STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
WHO CAN ENTER
2.1 Subject to clause 2.2 and 9.1, entry is open to Australian and New Zealand, 18+ years of age residents only.
2.2. Employees, franchisees, and their immediate families of We Are Explorers, Amer Sports, Adrenaline, Freely, Tourism Tropical North Queensland, Athletic Brewing Co. or any related agencies, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, or step-sister.
HOW TO ENTER
3.1 The Competition commences on 16/09/22 at 10:00 AM AEST and closes 12/10/22 at 11:59 PM AEST (“the Competition Period”).
3.2 In order to enter, the entrants must complete the entry form on the Competition landing page by providing the entrant’s full name, email address, and State.
3.3 In order to enter, the Entrants must agree to receive email marketing communications from the Promoter and Competition Partners (who are; We Are Explorers, Amer Sports, Adrenaline, Freely, Tourism Tropical North Queensland and Athletic Brewing Co.). Entrants may unsubscribe to email marketing from the Promoter and Competition Partners at any time after receipt of the first promotional email from the Promoter.
3.4 Entrants may only enter once.
3.5 By entering the Competition, each Entrant consents to and grants a royalty free perpetual licence to the Promoter and the Competition Partners to use the winning Entrant’s name, in accordance with clause 5.4 below.
PRIZES AND UNCLAIMED PRIZES
4.1 The winners will be chosen at random with a certified third party draw service randomdraws.com.au™.
4.2 The winners will be notified by email.
4.2 Prizes cannot be exchanged or refunded in any way by the winner.
4.3 Prizes are valid for redemption until 01/11/2024.
4.4 Any prizes that remain unclaimed for 1 month after the end of the Competition Period will be awarded to another Entrant as determined by the Promoter. If required, this will occur on 13/11/2022.
SELECTION OF PRIZE WINNERS
5.1 Each Entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the prize pool.
5.2 The winner will be selected through a certified third party draw service randomdraws.com.au™ on the 13/10/2022 at 11:00AM AEST at the Promoter’ Premises at 2/10 Towers Drive, Mullumbimby NSW 2481.
5.3 The winner of the Competition, as determined by the Promoter, agrees to provide proof of age to We Are Explorers and any Competition Partners if deemed necessary by the Promoter.
5.4 The winner will be notified by email and will be announced on the Promoter’s social media platforms on 14/10/2022.
5.5 The winner will also be published on www.weareexplorers.co within 30 days of the draw.
5.6 The Promoter’s decision is final.
NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition or other as subject to any State Legislation.
6.2 The Promoter, its associated agencies and companies, and the Competitions Partners, will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail or email.
6.3 The Promoter, its associated agencies and companies, and the Competition Partners will not be liable to the Entrants or winners for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
6.3.1 during the draw;
6.3.2 whilst undertaking any travel won in connection with their entry into the Competition;
6.3.3 in the participation in any prize;
6.3.4 as a consequence of late, lost or misdirected mail or email;
6.3.5 due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; or
6.3.6 due to circumstances outside the Promoter’s, or any Competition Partners’ reasonable control.
6.4 The Promoter, its affiliates, and the Competition Partners, assume no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorised access to, or alteration of, entries, and reserve the right to take any action that may be available.
6.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserve the right, at their discretion, to disqualify any individual who tampers with the entry process or any other dishonest act, may take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State Legislation.
RESOLVING DISPUTES
7.1 Any Entrant may email the Promoter (sian@weareexplorers.co or henry@weareexplorers.co) and state their dispute.
7.2 The Promoter will be required to respond within 30 days and set a time for questions and answers if desired by the Entrant.
7.3 From the date of response, a final written decision from the Promoter will be supplied containing concise, reasoned decisions.
8.1 The details contained in your entry are protected by security safeguards as detailed in the Promoter’s Privacy Policy. The personal information collected as part of the entry is collected to run the Competition, enable identification of the winner, and for future marketing and promotional purposes by the Promoter and the Competition Partners. Your personal information will only be disclosed to the Promoter and its related corporate bodies and other listed Competition Partners, for these purposes, and the relevant Privacy Policies can be accessed via each of the Competition Partners’ website.
TRAVEL INSURANCE
9.1 Travel insurance cover (“Cover”): (1) is subject to underwriting eligibility criteria, limits, sub-limits, and the conditions and exclusions set out in the FGS/PDS; (2) is only available to Australian winners over 18 years of age; (3) may not cover certain existing medical conditions; (4) is valued at $1,500 per winner (“Cover Value”); and (5) is valid for a period of 1 year (“Cover Duration”), commencing from the first day of travel to the holiday in Cairns, and may be utilised for subsequent travel bookings by each winner for the Cover Duration until the Cover Value is exhausted.
9.2 Each winner will be contacted by Freely by telephone to assist with obtaining Cover via the Freely App. To access and arrange Cover (or to vary or purchase additional Cover), winners can download the Freely App from the Freely website, Apple Store or Google Play, and follow any additional instructions received by email or telephone.
9.3 Subject to meeting underwriting eligibility criteria, limits, sub-limits, and the conditions and exclusions set out in the FGS/PDS, winners may vary their Cover to suit their individual travel needs during the relevant period of travel. For more information on the types of Cover available (described as a ‘Boost’ or ‘Daily Boost’), please refer to the FGS/PDS.
