Terms and Conditions of Entry for RESIDENT EVIL: THE FINAL CHAPTER Facebook Competition (“Promotion”)
1. Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
2. The Promoter is Sony Pictures Releasing Pty Ltd ABN 28 000 030 115 of Level 26, 1 Market Street, Sydney NSW 2000 ("Promoter").
3. The Promotion will be open from 1.30pm Australian Eastern Standard Time ("AEST") on Wednesday, January 25 2017 and will continue until 12:00am AEST on Wednesday, February 1 2017 ("Promotion Period").
4. Entry is open to all Australian residents aged 18 years and over, other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including suppliers of prizes), and their immediate families ("Eligible Entrants").
5. To enter and be eligible to win, Eligible Entrants must during the Promotion Period:
Comment on the Facebook competition post with their answer to the question “Who would you call in the event of a global zombie apocalypse, and why?”
Completing this task will constitute one entry (an ‘Entry’). ("Eligible Entry").
6. The entry must be:
a) the original, independent creation of the entrant
7. The Eligible Entrant acknowledges and agrees that his or her Entry will not be obscene, defamatory, libellous, threatening, harassing, hateful, racially or ethnically offensive, or encouraging of conduct that would be considered a criminal offence, gives rise to civil liability, or violate any law.
Prizes
8. Judging of all Eligible Entries received during the Promotion Period will take place on Wednesday, February 1 2017. The judging will take place at Level 26, 1 Market Street, Sydney NSW 2000. The judging will be conducted by a representative of the Promoter.
9. This is a competition of skill and chance plays no part in the determination of the Winner.
10. The 1x Eligible Entrant with the most creative Eligible Entry will win from the Promoter a Sony Xperia XZ.
11. The Prize winner will be notified between Wednesday, February 1 2017 and Friday, 3 February 2017 and contacted via a reply comment to the winning Entry on the Facebook post thread with instructions for how to claim the prize. It is the winner’s responsibility to contact the Promoter with their postal details in order to claim their prize.
12. Any Prize which has not been claimed by 1.00pm AEST on Friday, 17 February 2017 will be re-distributed at the Promoter's absolute discretion.
13. The Prize is valued at $999 (including GST).
14. The Prize is not transferable or exchangeable and not redeemable for cash.
15. All other costs associated with the Prize are the responsibility of the winner.
16. The Promoter reserves the right to supply an alternative prize of equal or greater monetary value.
17. The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the winner.
18. The Promoter accepts no responsibility for any variation in the value of a Prize.
General
19. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
20. The judges’ decision (including any decisions as to prize distribution) is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
21. If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
22. Any cost associated with accessing Facebook and mobile applications is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
24. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
25. By entering the Promotion, the entrant understands and agrees with the terms of the Promoter’s Privacy Statement available at http://www.sonypictures.com.au/corp/privacy.html
26. By entering into the Promotion, the entrant agrees and acknowledges that:
A. the Promoter may use the Eligible Entrant’s winning entry (“Materials”) and full name for the Promoter's future promotional and marketing purposes without prior consent, further reference or compensation to them;
B. the Promoter may duplicate, alter, adapt and utilise the Eligible Entry as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
C. they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
D. they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
E. they waive all Moral Rights in the Materials that arise outside Australia; and
F. they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
27. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.
28. The Entrant confirms and warrants that they have full power and authority to enter into this agreement and hereby indemnifies the Promoter from and against any and all costs and damages incurred as a result of any breach of these Terms and Conditions.
29. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
30. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. All entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this Promotion.
