Full Terms & Conditions Iron Jack MDF Promotion 1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid. 2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and venues/outlets associated with this promotion are ineligible to enter. This promotion is limited to venues and outlets that have been invited by the Promoter to participate ("Participating Venue" and "Participating Outlet", respectively). 3. The promotion commences at 00.01 EST on 01/08/18 and closes at 23.59 EST on 30/11/18 or while stocks of specially marked Iron Jack blocks or cases with unique codes last in Participating Outlets or while stocks of scratch cards last in Participating Venues (“Promotional Period”). How to Enter 4. There are two ways to enter this promotion, via Participating Outlets or Participating Venues. Participants who make a qualifying purchase and enter via a Participating Outlet will be eligible to win different minor prizes to those participants who make a qualifying purchase and enter via a Participating Venue. All valid entries made via Participating Outlets and Participating Venues, as outlined in Clauses 5 and 6 below will be eligible to win the same Major Prizes. 5. Via Participating Outlets - for a chance to win a Participating Outlet Instant Prize and a Major Prize, entrants must do the following within the Promotional Period: a) Purchase any specially marked promotional case (24 stubbies) or block (30 cans) of Iron Jack Full Strength Lager or Iron Jack Crisp Australian Lager to share from a Participating Outlet ("Participating Outlet Qualifying Purchase") and locate the unique code printed inside, ensuring that you collect a purchase receipt from the Participating Outlet; b) Visit www.ironjack.com.au/MDF and enter the unique code printed inside the case; c) Access and fully complete the online entry form for the promotion (including your full name, date of birth, address, email address and contact number); and d) Consent to receive marketing communications from Iron Jack and submit the online entry form by 23:59 EST on 30/11/18. 6. Via a Participating Venue - entrants must do the following within the Promotional Period: a) For a chance to win a Participating Venue Instant Prize: i. Purchase any four stubbies, schooners or pints of Iron Jack to share from a Participating Venue ("Participating Venue Qualifying Purchase") during the promotional period to receive a scratch card; and ii. Scratch the panels on the card to reveal a unique code and if you have won an instant prize. Entrants who scratch the panel and reveal three (3) of the same instant prize will win the prize indicated. Scratch cards that do not reveal three (3) of the same instant prize will not win an instant prize. Entrants must present the winning scratch card to a member of staff at the Participating Venue of purchase during the Promotional Period to redeem the minor prize. The promoter takes no responsibility for delivery of prizes to the winners. All instant Participating Venue Minor Prizes must be redeemed during the Promotional Period. b) And, for a chance to win a Major Prize: i. Once you have obtained a scratch card by following the instructions at Clause 4. a) above, visit www.ironjack.com.au/MDF and enter the unique code on any winning or non-winning scratch card; ii. Access and fully complete the online entry form for the promotion (including your full name, date of birth, address, email address and contact number); and iii. Consent to receive marketing communications from Iron Jack and submit the online entry form by 23:59 PM on 30/11/18. 7. Limit applies of one scratch card person per day and one entry into the Major Prize draw per person per day. 8. Entrants must retain a clear copy of their original receipt as proof of valid purchase during the Promotional Period. Total RRP value of all Prizes 9. Total national prize pool for this promotion = $1,743,424.80 inclusive of GST. Major Prize 10. All valid entries received via Participating Outlets and Participating Venues will be submitted into the Major Prize draw. 11. The Major Prize draw will take place at 11:00 EST on 05/12/18 at Traction Digital, Level 1, 100 Harris St, Pyrmont NSW 2009. The first three (3) valid entries drawn will receive a Major Prize. 12. There are three (3) Major Prizes available to be won as part of this promotion. The Major Prize is a fishing trip to the Northern Territory and entry into the Million Dollar Fish Competition, for the winner and three (3) guests, held in the Northern Territory, Australia (run by Tourism NT). Major Prize must be taken by 28 February 2019. Major Prize consist of: a) Return economy airfares for four (4) people from the winner's nearest Australian capital city to Darwin, including all airport and airline taxes, return private car transfers for the winner and their guests from Darwin Airport to accommodation; b) One (1) night 4-star hotel accommodation in Darwin (two twin-share rooms), to be determined by the Promoter; c) Return economy airfares for four (4) people from Darwin to Melville Island, including all airport and airline taxes, return private car transfers for the winner and their guests from Melville Island Airport to Clearwater Lodge; d) 3 nights’ accommodation at Clearwater Lodge, Lot 288 Pularumpi Rd, Pularumpi NT 0822 (two twin-share rooms); e) All meals on Melville Island (breakfast, lunch and dinner); f) Two full days fishing for four (4) people, including; i. Total RRP of Major Prizes = $67,815.00 (inclusive of GST). 13. Major Prize winners will be notified by telephone and email within two (2) days of the Major Prize draw. Major Prize winners must confirm acceptance of Major Prize via return email by 5:30pm EST 12/12/18. 14. Travel is encouraged to be taken between the NT Million Dollar Fish Season 4 dates (i.e., 01/10/2018 – 31/03/2019). The NT Million Dollar Fish Season 4, participating dates are 01/10/2018 – 31/03/2019. Prize winners may enter NT Million Dollar Fish if they so wish. There are no fees involved to register. Unless otherwise stated in these terms and conditions, all other ancillary costs including but not limited to insurance, taxes (excluding GST), meals, drinks, transfers and any and all other expenses as a consequence of receiving a Major Prize are the responsibility of the Major Prize winner. 16. The name and suburb of each Major Prize winner will be published on www.ironjack.com.au and in the Australian newspaper on 19/12/18. Participating Outlet Minor Prize 17. Only participants who enter via a Participating Outlet are eligible to win a Participating Outlet Minor Prize. 18. The Participating Outlet Minor Prize consists of one (1) Iron Jack fishing shirt (RRP $43.95 inclusive of GST). Total RRP of Participating Outlet Minor Prizes = $63,109.80 inclusive of GST. 19. There are twelve (12) Participating Outlet Minor Prizes to be won each day of the Promotional Period. There are 1176 Participating Outlet Minor Prizes available to be won across this promotion from Participating Outlets only. 20. A Participating Outlet Minor Prize draw will take place hourly on each day of the Promotional Period between 11.00 EST and 23:59 EST (each a "Participating Outlet Minor Prize Draw"). Twelve Participating Outlet Minor Prize Draws will take place each day of the Promotional Period. Each Participating Outlet Minor Prize Draw will take place at Traction Digital, Level 1, 100 Harris St, Pyrmont NSW 2009. 21. Participating Outlet Minor Prize winner's will be notified of their win within two (2) days of each Participating Outlet Minor Prize Draw by telephone and email. Minor prizes will be delivered to winners within 28 days of each Participating Outlet Minor Prize Draw, subject to any processing or delivery delays. Winners will be notified of any delay. Sizing is limited and subject to availability. Winners may not be able to receive the size of their preference. Participating Venue Minor Prize 22. Only participants who enter via a Participating Venue are eligible to win a Participating Venue Minor Prize. 23. Participating Venue Minor Prize consists of one (1) of the following: a) One (1) Iron Jack Hat (RRP $21.95 inclusive of GST); b) One (1) Iron Jack Shirt (RRP $43.95 inclusive of GST); c) One (1) Iron Jack Stubby Cooler (RRP $6.55 inclusive of GST). 24. There are thirty (30) Participating Venue Minor Prizes available to be won at each Participating Venue: ten (10) Iron Jack Hats, five (5) Iron Jack Shirts and fifteen (15) Iron Jack Stubby Coolers. Total RRP value of Participating Venue Minor Prizes at each Participating Venue is $542.50 inclusive of GST. Total value of all Participating Venue Minor Prize in this Promotion = $1,612,500 inclusive of GST. Unless otherwise stated in these terms and conditions, all other ancillary costs including but not limited to insurance, taxes (excluding GST), meals, drinks, transfers and any and all other expenses as a consequence of receiving a Participating Venue Minor Prize are the responsibility of the Participating Venue Minor Prize winner. 25. The maximum total number of scratch cards to be randomly distributed across venues for this promotion is 360,000. Each scratch card has a 1 in 4 chance of winning an instant prize. 26. All Participating Venue Minor Prizes from the advertised total prize pool will be distributed during, or after the completion of the Promotional Period. Any unclaimed Participating Venue Minor Prizes remaining at the close of the Promotional Period will be distributed by the Promoter in its sole discretion, including, e.g., for example, to any person who purchases a schooner of Iron Jack at a Participating Venue. 27. All valid claims for Participating Venue Minor Prizes and entitlements made during and at the end of the Promotional Period will be met notwithstanding that the advertised prize pool has been exceeded. Printing errors or other quality control matters outside the control of the individual entrants will not be used as the sole basis for refusing to award a Participating Venue Minor Prize. All instant Participating Venue Minor Prizes must be redeemed during the Promotional Period. Major Prize Special Conditions 28. Major Prize winners and their guests must be at least 18 years of age and residents of Australia in order to attend Major Prize. Major Prize winners are to reference https://www.milliondollarfish.com.au/terms-conditions/ for entry requirements into the Million Dollar Fish competition. 29. Each Major Prize is a single event trip for the winner and their guests and cannot be separated into separate trips or components. The Major Prize winner and their guest must depart from and return to the same departure point and travel together. 30. It is a condition of accepting the Major Prize that the winner and their travel guest arrange at their own expense valid travel insurance with the highest available coverage for their period of travel. Major Prize winner's and their guest may be required to provide evidence of valid travel insurance with the highest available coverage for their period of travel. The Major Prize winners and the travel guests are also solely responsible for ensuring that they have any necessary travel documentation. 31. As a condition of accepting a Major Prize, Major Prize winners and their guests may be required to sign additional legal documentation as required by the Promoter and/or Third-Party Suppliers, including but not limited to a legal release and indemnity form. 32. Major Prize winners and their guests may also be required to provide a credit card imprint at check-in to the accommodation that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property. 33. All travel is subject to availability at all times, and dependent on, select seating class with airlines, and/or specific room category availability with accommodation partner. Travel is required to be taken between the NT Million Dollar Fish Season 4 dates 1 October 2018 – 31 March 2019. Block out periods apply, including all Public Holidays and other special event periods (for example: Christmas and New Year). All bookings must be made a minimum of 14 days in advance of requested departure dates. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays (ABN 96 101 233 569) or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays (ABN 96 101 233 569) and the airline carriers in accordance with normal travel practices. Major Prize winner and their guests are responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. 34. The NT Million Dollar Fish Season 4, participating dates are 1 October 2018 – 31 March 2019. Major Prize winners and their guests may enter NT Million Dollar Fish if they so wish. Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into. 36. If any Major Prize remains unclaimed in accordance with Clause 13 or a Major Prize or Participating Outlet Minor Prize is otherwise forfeited, despite the Promoter making all reasonable efforts to notify a winner or because a winning entry does not comply with these terms and conditions, the Promoter may deem any winner as ineligible to receive the respective prize. 37. A draw for unclaimed or otherwise forfeited Major Prizes or Participating Outlet Minor Prizes will take place on 13 December 2018 at the same time and place as the Major Prize draw, subject to any directions from a regulatory authority. Second chance draw winners will be notified by telephone and email within two (2) days of the second chance draw and winners published on www.ironjack.com.au and in the Australian on 19 December 2018. 38. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the promotion whether as a result of: a) technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or b) acts or omissions (including negligent acts of omissions) of the Promoter's servants or agents involved in the conduct of this promotion. In the event of such problems or conduct, the Promoter may (subject to relevant state and territory lottery regulations and where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. 39. If any prize or any element of a prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value. 40. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may (where necessary with approval from the relevant lottery authority) modify, cancel, terminate or suspend the promotion. 41. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 42. The Prize is subject to the terms and conditions of third party prize suppliers, including any other third party prize suppliers ("Third Party Prize Suppliers"). The Promoter is not responsible or liable for any loss, damage or injury suffered by the winner or their guests as a result of the conduct of any Third Party Prize Suppliers or otherwise as a result of the winner and their guests accepting and/or using a prize, except for any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law, including the Non-Excludable Guarantees. 43. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the Code of Practice for Responsible Service of Alcohol and responsible service of alcohol.
