The associated agencies with this promotion is Rip Curl Pty Ltd (ABN 40 004 838 064) trading as Rip Curl and Flight Centre Ltd (ABN 25 003 377 188) trading as Student Flights.
1. The 'Win A Trip To Samoa Competetion' ("Promotion") will be conducted via City Beach Instagram Account: Instagram.com/citybeachaustralia
2. The Promotion will commence on Sunday 18, October 2015 at 12:01AM and ends Sunday 1, November 11:59PM ("Promotion Period"). All times are listed in Australia Eastern Standard Time.
Entry requirements
3. To be eligible to participate in the Promotion, during the Promotion Period, a person must:
a. Must be a resident within Australia;
b. If under 18 years of age, parents' consent to enter is required;
c. Have a valid Instagram account;
A person who meets the above criteria will be referred to as an "Eligible Entrant".
4. The Promoter reserves the right to refuse any person participation in the Promotion at any time in its absolute discretion
Entry into the promotion
5. To enter the Promotion, Eligible Entrants must:
a. Follow the City Beach Instagram (@citybeachaustralia) www.instagram.com/citybeachaustralia during the Promotion Period;
b. Upload a picture of you in your bikini, or what you get up to in summer to your Instagram account;
c. Add the hashtag 'mybikinicb' (#mybikinicb) and tag 'citybeachaustralia' (@citybeachaustralia) to the uploaded image.
6. At 4:00pm Thursday 5, November, 2015, the winner of the Promotion will be selected by a panel of judges as nominated by the Promoter. This is a game of skill and no chance is involved. The most creative and innovative entry, as determined by the judges in their absolute discretion will win. Judges’ decision is final and no correspondence will be entered into.
7. The winners selected and eligible entry will be deemed the winners subject to meeting Condition 3 ("Winners").
8. The Winners will be contacted via their Instagram post by a representative of the Promotor then announced on the City Beach Instagram account.
9. If the winner has not responded to the post within seven (7) days a new Winner will be selected meeting the requirements outline in Condition 6 and Condition 7
Invalid Entries
10. If an Entry is gained by means other than in accordance with these Conditions of Entry, the Entry may be deemed invalid.
11. If any Entry is illegible, incomplete, appears to have been tampered with, sows irresponsible or offensive behaviour, or is otherwise invalid in accordance with these Conditions of Entry, the Promotor reserves the right to refuse that Entry and deem it invalid.
12. If an entrants Instagram account is set to private and no entry is visible to the judges, this will be counted as an invalid entry
13. If the entrant is unable to travel overseas for any reason (criminal conviction, cannot cover excess costs, denied visa), the entry will be deemed invalid.
Prize
14. The Winner, subject to the Conditions of Entry, will receive:
a. A Hurley Pro Trestles 2016 VIP trip for two 09/09/2016 - 14/09/2016 (Dates TBC)
i. Return economy flights to Samoa for 2 people in Australia from the winners closest capital city booked through Student Flights to the approximate value of $3000 total;
ii. Transfers to and from the airport provided by Rip Curl;;
iii. Accommodation for two in a Beachfront Bungalow at the Sa’Moana Resort for seven (7) Nights provided by Rip Curl Valued at $3,500;
iv. Tropical Breakfast daily, Lunch per person daily from the A-La-carte menu ( one main per person), Dinner per person from A-La-carte menu (entr�e or dessert and one main per person) ;
The prize pool for this Promotion is valued at $7 500
15. To book flights, you will be directed to a Student Flights representative by City Beach Australia
16. To book and confirm accommodation and transfers, you will be put in contact with a Rip Curl representative by City Beach Australia.
17. Applicable taxes & travel expenses (i.e. passports, travel insurance) are the winners responsibility.
18. It is the winners responsibility to ensure that they are eligible for the appropriate visa for entry. If the winner is denied, they are deemed an invalid entry as outline in Condition 13 and a new winner will be selected as outlined in Condition 6.
19. Accommodation and Bungalow type is dependent on availability.
20. Accommodation can be extended at winner’s expense
21. Prize cannot be transferred or sold
22. Winner must use prize for stays between – 07/11/15 to 30/06/16. Cannot be used during school holiday periods
General
23. Directors, Head office management and Store Managers of the City Beach Australia are not eligible to participate in this Promotion.
24. Prizes must be taken as stated and cannot be exchanged or redeemed for alternate prizes. Any tax liability or implication which attaches to a prize is the responsibility of the Selected Winner claiming that prize.
25. The Promoter is not responsible for any loss, damage or injury suffered or claimed (including, but not limited to, indirect or consequential loss or damage, personal injury or death, and direct or indirect loss or damage) by an entrant in relation to entering or participating in this Promotion or taking or using the prizes offered except where that loss, damage or injury was caused by breach of these terms and conditions by the Promoter or the wilful or negligent acts or omissions of the Promoter.
26. Conduct of the entire Promotion, including decisions on the eligibility of persons to enter and validity of entry and prizes, shall be the responsibility of the Promoter.
27. To the extent that a situation or issue arises for which these terms and conditions make no provision or in relation to which the relevant terms and conditions are unclear, the Promoter reserves the right to make a decision regarding such situation or issue which is not inconsistent with these terms and conditions.
28. While the Promoter intends to conduct the Promotion as offered, the Promoter reserves the right to cancel or change the Promotion or a prize offered in the Promotion if it can no longer continue the Promotion or offer a prize due to circumstances outside the Promoter's control.
29. The Promoter accepts no responsibility for late or non-received entries. The Promoter does not guarantee the continuous or fault-free operation of the entry processes, including entry validating and receipting processes, during the Promotion.
30. Any entrant who tampers, or attempts to tamper, with the entry processes or tampers, or attempts to tamper with the processes used for the draws or who submits an entry which is not valid in accordance with these terms will be subject to disqualification at the discretion of the Promoter.
31. Selected Winners may be asked to participate in publicity or advertising at the request of the Promoter. Participation in any such publicity or advertising is at the sole discretion of the relevant Selected Winner.
32. Participation in the Promotion indicates acceptance of the terms and conditions governing the Promotion. These terms and conditions will be available on the City Beach Australia website www.citybeach.com.au throughout the Promotion Period.
33. By participating in this Promotion, each entrant's Entry/Entries becomes the property of the Promoter and may be used for the Promoter's business analysis and marketing purposes in accordance with the Promoter's privacy statement which can be viewed at www.citybeach.com.au. Privacy law allows entrants to access their personal information held by the Promoter in certain circumstances. Failure to supply the personal information requested may result in an Entry being deemed invalid.
34. City Beach Australia does not disclose any personal contact information provided obtained through this promotion for use by a third party unless stated or in compliance with the Australian Privacy and Spam Act legislation.
