TERMS AND CONDITIONS
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The promoter is Beam Suntory Australia Pty Ltd (ABN 85 003 953 357) of Level 18, 100 Pacific Highway, North Sydney, NSW 2060, telephone (02) 8977 9700 ("Promoter").
Entry is only open to South Australian residents aged 21 years or over and Australian residents (excluding residents of SA) aged 18 years or over.
Employees (and their immediate families) of the Promoter, participating Bottlemart or Sip'n'Save stores, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
Promotion commences for purchases on 01/06/2016 and ends for purchases at close of business on 28/06/2016 ("Purchase Period"). Entries open on 01/06/2016 and close at 11:59pm AEST on 05/07/2016 ("Entry Period").
To enter, individuals must complete the following steps:
spend $15.00 (incl. GST) or more in a single transaction on Jim Beam product(s) at a participating Bottlemart or Sip'n'Save store during the Purchase Period ("Qualifying Transaction"). Participating Bottlemart and Sip'n'Save stores will be any store displaying material advertising this promotion during the Purchase Period. If in doubt, an entrant may ask staff at an outlet whether or not they are participating in the promotion. Eligible Transactions are for off-premise consumption only;
tear off a promotional leaflet from the A6 promotional leaflet pad in store or request a promotional leaflet from the sales staff at time of purchase, while stocks of promotional leaflets last. Each promotional leaflet will feature a unique code ("Unique Code") which will need to be inserted when promoted in accordance with clause 6(c) below; and then
visit either bottlemart.com.au/jim-beam-bourbon-legends (if the Qualifying Transaction was made at a participating Bottlemart store) or www.sipnsave.com.au/jim-beam-bourbon-legends (if the Qualifying Transaction was made at a participating Sip'n'Save store), follow the prompts to the promotion entry page, input the requested details (including their full name, address, telephone number, age, a valid email address, and their Unique Code, agree to the Terms and Conditions and the Promoter's Privacy Policy by ticking the relevant tick box, and submit the fully completed entry form so it is received during the Entry Period.
Incomplete or indecipherable entries and incorrect Unique Codes will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the entrant.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction/receipt and Unique Code (regardless of the amount spent on Jim Beam product(s) in excess of $15.00 (incl. GST) in that transaction); (b) each entry must be submitted separately and in accordance with entry requirements; (c) Unique Codes can only be used once; and (d) a limit of one (1) prize per person (excluding SA residents).
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, that at least $15.00 (incl. GST) was spent on Jim Beam product(s) and that the purchase was made during the Purchase Period but prior to entry.
Entrants can only enter the promotion in their own name. Entrants who enter using multiple aliases (i.e. multiple names, addresses and/or email addresses) will be disqualified.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If requested by the Promoter, entrants must produce, within the time requested by the Promoter at its absolute discretion:
appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize, and compliance with these Terms and Conditions; and
their proof of purchase that corresponds to all entries they have submitted in the promotion.
If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the entrant will be deemed as invalid. A prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004 at 4:00pm AEST on 12/07/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winners will be notified by email within two (2) business days of the draw and their names will be published online at bottlemart.com.au/jim-beam-bourbon-legends and www.sipnsave.com.au/jim-beam-bourbon-legends from 19/07/2016.
The Promoter's decision is final and no correspondence will be entered into.
The first valid entry drawn will win a trip for the winner and two (2) companions (with one (1) companion aged at least 18 years or over and one (1) companion aged at least 21 years or over) to New York and Kentucky (USA), valued at up to AU$32,134.72 depending on date and point of departure ("Major Prize"). Major Prize includes:
economy airfares from winner's nearest Australian capital city to New York City, New York for three (3) adults;
return transfers from the airport to the accommodation in New York City for three (3) adults;
three (3) nights twin share accommodation in a minimum 4-star hotel in New York City for three (3) adults, including daily hotel breakfast on a set menu (exact hotel determined by the Promoter in its absolute discretion);
Private Drinking Establishment Tour in New York City for three (3) adults;
economy airfares from New York City to Louisville, Kentucky for three (3) adults;
return transfers from the airport to the accommodation in Louisville for three (3) adults;
one (1) night twin share accommodation in a minimum 4-star hotel in Louisville for three (3) adults, including daily hotel breakfast on a set menu (exact hotel determined by the Promoter in its absolute discretion);
return transfers from Louisville to Bardstown, Kentucky for three (3) adults;
two (2) nights twin share accommodation at Colonel's Cottage in Bardstown for three (3) adults, including daily hotel breakfast on a set menu (exact hotel determined by the Promoter in its absolute discretion);
Exclusive VIP Tour of Jim Beam American Stillhouse for three (3) adults;
Exclusive VIP Tour of Marker's Mark Distillery for three (3) adults;
return transfers from accommodation to tours in Kentucky for three (3) adults;
economy airfares from Louisville to the winner's nearest Australian capital city to for three (3) adults;
AU$1,500 spending money for the winner, awarded via an electronic funds transfer into an account in the winner's name.
The following conditions apply to the Major Prize: At least one (1) of the winner's travel companions must be aged 21 years or older. In the event that the winner is under 21 years or age, the winner will be able to attend the distillery tours included in the prize but due to drinking age restrictions in the USA, will not be able to participate in any alcohol tastings or any activity involving alcohol. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 12/07/2017 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods. Once the prize is booked no changes can be made. Prize participants are responsible for compliance with any health, passport, visa and other requirements for entry into the USA, any country en-route and for return to Australia. The winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. Prize participants are responsible for making themselves familiar with, and following, the Australian Government's travel advisory and consular assistance advice available at smarttraveler.gov.au.
The next ten (10) valid entries drawn will each win the following prize pack, valued at AU$1,020.80 ("Minor Prize"):
- GoPro HERO4 Black Edition;
- GoPro 3-Way Grip/Extension/Tripod;
- SanDisk Extreme Pro 64GB Memory Card; and
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to AU$42,342.72.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. The prizes cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a prize is obtained through any of these methods, it will not be honoured.
If any prize(s) remain unclaimed by 3:00pm AEST on 12/10/2016, a re-draw will take place on at 4:00pm AEST on 12/10/2016 at the same place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the re-draw and their names will be published online at bottlemart.com.au/jim-beam-bourbon-legends and www.sipnsave.com.au/jim-beam-bourbon-legends from 19/10/2016.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional websites are the entrant's responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
