The promoter is Aqueo Import & Distribution Pty Ltd (Havaianas Australia) (ABN: 55 098 528 440) of 13 Doody St, Alexandria, NSW 2015 telephone number (+61) 02 9369 0510 (Promoter). The Promotion involves the purchase of products from stores operated by Ozmosis Pty Ltd (ABN 52 147 803 950) (Ozmosis).
Duration
The promotion opens at 10:00 AM AEST on Monday, 24 September 2018 and closes at 18:00 PM AEST on Monday, 22 October, 2018 (Promotion Period)
Eligibility to enter
Entry is open only to Australian residents over the age of 18 (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoters (Havaianas Australia) and Ozmosis and its related bodies corporate and registered travel companions of employees of the Promoters and their related bodies corporate.
Entry into the promotion
Entrants must purchase a pair of Havaianas at any Ozmosis store located throughout Australia or from Ozmosis.com.au during the Promotion Period.
If the Havaianas are purchased in store, upon purchase the entrant must provide Ozmosis store staff with a valid email address. This email will be automatically entered into the Ozmosis and Havaianas Australia email databases. Entrants will be informed of this process by Ozmosis store staff and store signage at check-out.

One (1) Havaianas (pair) purchase counts as one (1) entry. Entrants who purchase multiple pairs of Havaianas will have their email address added to the pool multiple times - as many times as Havaianas purchased (e.g. Four (4) Havaianas purchased equals four (4) competition entries).
The time of entry will be deemed to be the time the entry is received by the Promoters.
The Promoters reserve the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoters accept no responsibility for any late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, transmission interruption, communications failure or otherwise.
The Promoters will not accept entries that they deem, in their absolute discretion, to be unlawful, fraudulent, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication.
Judging of entries
This promotion is a game of chance and the winners will be chosen from the list of submitted entrant’s emails at random. The Promoters’ decision in relation to all aspects of the promotion (including where an entry is deemed not to comply with these conditions of entry) is final and no correspondence will be entered into.

The Promoters will draw the one (1) major prize winner and five (5) runner up winners by 17:00 PM AEST on Monday, 29 October, 2018.
The Prize
It is a condition of entry that the prize winner accept all conditions of use of the prize.
There will be six (6) individual winners who will receive one (1) prize each. There will be one (1) major prize winner and five (5) runner up winners.
The major prize winner will receive one (1) Bali Bliss travel prize package up to the value of AUD $,8000. The package value is divided into two categories:
i. Up to AUD $5,000 to use on return flights for two (2) people from any major capital city in Australia, and three (3) or four (4) star accommodation for two (2) people for approximately seven (7) nights. A travel agent of the Promoter’s choosing will facilitate the booking of the flights and accommodation as stated above. Any additional funds needed to book the trip will be at the winner’s personal expense. If the AUD $5,000 allocation is not used up the winner will not receive the leftover funds.
ii. AUD $3,000 spending money in the form of one (1) AUD $3,000 Visa Gift Card.
The five (5) runner up individual winners will receive one (1) AUD $1,000 Visa Gift Card each. For all general Terms & Conditions relating to the individual prize, refer to VISA website.
The total prize pool value for all six (6) prizes is AUD $13,000.00.
The package for the Major Prize winner does not include travel insurance, meals or beverages, taxes, additional flights or transportation, and/or any other costs of a personal nature while the winner is in Bali. Compliance with any health or other government requirements is the responsibility of The Prize Participants. The Promoters make no representation as to the safety, conditions or other issues that may exist.
Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize is not exchangeable or redeemable for cash or other goods or services. The prize cannot be transferred to any other person, unless agreed to by the Promoters.
If the prize (or part of the prize) is unavailable, the Promoters, in their discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Notification of the winners for the major prize
The winner of the major prize will be notified via a Facebook post by The Promoters (Havaianas Australia) by 17:00 PM AEST on Monday, 29 October 2018. This Facebook post will also be shared on Ozmosis’ Facebook page. The winning Eligible Entrant must respond to the Promoters (Havaianas Australia) by direct message by 09:00 AM AEST Monday, 5 November 2018.
Notification of the winners for the runner up prizes
The five (5) winners of the runner up prizes will be notified via a Facebook post by The Promoters (Havaianas Australia) by 17:00 PM AEST on Monday, 29 October 2018. This Facebook post will also be shared on Ozmosis’ Facebook page. The winning Eligible Entrants must respond to the Promoters (Havaianas Australia) by direct message by 09:00 AM AEST Monday, 5 November 2018.
Right of the Promoters to redraw
The Promoters reserve the right to redraw any of the six (6) prizes in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming the prize. Every prize will be redrawn using the below process:
a) For any prize that remains unclaimed by 09:00 AM AEST Monday, 5 November 2018 the Promoters will draw a new winner (the first runner up) for the relevant prize by 17:00 PM AEST Monday, 5 November 2018. This new winner for the relevant prize will be notified via a comment made by the Promoters (Havaianas Australia) on the winner announcement Facebook Post made by The Promoters (Havaianas Australia) on Monday, 5 November 2018.
b) The first runner up for the relevant prize must respond to the Promoters via email by 09:00AM AEST Monday, 12 October 2018.
c) Upon no response of the first runner up, the Promoters reserve the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming the prize. For any prize that remains unclaimed by 09:00 AM AEST Monday, 12 October 2018 the Promoters will award the prize to the second runner up by 17:00 PM AEST Monday, 12 November 2018. The second runner up will be notified via a comment made by the Promoters (Havaianas Australia) on the winner announcement Facebook Post made by The Promoters (Havaianas Australia) on Monday, 12 November 2018.
d) The second runner up must respond to the Promoters via email by 09:00AM AEST Monday, 19 November 2018.
The Promoters reserve the right to discontinue a re-draw in the event of the second runner up being unable to satisfy these promotion terms and conditions or forfeiting or not claiming the prize.
Limitation of liability and variation of terms
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoters and which prevents the Promoters from complying with these terms and conditions, the Promoters will not be liable for any failure to perform or delay in performing its obligations. The Promoters reserve the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
The Promoters, their related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
The Promoter has no control over mobile telephone communications, networks or lines or the postal service and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction, outage, strike or otherwise.
Entry details and privacy
Entry details remain the property of the Promoter. The name and entry of the winner may be used for promotional purposes by the Promoter. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to third parties involved in the promotion and any applicable statutory authorities) and to conduct marketing activities. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion.
By entering this competition an entrant will receive The Promoters (Havaianas Australia) and Ozmosis email newsletters and is indicating his/her agreement to be bound by these terms and conditions. The data gathered from this competition may be used for promotional and marketing purposes, including marketing emails, cookies, and ads. By submitting your email with The Promoters (Havaianas Australia) and Ozmosis in any Ozmosis store throughout Australia, you have given The Promoters (Havaianas Australia) and Ozmosis express consent to send you these emails. Our company and the software providers that The Promoter (Havaianas Australia) and Ozmosis use have access to this data. All data is held securely through a secure email service provider as well as through at secure database. In the event of a breach of this data, we promise that you will be notified within 72 hours. You have a right to completely remove yourself from The Promoters (Havaianas Australia) and Ozmosis database and have all the records we hold on you removed. You also have a right to receive a copy of your data. You can achieve this by emailing help@havaianasaustralia.com.au and/or marketing@ozmosis.com.au
