2. WHO CAN ENTER?
2.1 Subject to clause 2.2, 2.4 and 2.5, entry is open to residents of Australia, 18 years of age or older where the Channel Seven signal is received. 2.2 Employees and their immediate family members of Seven Network (Operations) Limited (“Promoter”), Qantas Airways Limited (“Sponsor”) and their associated agencies and companies and any prize suppliers are not eligible to enter. 2.3 In this clause 2.2, a reference to “Immediate Family Member” includes a spouse, defacto spouse, parent, natural or adopted child or sibling. 2.4 Entrants must be available to answer the door of their nominated address on the dates stipulated in clause 5.7 to be a valid winner. In the event a Prize Winner is unable to do so they will be deemed invalid, forfeit the Prize in its entirety and the Prize will be rejudged. 2.5 Entrants must be able to complete the Prize during December 2022 or January 2023 to be a valid winner. In the event a Prize Winner is unable to do so they will be deemed invalid, forfeit the Prize in its entirety and the Prize will be rejudged. 3. HOW TO ENTER 3.1 The competition commences on Wednesday 7th December 2022 at 5:30 AEDT and concludes on Monday 12th December 2022 at 12:00 AEDT (“the Competition Period”). 3.2 In order to enter, viewers must watch Sunrise (Monday to Friday) (“the Program”) on the Seven Network during the Competition Period where there will be a competition segment aired during the Program (or any replacement program broadcast in the Sunrise timeslot) which will invite viewers to enter the competition. 3.3 In order to enter, viewers must: (a) Go to www.7news.com.au/sunrise/win and click on the Sunrise Qantas Christmas Flights Competition tile to direct them to the dedicated competition page. (b) Complete the entry form including (but not limited to) the entrant’s full name and full address including suburb, state, and postcode (“Online”); and (c) Submit an answer to the competition question, “Tell us in 25 words or less why you or someone that you know needs free flights this holiday season?”. 3.4 Entries that meet the requirements of clauses 3.3 and adhere to these Terms and Conditions will be deemed a valid entry (“Valid Entry”). 3.5 Entries are unlimited. However, each entry must be significantly different to any previous entry. Entrants are only eligible to win one prize during the Competition Period. Page 2 of 6 3.6 Each entry must be: (a) the original independent creation of the entrant; (b) written in English; and (c) free from any claims, including but not restricted to copyright or trademark claims, by other parties. 3.7 Entry details remain the property of the Promoter and will not be returned to the entrant. The prize winners agree to grant the Promoter a perpetual and non-exclusive license to use their entries in all media worldwide and the prize winners will not be entitled to any fee for such use. 3.8 Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into. 3.9 Neither the Promoters nor Sponsor are responsible for any data or other information related to this competition that may be lost, damaged as a result of any computer software or hardware malfunction. Any issues occurring as a result of computer / server/ software problems will be rectified as quickly as possible. 3.10 Entrants must provide accurate and complete information when submitting entries, or the entry will be deemed invalid. 4. PRIZES 4.1 There will be Five (5) Prize Winners (“Winners”) in total throughout the Competition Period. Each Winner will receive: a) Up to four (4) x Qantas domestic economy return flights for use in December 2022 and January 2023 only, subject to availability (“Prize”) on a Qantas operated flight (with a QF flight code). One (1) of the selected Prize Winners will also receive: b) One (1) year’s worth of flights (two (2) x domestic economy return flights per calendar month valid for 12 months (until 31 December 2023) (“Surprise Prize”) subject to availability TOTAL MAXIMUM PRIZE POOL VALUE: $22,300.00 AUD 4.2 Prizes have been valued on average domestic economy fares therefore may vary based on destinations selected by winners. The Promoter and Sponsor take no responsibility for any variation in final value of prizing. 4.3 The Prize Winner who receives the Surprise Prize outlined in clause 4.1 b) will be determined by the Promoter at their absolute discretion. 4.4 Prizes cannot be exchanged, transferred, or traded for an alternative prize. 4.5 It is a condition of accepting a prize that the winner must comply with all the conditions of use of the Sponsor and the Promoter’s requirements. 4.6 The Prize outlined in clause 4.1 a) are for use only in December 2022 and January 2023. 4.7 Flights are subject to availability and Terms and Conditions apply. All travel on prize flights is subject to the Qantas Conditions of Carriage. 4.8 Winner of the Surprise Prize outlined in clause 4.1 b) must give 30 days notice for each flight booking over the 12 month period. 4.9 Prize Winners must give 7 days notice for booking of their flights in December 2022 and January Page 3 of 6 2023. 4.10 Prizes will be awarded to Winners in person by the Sponsor and/or the Promoter at the Winners’ nominated address, filmed live for broadcast during the Sunrise program on the dates stipulated in clause 5.7. The Winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. 4.11 The Promoter or Sponsor accepts no responsibility for any tax implications that may arise from acceptance or redemption of the prize, or this Competition. Independent financial advice should be sought by the Winner prior to accepting the Prize. The Promoter and Sponsor accept no responsibility for any variation in prize value. 4.12 In the event that the Prize outlined in Clause 4.1 above is, for any reason, not available, the Prize will be considered as forfeited and no cash alternative offer will be granted in lieu of the part of the Prize. If, for any reason whatsoever, a Winner does not take an element of their Prize within the time period stipulated by the Promoter then that element of the prize will be forfeited by the Winner and cash will not be awarded in lieu of that element of the Prize. 4.13 The prize winners grant the promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the prize winners will not be entitled to any fee for such use. 4.14 The prize winners agree that they will not sell or otherwise make available their story and/or photographs to any media or other organization. 4.15 The Prize Winners must provide valid identification to the Promoter upon the Promoter’s request. Failure to do so will result in the forfeiture of the Prize at the Promoter’s sole discretion. 4.16 Subject to state permit authority restrictions, the Promoter may reasonably amend these terms and conditions, orally or in writing, in its absolute discretion. 4.17 Full details of prizes can be obtained at 7news.com.au/sunrise. 5. HOW TO WIN 5.1 There will be Five (5) Winners in total, judged from the national pool of entrants received. 5.2 Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the Competition. 5.3 The Winners will be the best valid entries as judged (“Winner Selection”) by a panel of representatives appointed by the Promoter having regard to being the most deserving at Ansible Pty Ltd Level 3 100 Chalmers Street, Surry Hills NSW 2010 as stipulated in the table below. PRIZE WINNER SELECTION 1 Sunday 11th December 2022 at 12:30PM 2 Monday 12th December 2022 at 12:30PM 3 Tuesday 13th December 2022 at 12:30PM 4 Wednesday 14th December 2022 at 12:30PM 5 Thursday 15th December 2022 at 12:30PM 5.4 The Promoter and Ansible Pty Ltd reserves the right to judge additional reserve entries (and record them in order), in the event that an invalid entry is judged, or an entrant judged is ineligible. 5.5 This competition is a game of skill and chance plays no part in determining the prize winner. 5.6 The Winner must be available to answer their door and accept their prize on the dates detailed in the table below to be able to win the prize. If the Winner is not able to be available, they will forfeit Page 4 of 6 the prize in its entirety and the Winner will be rejudged. 5.7 On the dates stipulated in the table below, Sunrise will knock at the door of the relevant Winner’s home live on the Sunrise program scheduled to be broadcast on the Seven Network between 05:30 AM to 09:00 AM AEDT. In the event that the first (1st) does not answer or is not able to be available, that Winner will forfeit the prize in its entirety and the Promoter will call the remaining reserve Winners in the order they were judged, until the call is answered to ensure that the prize is awarded. In the event this process does not result in the prize being awarded, an unclaimed prize draw will take place as per the details set out in clause 5.10 below. 5.9 The prize winner’s names will each be published on the Sunrise website within three (3) business days of the relevant Winner Selection. 5.10 If any Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct an Unclaimed Prize Judging, as required, at the Promoter’s offices, on Monday 26th December 2022. The alternative Winner, if any, will be notified in writing and by phone within two (2) business days of the Unclaimed Prize Judging and their name published on the Sunrise website within three (3) business days of Unclaimed Prize Judging. 5.11 The judges’ decision is final, and the Promoter will not enter into correspondence regarding the result. 5.12 Incomprehensible and illegible entries will be deemed invalid. 5.13 It is a condition of accepting the prize that the prize winners must comply with all the conditions of use of the Prize and Sponsors requirements. Prizes are subject to Sponsor and prize suppliers Terms and Conditions. 5.14 It is a condition of accepting the prize that the prize winners may be required to sign a legal release in a form determined by the Promoter or the Sponsor in their absolute discretion. 6. NO LIABILITY 6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, pandemic, COVID-19, epidemic, government restraint, or act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize. 6.2 The Seven Network (Operations) Limited, Qantas Airways Limited and their associated agencies and companies will not take any responsibility for prizes damaged or lost in transit, or late, lost, or Page 5 of 6 misdirected mail. 6.3 Promoter, Sponsor and prize suppliers are not responsible for any costs associated with Prize collection. 6.4 The Seven Network (Operations) Limited, Qantas Airways Limited & affiliates and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: (a) during the judging; (b) as a consequence of late, lost or misdirected mail; (c) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; (d) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; and (e) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion. 6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter and/ or Sponsor which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation. 6.6 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements. 6.7 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s and the Sponsor’s legal rights to recover damages or other compensation from such an offender are reserved. 6.8 Seven Network (Operations) Limited and the Sponsor assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.9 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter or the Sponsor which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition. 6.10 By entering the competition, and by collecting a Prize, Winners acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Sponsor or prize supplier are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst a Winner is travelling. It is the responsibility of the each Winner to enquire about local issues and conditions at destinations prior to travel. Page 6 of 6 7. PROMOTER’S DETAILS 7.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of Media City, 8 Central Avenue, Eveleigh NSW 2015. 7.2 The Sponsor is Qantas Airways Limited (ABN 16 009 661 901) of Qantas Centre, Building A, 10 Bourke Road, Mascot, NSW 2020. 7.3 With your express consent to do so, by opting in via the competition entry form, the Sponsor will handle entrant’s personal information (e.g., first name, last name, address, suburb, state, postcode, phone number, email address, date of birth) in accordance with their privacy policy, which can be accessed at https://www.qantas.com/au/en/support/privacy-and-security.html. The Sponsor’s Privacy Policy may be updated from time to time, and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. The entrant may at any time, opt out of receiving contact from the Sponsor by emailing PrivacyOfficer@qantas.com.au. 7.4 Entry details remain the property of the Promoter.
