GROUPON EASTER SHOW GLAMPING COMPETITION TERMS & CONDITIONS
PROMOTER
1. The promoter is Groupon Australia Pty Ltd (ACN 147 834 151) of Level 17, 9 Hunter Street, Sydney NSW (“the Promoter”).
ELIGIBILITY
2. Entry to the competition is open to all Groupon customers over the age of 18 years with internet access, other than employees of The Promoter, their related companies, and their immediate families (“Eligible Entrants”).
3. Competition open to Australian residents only.
ENTRY
4. The promotion commences on Wednesday 22 March 2017, 9.00am ADST and ends on Thursday 30 March 2017, 11.59pm ADST (the “Promotion Period”).
5. To enter, Eligible Entrants must
(a) Purchase this $0 Sydney Royal Easter Show competition deal
(b) correctly complete the task as outlined in the competition instructions during the Promotion Period.
6. Entry into the competition constitutes acceptance of these Terms and Conditions.
PRIZE AND WINNING
7. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merits in completing the task. Entries must be the original, independent creation of the Eligible Entrant and free from any third party claims, including copyright or trademark claims. Entries must not:
(a) have been published previously; and
(b) contain information that is discriminatory, defamatory, or offensive or which infringes any law or regulation.
8. The Eligible Entrants consent to the Promoter, its related companies and the competition sponsors using comments made on the competition form, including placing such comments on its websites or third party websites for any commercial purpose including future promotional marketing and publicity purposes. Unless expressly requested by the Eligible Entrants to do so we may not acknowledge your authorship when posting comments.
9. Two (2) winners will be chosen by the Promoter at 9am AEST on Friday 31 March 2017 at Level 17, 9 Hunter Street, Sydney NSW. The decision of the Promoter is final and no correspondence will be entered into.
10. The winners will receive (the “Prize”) an exclusive overnight glamour-camping experience for four people (2 Adults + 2 Children under 15 years or 1 Adult + 3 Children under 15 years) at the 2017 Royal Easter Show on Saturday 8 April plus a two-day 2017 Royal Easter Show Family Pass valid for Saturday 8 & Sunday 9 April.
The glamour camping experience consists of:
5m x 5m Glamping tent for up to 4 people. Includes queen size bed and 2 x single beds with linen
Towels and face washers provided along with toiletries (soap, shampoo, conditioner and moisturiser)
Campground Host on site
Shared toilet and shower unit dedicated to thecampsite
Breakfast (includes bacon and eggs, fresh fruit, muesli, tea, coffee and orange juice)
Hand-feed farm animals
Toast marshmallows by the fire
11. The total Prize value is $1,997.92 ($998.96 per prize).
12. The winners will be notified by email address provided no later than 5.00PM ADST on Friday 31 March 2017. The winners will have their details published on www.facebook.com/groupon.au no later than 5.00PM AEST on Monday 3 April 2017. The winners have five (5) business days to respond, or will be deemed to have forfeited their prize. Should this occur, the Promoter reserves the right to award the prize to another Eligible Entrant.
PRIZE CONDITIONS
13. The Prize is available for the dates specified only - glamour-camping experience on 8 April 2017 and Family Pass on 8 & 9 April 2017. All components of the Prize must be taken together.
14. The Prize is non-transferable, cannot be redeemed for cash and will expire if not used by the dates referred to above. The winner must take the prize as described in these Terms and conditions, and the Prize cannot be used in conjunction with any other offer. This clause does not set out to limit any rights under the Australian Consumer Law.
15. All ancillary costs or accessories not expressly provided are the responsibility of the winner. The Prize excludes travel insurance, operational costs, fuel, extra accommodation, extra meals, tipping, applicable taxes, surcharges, upgrades, personal costs and any other ancillary or incidental costs related to the Prize or anything else not specifically mentioned, which is the responsibility of the winner and their chosen guests.
GENERAL
16. If for any reason beyond the control of the Promoter this competition is not capable of running as planned and the administration of this competition is affected, the Promoter reserves the right to cancel, terminate, modify or suspend the competition.
17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
18. The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as the Promoter deems fit and the Promoter’s decision will be final and binding upon every person who enters. No correspondence will be entered into. The Promoter expressly reserves the right to change the Terms and conditions of the competition at any time.
19. The Promoter collects a person's information to include the person in this competition. Use of personal information is governed by the Promoter's Privacy Policy at https://www.groupon.com.au/privacy. The winner in this competition agrees that their identity may be disclosed in winner announcements and promotional material.
20. The Promoter shall not be liable for any loss, damage or loss of profit (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained, as a result of participating in the competition and/or taking the prize, except for any liability which cannot be excluded by law. In accepting the prize, the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
21. These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales. All entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
