Competition being conducted by the Promoter, DarkLab Pty Ltd, trading as Dark Mofo (ABN 51615 687566).
Competition commences at 10am AEST on Wednesday 10 May 2017. Entries close 5pm AEST on Wednesday 24 May 2017.
Prize includes: two (2) return economy airfares from any Australian capital city (excluding Hobart) flying into Launceston and out of Hobart, departing 13 June 2017 and returning 19 June 2017; shared accommodation for six (6) nights; one (1) hire car for seven (7) days; Dark Mofo VIP accreditation; $500 cash; and two (2) tickets to each of the following:

If the winner is already in Tasmania during the Prize dates then the Prize does not include airfares and the airfare component of the prize is not redeemable for cash.
The Prize is valued up to a total of $6,600.00 (GST inclusive). The Prize value is based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for a change in the Prize value between now and the Prize redemption date.
The winner and their companion must depart from and return to the same departure point and travel together. The itinerary cannot be changed by the winner once the booking has been confirmed by the Promoter.
Frequent flyer points will not form part of the Prize.
Entrants are responsible for arranging their own transport to and from their nearest capital city airport.
The winner (and their companion) is responsible for all other expenses including travel to and from the departure point, petrol, car hire excess, additional spending money, food provisions, drinks, transfers, laundry charges, activities (unless specified), incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
Prizes cannot be transferred, exchanged, on sold or refunded for cash.
Entrants must be 25 years of age or over and hold a valid driver’s licence.
Entrants must have a public Instagram account.
The winner agrees to publicly post a minimum of one (1) photo per day to their personal Instagram account for the duration of their trip (7 days).
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter reserves the right to request the winner to provide proof of identity, and/or proof of entry validity in order to claim the Prize. In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.
This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the creative merit of the entry. Judges will be selected by the Promoter in its absolute discretion. All decisions will be final and no correspondence will be entered into.
The Promoter will select the winner at DarkLab Level 3, 93 Macquarie St, Hobart Tasmania on Thursday 25 May 2017 at 10:00am AEST. The Promoter may select additional reserve entries that they determine to be the next best, and record them in order in case an invalid entry or ineligible entrant is drawn.
Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
The winner will be notified on Friday 26 May 2017 via a post on the Dark Mofo Instagram account and also the email address they used to enter.
The winner will be published on darkmofo.net.au/the-dark-pilgrimage/ on Friday 26 May 2017.
If the winner does not take the Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
Dark Mofo is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
Employees (and their immediate families) of DarkLab and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in the prize.
The winner and their companion must comply with all regular terms and conditions of the elements of the Prize including, but not limited to, the accommodation provider, and car hire company.
As a condition of accepting the prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The winner agrees to the use of their name in any publicity material. Any personal data relating to the winner or any other entrant will be used solely in accordance with the Commonwealth Privacy Act 1988, and will not be disclosed to a third party (including Tourism Tasmania) who is not directly associated with this competition without the entrant’s prior consent. All entries become the property of the Promoter, and entrants agree to the use of their entry submission, and the content generated as part of their Prize requirements while they are on the pilgrimage, in Dark Mofo’s and Tourism Tasmania's marketing material in relation to the festival, including, but not limited to, sharing on Facebook, Twitter, Instagram, eDMs, the Dark Mofo website and printed materials.
Entering the competition is considered as acceptance of these terms and conditions.
Dark Mofo reserves the right to change the aforementioned terms and conditions at any time without prior notification. It is the entrant’s responsibility to check these terms and conditions for changes.
