TERMS AND CONDITIONS:
1. Information on how to enter and prizes form part of these Terms and Conditions. By entering the competition, entrants are deemed to have accepted these Terms and Conditions and the Privacy Policy. Any violation of these Terms and Conditions may result in disqualification.
2. Entry is only open to Australian and New Zealand legal residents aged 18 years and over at the time of entry and who satisfy the entrance requirements contained herein.
3. Employees (and their immediate families) of Cosmetics Cubed Pty Ltd ABN 11 077 859 931 (“Promoter”), their related bodies corporate and the agencies associated with this promotion (including Travel Associates) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions or who otherwise tampers with the entry process. Manifest errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter accepts no responsibility for any incorrect, incomplete or lost entries.
6. If there is a dispute as to the identity or details of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or details of the entrant.
7. Promotion commences on 28/04/2014 at 9.00am AEST. Entries close on 28/06/2014 at 11.59pm AEST. Entries submitted and received by the Promoter after this time will not be accepted.
8. The winner (“Winner”) will be determined by a game of skill and entrants are required to demonstrate skill, talent, creativity and/or imagination in order to compete. The Winner will be the entrant with the most skillful, original and creative entry, based on the theme ‘French Kisses lip look’, deemed by a panel of judges at the offices of the Promoter located at 34 Wangaratta Street, Richmond, Victoria, 3121, Australia on Wednesday 27 August 2014 at 9amAEST. Chance plays no part in determining the Winner. The Promoter reserves the right to select additional valid reserve entries and record them in order, in case an invalid entry or ineligible entrant is selected and the Promoter elects to draw upon such reserve entries.
9. The Winner will be notified via Instagram and will be required to supply their name and email address (and a postal address if the Winner elects to have the prize posted to him / her) in order to coordinate the collection and receipt of his or her prize. The Winner’s name, Instagram Entry and/or Instagram handle may be published on the Mecca Maxima’s Instagram Account, Facebook Page, and in any other promotional material the Promoter deems relevant. Entrants consent to their details and images being published in these circumstances. If the Winner does not claim his or her prize within three months of email notification, or he or she is not otherwise contactable, the prize will be selected again, using the same procedure set out in clause 9, on Wednesday 17 December at 9am AEST, subject to any directions from a regulatory authority. This procedure will continue, as the context permits and in the Promoter’s absolute discretion, until a claimable Winner can be contacted. Unclaimed prize draws will be conducted and subject to any direction given under relevant legislation.
10. The Promoter’s decision is final and no correspondence or communication will be entered into in relation to such decision or associated process.
PRIZES:
11. There is one prize to be won. The Winner will win a Travel Associates Gift Voucher valued at $AU3,000.
12. Prizes, or any unused portion of a prize, or any part thereof, are not transferable, saleable or exchangeable and cannot be taken or redeemed as cash or equivalent. Further conditions of the voucher are set out in clause 15 of these Terms and Conditions below and may otherwise be set out on the voucher or the terms and conditions of Flight Centre.
13. The Winner will be responsible for redeeming the Gift Voucher, and making their own travel arrangements, directly with Flight Centre.
14. The Travel Associates Gift Voucher will be subject to terms and conditions of Travel Associates specific to the Gift Voucher which are specified on the Gift Voucher, including the following: a) They are redeemable at participating Travel Associates retail stores located within Australia. b) Unless otherwise stated on the Gift Voucher, they are valid for use within 12 months from the date of issue. c) They may only be applied up to the maximum value loaded onto the Gift Voucher which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Voucher, the excess amount must be paid by another payment method. d) They may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Voucher expires. e) They cannot be reloaded.
f) They may not be redeemed or exchanged for cash, traveller's cheques, cash passports or any other form of currency. g) You are responsible for the use and security of your Gift Voucher. Lost or stolen Gift Vouchers may not be replaced or refunded. h) Defaced, mutilated or altered Gift Voucher may not be accepted, replaced or refunded. i) They may not be used for payment of credit or retailer accounts.
15. Meals, accommodation, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other travel and associated costs, charges, taxes and expenses are not included in the prize and remain your responsibility.
16. If for any reason this competition is not capable of running as planned, (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, to cancel, terminate, modify or suspend the competition. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17. The Promoter makes no warranties, representations or guarantees, express or implied, in fact or in law, as regards this competition or the merchantability, quality or fitness for a particular purpose regarding any prize or any component of any prize.
GENERAL:
18. Entrants agree that they are fully responsible for the image they submit. The Promoter shall not be liable in any way for such image to the full extent permitted by law. Entrants warrant and agree that: (a) they will not submit any image that is unlawful or fraudulent, or that the Promoter may deem is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior written consent from any person or property that appears or is personally identifiable in their image; (c) they will obtain full prior written consent from any person who has jointly created or has any rights in the image, to the uses and terms herein; and (d) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
19. The Promoter is free to ‘regram’ and re-use the images submitted for any purposes whatsoever. Entries will not be returned to any entrant. As a condition of entering into this Promotion, each entrant permits the Promoter to ‘regram’ or use their images in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry image is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their images (and all intellectual property rights contained therein), which without such consent may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth) or relevant privacy laws.
