This promotion (the “Promotion”) is brought to you by Emirates, a corporation established by Dubai Ruler’s Decree No. 2 of 1985 (as amended) having its principal office at Emirates Group Headquarters, Airport Road, P.O. Box 686, Dubai, United Arab Emirates (“Emirates”) and hosted via the website found at www.emirates.com/au/RWC15 (“Website”).
These terms and conditions together with the general terms and conditions that are applicable to your use of and access to the Website (together the "Terms") govern your use of the Website and set out the rules of participation in the Promotion. By entering the Promotion, you guarantee that you have the authority to accept these Terms and you agree to be bound by the Terms.
In the event of any dispute regarding the Terms or the conduct, results and all other matters relating to the Promotion, Emirates decision will be final and binding and no correspondence or discussion will be entered into.
The Promotion commences at 00.01 AEST on 30 August 2015 and closes at 23.59 AEST on 26 September 2015 (“Promotion Period”)
Qualifying Entrants
On the date of entry you must be at least 18 (eighteen) years of age and a legal resident of Australia in order to be eligible to enter the Promotion (“Qualifying Entrants”).
Employees of Emirates and/or their immediate family and agencies associated with the Promotion are not eligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promotion is only open to Qualifying Entrants who, on the date of entry, are legal residents of Australia and is void in any other country. Emirates shall not be taken to make any representations, express or implied, as to the lawfulness of any individual’s participation, or as to any other aspect of the Promotion.
Emirates reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. Errors and omissions may be accepted at Emirates’ discretion. Failure by Emirates to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant, Emirates reserves the right, in its sole discretion, to determine the identity of the entrant.
Rules of Entry
The Promotion must be entered as per any instructions set out for the Promotion on the Website. In order to eligible to participate in the Promotion, all bookings must be received via the Website no later than 23.59 AEST, 26 September 2015 (the “Closing Date”). No booking entries will be accepted after the Closing Date. Incomplete or indecipherable entries will be deemed invalid and Emirates accept no responsibility for entries which are incomplete, illegible, lost or delayed in transit.
To register for the Promotion, Qualifying Entrants must, during the Promotion Period, book and pay in full for an Emirates return economy, business or first class flight ticket via www.emirates.com/au the Website with point of origin and sale as Australia (the “Qualifying Ticket”) and then register their booking number on the Promotion landing page on the Website. In order to be in with a chance of winning, the Qualifying Entrant must describe in 25 words or less “Please tell us in 25 words or less which team is going to win Rugby World Cup 2015 and why?” Qualifying Tickets must be purchased for return journeys. One way flight tickets will not be eligible for entry into the Promotion. A Qualifying Flight will entitle the participant to 1 (one) entry into the prize draw.
Applications to participate in the Promotion can only be made via the Website. All applications are subject to acceptance by Emirates. The entrant agrees that Emirates shall not be liable as a result of any refusal or failure to accept an application and no compensation shall be payable to any person in consequence of such action.
Any Entrant, who fails to abide by any of these Terms or fails to meet the entry criteria set out in these Terms, may be disqualified at the sole discretion of the Emirates.
Two winners will be chosen from all eligible entries validly submitted (“Winners”). Winners will be chosen based solely on creative writing merit of their entry as determined by the judging panel. The judging will take place at Emirates, Level 17, 1 York Street, Sydney, Australia at 14:00 AEST on 28 September 2015. The decision by Emirates as to the Winners shall be final. Emirates may withdraw the Promotion at their discretion. The Winner will be notified via email and/or telephone within 2 [two] working days of the draw using the contact details provided at the time of entering the Promotion.
The Prize
Two (2) return Y Class (Economy) flights on Emirates from Australia (Sydney, Melbourne, Brisbane, Perth or Adelaide international airport) to London for the winner and one (1) guest (“Flight Tickets”) and two (2) Category A seat only tickets to the Australia v Wales match at Twickenham Stadium, London on 10 October 2015 (“Match Tickets”) (Collectively the “Prize”)
Winners and guests will be responsible for their own travel to and from the designated Rugby World Cup stadium and for any accommodation.
The Prize includes nothing other than that expressly stated to be included as part of the Prize. Proof of age may be required before the Prize can be given. Emirates reserves the right to substitute the prize for another prize of equal or greater value, should the need reasonably arise. The Winner and where applicable their guest will be responsible for all other costs and expenses associated with redeeming the Prize including but not limited to travel insurance, airfares, food, accommodation transfers (other than as provided for under these Terms) and any other ancillary costs associated with redemption of the Prize.
Flight tickets are valid on Emirates only and are non-extendable, non-transferable, non-re-routable, non-endorsable and non en-cashable and shall at all times be subject to availability and Emirates Conditions of Carriage and applicable ticket conditions as set out on the Emirates website. The Winner and their guest must travel together on the same dates / sectors on both outward and return journeys. If the Winner and / or guest is unable to utilize the flights or does not accept the Prize no cash alternative will be provided. All travel documentation and visas must be up to date and are the responsibility of the Winner and where applicable the guest. Flight Tickets do not include access to the Emirates Lounges. Skywards Miles are not accruable on the flights.
Nothing in this Agreement requires Emirates to provide transportation to any person except in accordance with:
Emirates General Conditions of Carriage for Passengers and Baggage and travel documents, including airline tickets and airway bills, issued by Emirates;
Emirates Schedule of Operations in place from time to time; and the relevant immigration rules applicable to any ticket holder.
Except in accordance with and subject to the limitations set out in the Warsaw Convention 1929 (as amended by the Hague Protocol 1955), the Montreal Convention 1999, and its travel documents (including but not limited to airline tickets and airway bills), Emirates accepts no liability to any person for any liabilities, losses, claims, demands, costs or expenses arising directly or indirectly from the utilisation of Tickets provided pursuant to the Promotion.
Allocation of Match Tickets shall be at Emirates sole discretion. The Match Tickets shall be subject to the applicable terms and conditions which apply to the possession and use of the tickets. The Match Tickets are non-transferable except as set out in the ticket conditions and cannot be sold, encashed or given away in any circumstances. Tickets cannot be used for commercial or promotional purposes.
The Prize is non-transferable and subject to availability. If a Winner or guest is unable to utilize the Prize no cash alternative will be provided.
In the event that a Winner cannot be contacted; fails to confirm acceptance of the Prize within 3 (three) working days of receiving notification; or is ineligible for entry into the Promotion then Emirates reserves the right to substitute them with another Qualifying Entrant of its choice. In the event that a Prize is unclaimed, the judging will take place at Emirates, Level 1, York Street, Sydney, Australia at 15.00 AEST on 1 October 2015, subject to any written directions from a regulatory authority. The Winners will be notified by email within 2 [two] working days of the draw. Emirates take no responsibility for incorrect contact details provided by the Winner.
Taxes
Total prize value is AUD 8,000 RRP. Any valuation of the Prize shall be based on information available to Emirates as at the date of the Promotion and the value of the Prize may be disclosed by Emirates where required by law for tax purposes. The Winner is solely liable for reporting and paying any and all applicable taxes including but not limited to, personal tax, service tax and other entertainment tax due as a result of the Prize and Emirates accept no responsibility for any tax implications arising as a result of the Prize.
Personal Information
Emirates collect and use the Qualifying Entrant’s personal information (the “Data”) in order to conduct the Promotion and may, for this purpose, disclose or transmit such information to third parties rendering services in relation to the Promotion. In processing the Data Emirates may transfer it to countries which may not afford the same level of data protection as your country of residence. However, in all cases, Emirates undertakes to collect, process, store, save and transfer the Data in compliance with relevant data protection legislation in force from time to time. By entering the Promotion and providing the Data the Qualifying Entrant authorises Emirates to collect and process the Data in this manner.
In consenting to receive the Emirates Newsletter, the Qualifying Entrant authorises Emirates to retain and use the Data and transmit the Data for the purposes of issuing the Emirates Newsletter.
In consenting to direct marketing the Qualifying Entrant authorises Emirates to retain and use the Data for other direct marketing, which may involve sharing the Data with Emirates’ offices, authorised agents, Emirates’ other companies and/or brands, anyone to whom Emirates transfers their rights and duties, third party companies offering related services (including, for example, car rental, hotels, limousines, transfers, ancillary services), governments and government agencies, credit card and other payment card companies, and other airlines or providers of such related services.
The Winners agree to participate in such reasonable publicity as may be requested by Emirates. The Winners agree to the publication of their respective name and country in connection with the Promotion.
If the Qualifying Entrant would like to know what Data Emirates are holding about them and/or correct the Data that Emirates hold about them they should contact their local Emirates office.
Emirates Liability
Emirates will not be liable to perform any of its obligations under these Terms where it is unable to do so as a result of circumstances beyond its reasonable control including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots or any other circumstances amounting to force majeure. Emirates accept no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for special, direct, indirect or consequential loss of any nature howsoever arising.
Emirates accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the Winner or where applicable the guest as a result of entering or participating in the Promotion or accepting the Prize. This exclusion does not include any liability for death or personal injury caused solely by the negligence of Emirates.
Participants enter the Promotion at their own risk and agree to indemnify Emirates against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors' fees) and any claim arising from a participants own actions in any way in connection with the Promotion or a breach of a participants obligations hereunder.
General
Participation in the Promotion does not confer on the entrant any rights in or over any intellectual property arising in connection with the Promotion. Any Terms which are held to be invalid in any jurisdiction shall whenever allowed by the context be deemed to be replaced by such valid and enforceable terms and conditions whose contents are as close as permissible to those of the invalid or unenforceable Terms. Emirates reserve the right to modify or vary the Promotion and/or these Terms at any time.
These Terms shall be governed by and construed in accordance with laws of Dubai, and as applicable the UAE, and the Dubai courts shall have exclusive jurisdiction in relation to any disputes arising.
Each winner and his/her guest(s) as applicable agree to comply with the terms and conditions applicable to the issue and use of tickets from time to time (as available and set out at https://tickets.rugbyworldcup.com/staticpages/termsandconditions.aspx or such other webpage as determined by Rugby World Cup Limited (“RWCL”) from time to time) and all applicable RWCL, the tournament organiser (England Rugby 2015, “ER2015”) and venue owner or operator rules and regulations relating to access to Rugby World Cup venues and any other areas associated with Rugby World Cup (including any terms of accreditation determined by RWCL). Further each winner and his/her guest(s) acknowledge that he/she may be required to enter into a direct acknowledgement and/or agreement with RWCL and/or ER2015 concerning use of the tickets and compliance with ticket terms and conditions prior to receiving the prize.
Winners and/or guests shall not, while using any Rugby World Cup tickets, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Rugby World Cup, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon any of RWCL or the Rugby World Cup. Each entrant agrees and acknowledges that any breach of this clause will cause significant damage and loss to RWCL.
The Promoter may pass personal information relating to prize winners to RWCL and/or ER2015 (and any of their service providers or agents) for the purposes of monitoring the distribution and use of Rugby World Cup tickets and related experiences and, in the event of a suspected breach of any terms and conditions, rules or regulations of RWCL and/or ER2015 relating to the use of such tickets and/or experiences, investigating and taking action against such winners.
This promotion is run by the Promoter with the permission RWCL. Accordingly the Promoter is responsible for the operation of and all matters and concerns relating to the promotion, not RWCL or any other persons involved in the staging of Rugby World Cup 2015 (including ER2015) and World Rugby (formerly the International Rugby Board), all of whom shall not be responsible for or liable to entrants in any way whatsoever in connection with this promotion.
