Within THE GAME there are 3 available Games to play and enter: Tipping, Pick 7 and Draft Fantasy.
3. WHO IS ELIGIBLE TO PARTICIPATE
Participation in THE GAME is open to Australian residents, 18 years of age or older, excluding Management, employees and contractors of the Promoter, Fan Hub Media, Sportsbet, Seven Network (Operations) Limited, and Mazda Australia Pty Ltd (Mazda Australia), their agencies and other firms or companies associated with this Promotion, and their immediate families ("Eligible Participants").
There are certain minimum activity requirements for all participants. Participants who fail to meet the minimum activity requirements will be disqualified.
4. HOW TO PARTICIPATE
To participate, Eligible Participants must, during the Promotion Period:
visit www.thegame.com.au ("Website") or download THE GAME application;
register for the THE GAME using the online registration form for THE GAME competition;
create and/or join a public or private competition (“League”);
nominate an AFL team to support; and
participate in THE GAME in accordance with these terms and conditions. ("Eligible Entry"). ("Registration").
Only one Registration per Eligible Participant (and per email address supplied) will be accepted.
If an Eligible Participant is invited to join a League, they may enter the appropriate details to join that League during registration.
Alternatively, an Eligible Participant can create a private or public League and invite other Eligible Participants to join. An Eligible Participant may advise a person about THE GAME and invite them to join by sending them an email through the Website. The Eligible Participant warrants that any person they send an email to in this manner has consented to the receipt of the email.
If an Eligible Participant does not select a League during registration, they will be automatically entered into a public League
After registration, Eligible Participants may participate in all remaining Rounds which have not already been completed or Locked-Out.
5. TIPPING GAME
Prior to the commencement of each Round in Season, an Eligible Participant must make a selection of the teams the Eligible Participant tips to win (Tip) and the margins by which it is expected the winning teams’ scores will exceed the losing teams.
An Eligible Participant may make or change a Tip for a given Match in a Round at any time prior to the scheduled starting time of that Match.
Eligible Participants will be allocated points based on their Tips (“Score”).
One (1) point will be allocated for each correct winning team selection.
Zero (0) points will be allocated for each incorrect team selection.
In the event of a Match drawn, cancelled, abandoned, not completed or not played for any reason and/or a result not officially declared within three (3) days of the date the Match was originally scheduled to be played, it is treated as a win for both teams competing in that Match.
If an Eligible Participant:
does not submit a Tip for a given Match in a Round, then the Eligible Participant's Tip for that Match will be deemed to be for the away team;
enters the Promotion after the commencement of the first Round, then the Eligible Participant’s Tips for those Rounds that have been completed will be deemed to be for the away teams;
does not enter a Margin for a Margin Match, then the Eligible Participant’s Margin will be the average Margin of all the Margins submitted by Eligible Participant’s in that Round.
Margins are taken into account when two or more Eligible Participants have the same Score. The number of points between an Eligible Participant’s Margin prediction and the actual Margin for a Match will form the basis of the Eligible Participant’s Margin Score. The Margin Score will accumulate each week.
Eligible Participants will be ranked on a leaderboard on the Website. Rankings will appear by Score for the previous Round (“Round Ranking”), and the overall Score for all previous Rounds (“Overall Ranking”). These rankings are an indication of ranking for all participants in THE GAME (including persons who participate in THE GAME who are not Eligible Participants).
A $1,000 prize will be awarded to the Eligible Participant with the highest score at the end of each Round. In the event of a tie the prize will be awarded to the Eligible Participant, from the tied Eligible Participants, who submitted their Tips first in time, as determined by the Promoter.
A $50,000 major prize will be awarded to the Eligible Participant with the highest score at the end of the Season. In the event of a tie the prize will be awarded to the Eligible Participant, from the tied Eligible Participants, who registered for THE GAME first in time, as determined by the Promoter.
6. PICK 7 GAME
Prior to the commencement of each Round in the Season, each Eligible Participant must select seven Active Players from a pool of players.
Eligible Participants will score points based upon the real-life performance of their Active Players for each Round, based on the point system set out below.
Points will be awarded (or subtracted) for each performance statistic attributed to each Active Player during the Round as follows:

The Team captain will score double points. In the event the Team captain does not play and therefore scores 0 points, the vice-captain will score double points.
Eligible Participants will only receive the points accumulated or subtracted by Players whilst they are in the Eligible Participant’s team.
Eligible Participants will be ranked on the Website by their overall score for THE GAME to date ("Overall Ranking"), where in each case the highest score is the highest rank.
The scoreboard will be updated on the day following completion of each Round, and Eligible Participants will be sent their score for each Round via email.
In the event of a tie between two (2) or more Eligible Participants for a position on the scoreboard after any Round (for a Round Ranking or an Overall Ranking) the Eligible Participant, from the tied Eligible Participants, who registered to participate in THE GAME first in time, as determined by the Promoter, will be ranked higher.
A $1,000 prize will be awarded to the Eligible Participant with the highest rank at the end of each Round.
7. DRAFT FANTASY
Prior to the commencement of Round 1 in the Season, each Eligible Participant must select one player at a time from a shared pool of players until each Eligible Participant in a particular Draft League has a unique team of players that they maintain for the entire Season.
Eligible Participants will score points based upon the real-life performance of their Active Players for each Round, based on the point system set out below.
Points will be awarded (or subtracted) for each performance statistic attributed to each Active Player during the Round as follows:

The Team captain will score double points. In the event the Team captain does not play and therefore scores 0 points, the vice-captain will score double points.
Eligible Participants will only receive the points accumulated or subtracted by Players whilst they are in the Eligible Participants team.
Eligible Participants must create and/or compete in private/public Leagues and may invite friends to join their League(s).
During the Fantasy Draft registration process, participants who do not create a private League or who were not invited to join a private League, will not be eligible to play
During the season, the Eligible Participant’s Fantasy team will "play" against each Fantasy team in their League. The draw for each head-to-head fixture in a League is generated automatically. The winner of each head-to-head fixture is the participant whose Fantasy team scored more Fantasy points for that Fantasy round.
4 Fantasy points will be awarded for a win and 2 points for a draw (no points will be awarded for a loss).
If the League opts to play a Finals series as part of its creation, the League winner will be decided by a head-to-head knock-out playoff in the last 3 Fantasy Rounds of the League’s schedule.
If the League opts not to play a Finals series, the League winner will be determined by the number one ranked Eligible Participant on the League ladder.
8. GENERAL
The Promoter is West Australian Newspapers, ABN 98 008 667 632 of Newspaper House, 50 Hasler Road, Osborne Park WA 6017. Apple Inc. is not a Promoter.
By participating in THE GAME, Eligible Participants agree to being contacted (including via email) by the Promoter and/or Fan Hub Pty Ltd from time to time in conjunction with THE GAME. Eligible Participants also agree to information about them and their participation in THE GAME being displayed on the Website, and to their participation being tracked via the use of cookies.
The Promoter accepts no responsibility for any Registrations not received for any reason during the Promotion Period. Registrations will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected Registrations. The Promoter is not responsible for technical difficulties with the online Registration process and does not warrant that the online Registration will be available at all times.
If for any reason THE GAME is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to compliance with any laws.
Any participant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process (including submitting incomplete Registrations), will be ineligible to participate.
The Promoter reserves the right to disqualify participants in the event of non-compliance with these Rules.
In the event there is a dispute concerning the conduct of THE GAME, the decision of the Promoter is final and binding on each person who participates and no correspondence will be entered into.
To the extent permitted by law, the Promoter, Fan Hub Media, Sportsbet, Seven Network (Operations) Limited and Mazda Australia Pty Ltd, and their associated agencies and companies shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with THE GAME.
Information about Eligible Participants is used by the Promoter to assess and process registrations for THE GAME. If a person wishing to participate in THE GAME does not provide the required information (see clause 4 above), the Promoter cannot process the registration and the person will not be entered into THE GAME. All registrations and information contained in them become the property of the Promoter and will be entered into a database. Information emanating from the Eligible Participant's participation in THE GAME is used by the Promoter and its agencies associated with it for the determination of the scoreboard, referred to in clauses 5.6, 5.7 and 5.8 above. Eligible Participants consent to the publishing of their personal information and score on the Website by the Promoter. The Promoter will not be held responsible for, and expressly excludes, any loss of reputation, status or otherwise in connection with an Eligible Participant's score.
By participating in THE GAME, the Eligible Participant agrees and acknowledges that:
they may be contacted by the Promoter to provide comments about THE GAME and the Promoter (or an agent of the Promoter) may take photos of them;
the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
they acknowledges that the Promoter retains all right, title and interest, including copyright, in the Materials and, by participating in THE GAME, they assign to the Promoter on creation of the Materials all right, title and interest which might, but for these terms and conditions, vest in them;
they unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
they waive all Moral Rights in the Materials that arise outside Australia; and
they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
IF ANY PARTICIPANT ATTEMPTS TO DELIBERATELY DAMAGE THE WEBSITE OR THE INFORMATION ON THE WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE GAME, THE PROMOTER RESERVES THE RIGHT TO TAKE LEGAL ACTION PERMITTED BY LAW.
9. PRIZES – Game of Skill
If a winning Eligible Participant is or are unable to accept a prize for whatever reason, the Promoter will award that prize to the Eligible Participant who meet the eligibility criteria and would have been deemed to be the winner or winners had the winning Eligible Participant not participated in the Promotion;
All winners will be notified by phone or email by the Promoter and their name will be published on the Promoter’s Web Site.
To claim a prize, a winning Eligible Participant must provide proof of identity, proof of age and proof of their normal residential address (which must match the address nominated in their registration details).
If the winning Eligible Participant does not provide proof of identity, age and normal residential address to the Promoter within 10 working days of being sent a prize notification, then the prize will be forfeited. If the winning Eligible Participant provides any incorrect or invalid contact details their entry is null and void. If the Promoter is unable to contact the winning Eligible Participant within 10 working days of receiving their details then the prize will be forfeited and the next highest ranked Eligible Participant will be deemed the winning Eligible Participant.
There are no Apple Inc. prizes available for THE GAME.
Total Game of Skill prize value is $96,000 and is correct as at Tuesday 7 February 2017.
10. MAJOR PRIZE – Game of Chance
The Major Prize will be awarded to an Eligible Participant within one week of the end of the Season. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the major prize is awarded.
To qualify Eligible Participants must login to THE GAME a minimum of one time per week. Eligible Participants are then placed in a random draw to select one Eligible Participant from each round. The random draw to select one Eligible Participant from each round will take place at 11:00 AEDT/AEST at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 every Wednesday of the AFL home and away Season. The name drawn will be telecast during Seven News (Perth) between 6.00pm and 6.30pm (WST) every Wednesday of the season.
Eligible Participants that reside within the area where Channel Seven Perth’s broadcast signal is received must watch Seven News. If their name appears, they have 30 minutes to call Channel Seven on 08 9344 0777; if the Eligible Participant does not call within the 30 minutes then the Eligible Participant forfeits the opportunity to be registered for the final. No new winner will be drawn for that round.
An Eligible Participant that resides outside of the area where the Channel Seven Perth broadcast signal is received is exempt from calling Channel Seven within the 30 minutes and will be automatically registered.
Weekly finalists’ names will be published on the Promoter’s website on the following Wednesday after each weekly draw.
One winner will be randomly drawn, from the weekly finalists, on Wednesday 6 September 2017 at 10:00 AEST. The draw will be held at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000. The Winner will be notified by phone and by mail and their details will be published on the Promoter’s website from Friday 15 September 2017.
The Major Prize is a BT-50 XTR 4x4 Double Cab manual transmission (including all statutory and on-road costs and third party compulsory insurance) valued at $55,620. The major prize does not include comprehensive insurance or any accessories not specified. The winning Eligible Participant must attend their nearest dealership nominated by Mazda Australia to claim the vehicle prize. The winning Eligible Participant must provide all information and sign all documents required to allow Mazda Australia to register the vehicle in the winning Eligible Participant’s name before collection. The winning Eligible Participant must be able to register and operate the vehicle in the winning Eligible Participant’s name in accordance with applicable laws. However if the winning Eligible Participant is unable to register the vehicle in the winning Eligible Participant’s name then the winning Eligible Participant may transfer it to another person for the purpose of registration and ownership. The winning Eligible Participant (and any companion) must take part in all publicity, photography and other promotional activity as the Mazda Australia requires, without any compensation. The winning Eligible Participant (and any companion) consent to the Mazda Australia using your names and images in any promotional or advertising activity.
Subject to state government legislation, and if required, an unclaimed prize draw will take place at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Wednesday 6 December 2017 at 10:00 AEDT and Winner will be notified by mail and their details published the Promoter’s Web Site from Wednesday 13 December 2017.
Total Major Prize Value is $55,620 and is correct as at Tuesday 7 February 2017.
11. PRIVACY
Entry details remain the property of the Promoter. West Australian Newspapers Limited (ABN 98 008 667 632) and its related entities (“WAN”), are collecting your personal information for the purpose of conducting and promoting THE GAME (including games such as tipping, draft fantasy and Pick 7), for the purpose of identifying and notifying winners and for understanding our audiences. WAN will otherwise handle your personal information in accordance with Seven West Media’s Privacy Policy which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information, and whether we disclose your personal information overseas. Seven West Media’s Privacy Policy is available at http://info.thewest.com.au/documents/WAN_PrivacyPolicy.pdf. By providing your personal information, you agree to the terms of this Privacy Policy. Without limiting the foregoing, WAN may disclose the personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the Eligible Participant’s relationship with WAN. In addition, by entering this competition, you consent to WAN using your personal information for the purpose of WAN and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to WAN from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly. We will always provide you with the ability to opt out of those communications.
