Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia and New Zealand. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter, and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and immediate families) of the promoter, Gordon & Gotch Australia Pty Limited, Gordon & Gotch (NZ), and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
3. The promotion commences on 2 November 2017 and closes at 11:59pm AEST (for online entries) or last mail received (for mail entries) on 9 April 2018 ("Promotional Period").
4. The promoter's decision is final and no correspondence will be entered into.
5. To be eligible to enter, individuals must purchase any Puzzler branded puzzle magazine that features the '$20K Giveaway' promotional logo ("Participating Titles") during the Promotional Period. For the sake of clarity, any Puzzler branded puzzle magazine that does not feature the '20K Giveaway' promotional logo will be deemed invalid for entry into this promotion.
6. To enter, individuals must then complete one (1) of the following entry methods during the Promotional Period:
a) Mail Entry: To enter via mail, individuals must, with the coupon found inside the Participating Titles, complete at least one (1) puzzle in the Participating Title (purchased in accordance with clause 5 above), write the correct solution to that puzzle in the space provided on the official entry form (found within that Participating Title), complete the rest of the official entry form with all of the requested personal details (including their full name, mailing address and daytime telephone number), and then send the fully completed entry form to "Puzzler $20K Giveaway, PO Box 590, Sydney, NSW 2001, AU" (for Australian residents) or to "Puzzler $20K Giveaway, Private Bag 92-217, Auckland Mail Centre, Auckland, NZ" (for New Zealand residents) so that it is received during the Promotional Period.
b) Online Entry: To enter online, individuals must complete at least one (1) puzzle in the Participating Title (purchased in accordance with clause 5 above) then visit the promotional entry page at www.puzzler.com.au/competitions (in Australia) or www.puzzler.co.nz/competitions (in New Zealand), write the correct answer of the puzzle completed as prompted, and submit the online form with their personal details fully completed (including their full name, address, a valid email address and daytime telephone number) so that it is received during the Promotional Period.
7. Maximum of two (2) entries are permitted per Participating Title/Issue purchased, subject to the following: (a) maximum of one (1) Online Entry permitted per Participating Title/Issue purchased; (b) maximum of one (1) Mail Entry per Participating Title/Issue purchased; and (c) each entry must be submitted separately and in accordance with the entry instructions outlined above. Each Mail Entry must be posted in a separate stamped envelope and contain an official entry form with a correct Participating Title/Issue puzzle solution. For the sake of clarity, individuals are eligible to submit up to two (2) entries for each Participating Title/Issue purchased, however one (1) of those entries must be an Online Entry and one (1) of those entries must be a Mail Entry.
8. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
9. The promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the promoter for any reason whatsoever. Original copies of entries will not be returned to the entrant after the draw has been completed.
10. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid.
11. The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the promoter's discretion. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12. If there is a dispute as to the identity of an entrant, the promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. The draw will take place on 11 April 2018 at Direct Response Australia, Unit D, 65 Reserve Road, Artarmon, NSW 2064 at 10:00am (AEST). The promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
14. The winners will be notified in writing within two (2) business days of the draw and by telephone. The winners’ names will also be published online at www.puzzler.com.au and www.puzzler.co.nz, and in The Australian from 18 April 2018.
15. The first valid and correct entry drawn from all entries received will win AU$10,000, awarded in the form of a cheque made payable in the winner’s name.
16. The second valid and correct entry drawn from all entries received will win AU$5,000, awarded in the form of a cheque made payable in the winner’s name.
17. The third valid and correct entry drawn from all entries received will win AU$2,500, awarded in the form of a cheque made payable in the winner’s name.
18. The next five valid and correct entries drawn from all entries received will win AU$500, awarded in the form of a cheque made payable in the winner’s name.
19. Total prize pool is valued at up to AU$20,000.
20. If necessary, an unclaimed prize draw will be held on 11 July 2018 at the same time and place as the original draw in order to distribute any unclaimed prizes, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing within two (2) business days of the unclaimed prize draw. Winners’ names will also be published online at www.puzzler.com.au and www.puzzler.co.nz and in The Australian from 18 July 2018.
21. Prizes must be taken as offered. The prizes, or any unused portion of a prize, are not transferable or exchangeable. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. All prizes must be taken as offered.
22. The prizes will be delivered to the nominated mailing address of each prize winner to any State/Territory and/or city/suburb in Australia or New Zealand.
23. If a winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winner’s parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the promoter). Where relevant, the promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
24. The promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to prizes).
25. If an entry is selected as a provisional winning entry, validation of the winner's circumstances and the validity of their entry will be undertaken by the promoter. Method of validation (without limitation) will be determined by the promoter in its complete discretion. If the provisional winning entry is deemed to be a winner, the winner will be notified as per the Terms and Conditions herein. In the event that the promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the promoter. It is a condition of accepting the prize that the winner signs any such legal documentation. If an entrant is under the age of 18, the entrant's nominated parent or legal guardian will be required to sign the legal documentation required under this clause on their behalf.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize.
28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
29. Entrants consent to the promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.
30. Any cost associated with accessing the promotional website or posting any entries via mail is the entrant’s responsibility and is dependent on the Internet Service Provider or mailing company used and postage option selected.
Privacy
31. The promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The promoter may also disclose PI to other third parties, who may send the entrant promotional and marketing communications, unless the entrant ticks the box on the entry form stating "Please do not provide information about me to any organisation not associated with this competition". Entry is conditional on providing this PI. The promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.puzzler.com.au/legals/privacy-policy (for Australian residents) or www.puzzler.co.nz/legals/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the promoter's Privacy Policy, the promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the promoter. Entries collected in Australia will not be disclosed overseas.
