1. Entry instructions and prize information form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
2. The promotion is open to Australian residents over 18 years of age. Employees and their immediate families of participating retailers, and their related companies and agencies associated with this promotion are ineligible to participate.
Dine with Justine and Emile Henry National Competition
1. Entry instructions and prize information form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
2. The promotion is open to Australian residents over 18 years of age. Employees and their immediate families of participating retailers, and their related companies and agencies associated with this promotion are ineligible to participate.
3. Entrants are eligible to enter the competition visiting www.emilehenrycompetition.com.au and fill out the entry form to enter including their answer.
4. Entry for the Emile Henry National Competition is free.
5. Only one entry is permitted per person.
6. The Emile Henry Australia National Competition begins 1 October and runs until close of business
12 December 2016.
7. All entry forms must be received by Emile Henry Australia from
www.emilehenrycompetition.com.au on or before 12 December 2016.
8. Any entry forms that are received by Emile Henry Australia on or after the 12 December 2016 will
be ineligible to participate or win.
9. The prize will be drawn at Emile Henry Australia’s Head Office, 5-7 Glassford Road, Kewdale WA
6105, at 11.00am AWST on 16 December 2016.
10.All winners will be announced via the Emile Henry Australia Facebook page
(www.facebook.com/EmileHenryAustralia) by 3.30pm on 23 December 2016.
11. The winner will be notified via the phone number and email address provided on their entry form by close of business 13 December 2016 AWST. Failure to claim their prize by close of business on 14 December 2016 will result in a runner-up being announced as the winner. If the winner does not respond, after being notified that they have won the competition, or the winner is not readily identified and reasonable efforts have been made by the promoter to identify the winner were unsuccessful, they will automatically forfeit their prize and the promoter reserves the right to
select another winner.
12. All prizes will be sent via email to the winning entrants on or by Friday 16 December 2016.
13. Western Australian Prize winners must be available to fly to Sydney on Thursday 19 January 2017,
returning to Perth, Western Australia on Sunday 22 January 2017.
14. NSW, Queensland, South Australian and Tasmanian prize winners must be available to fly on
Friday 20 January 2017, returning to their respective home states on Sunday 22 January 2017. All
winners will fly (return economy) from the capital city in their respective state.
15. Victorian prize winners must be in Sydney CBD on Friday 20 January 2017 until Sunday 22 January
2017.
16. All changes to flights and accommodation are at the expense of the prize winners.
17. An entrant is not eligible to win a prize in the Emile Henry Australia Competition if their entry form
is not filled in entirely and submitted by the closing date.
18. At the end of the Emile Henry Australia National Competition all existing claims to prizes and
entitlements will be met notwithstanding the advertised prize pool has been exceeded.
19. Emile Henry Australia does not accept any responsibility for damaged, misprinted, counterfeit, late, lost or misdirected entries. Emile Henry Australia reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by Emile Henry Australia to enforce any of its rights at any stage does not of itself constitute a waiver of those rights.
20. Emile Henry Australia does not accept responsibility for printing errors or other quality control matters outside the control of individual players and these errors will not be used as the sole basis for refusing to award a prize.
21. Prizes given out by Emile Henry Australia are not eligible to be replaced by, or substituted for, another prize.
22. The winner will receive the following prize: Return flights for two people from [home state] to Sydney, accommodation in Sydney CBD for two nights, dinner for two with Justine Schofield and transfers to and from Sydney Airport. Dinner at Felix with a curated menu with Justine Schofield to the value of $500. The winner will also receive an Emile Henry cookware pack to the value of $500 at recommended retail price and an autographed copy of ‘Dinner with Justine’ by Justine Schofield.
23. Total Prize Pool is valued at $5, 000. Prize does not include spending money.
24. Records relating to the Emile Henry Australia National Competition will be maintained for a period
of three years.
25. If for any reason this Competition is not capable of running as planned, or is interfered with or
disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, weather event, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend the Competition, or invalidate any affected entries.
26. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.
27. All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
28. A winner accepts a prize at their own risk. Any tax liability arising as a result of accepting a prize is the responsibility of the winner. Independent financial advice should be sought.
29. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage,
claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or a prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.
