TERMS AND CONDITIONS
1. Information on how to enter, the collection of personal information and prize forms part of these
conditions of entry. Entry into the competition constitutes acceptance of these terms and conditions.
2. The competition is promoted by Manpower Services (Australia) Pty Ltd t/as Defence Force Recruiting
(ABN 15 071 884 994), 10 Richmond Avenue, Canberra Airport, ACT 2609 (‘Promoter’).
3. Entry is open to only Australian residents aged between 16 and 22 years who have a genuine interest in
joining the ADF through ADFA (‘Eligible Entrants’). Eligible Entrants aged less than 18 years old, must have
parental or guardian approval to enter and further, the parent or guardian of the Eligible Entrant must
read and consent to these Terms and Conditions. Parents or guardians may be required by the Promoter
to enter into a further agreement as evidence of consent to the minor entering this competition. Eligible

9. The three (3) Winners, as determined by the judges, will each win a trip, with one (1) parent or guardian
(if under 18 years old), to Canberra, ACT, to attend the ADFA Open Day, valued up to $3,000 depending
on point of departure. Each Prize includes:
a. Return economy airfares for each Winner with one (1) parent or guardian to Canberra, ACT (if
required);
b. Return transfers from the Winner’s residence to the departure airport (if required);
c. Return transfers from the airport to the accommodation (if required);
d. Two (2) nights 4-star accommodation at Vibe Hotel Canberra Airport including breakfast;
e. One (1) lunch per Winner and guardian (if required);
f. One (1) dinner with Trainee Cadet Officers at a restaurant chosen by the Promoter;
g. One (1) ADFA merchandise pack (contents of the pack will be determined by the Promoter in its
absolute discretion); and
h. A full two (2) day ADFA Open Day experience with an ADFA cadet escort which may include, but
is not limited to, the following activities (subject to change due to unavailability, weather
conditions or other reasons beyond the Promoter’s control):
i. Personal tour of ADFA
ii. Helicopter flight
iii. Weapons Training Simulation System shoot
iv. Over water obstacle course
v. Roulettes aerial display
vi. Enemy view of section attack demonstration
10. Spending money, meals (other than as mentioned above), in-room charges and any other ancillary costs
are not included. The Prize must be taken to coincide with the ADFA Open Day experience event, with
flights departing on 23/08/2018 and being subject to booking and flight availability.
11. If any Winner is under 18 years of age, they must be accompanied by a parent or guardian. The parents
or guardian acknowledges that they may in some instances be required to only observe the Winner
perform certain elements of the ADFA Open Day experience, and may not be able to participate.
12. The Winners and their parent or guardian (if required) must depart from and return to the same
departure point and travel together. Itinerary is to be determined by the Promoter in its absolute
discretion. Frequent flyer points will not form part of the Prize. The Prize is subject to the standard terms
and conditions of individual prize and service providers. The Winners may be required to present their
credit card at time of accommodation check in. If a Winner is from the ACT or within 100 kilometres from
the ACT border, then the Prize does not include airfares or transfers and these components of the Prize
will not be redeemable for cash.
13. The next ten (10) best valid entries, as determined by the judges, will each win an ADFA merchandise
pack. Exact contents of the pack will be determined by the Promoter in its absolute discretion.
14. If for any reason a Winner does not take a Prize by the time stipulated by the Promoter, then the Prize
will be forfeited and will not be redeemable for cash.
15. If any Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a
prize to the equal value and/or specification.
16. Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
17. Each Eligible Entrant warrants that their entry is an original literary work of the Eligible Entrant that does
not infringe the rights of any third party. An Eligible Entrant will be automatically disqualified from the
Promotion and become ineligible to claim a prize in circumstances where other source material or
intellectual property belonging to another is used in answering the questions. As a condition of entering
this competition, each Eligible Entrant licenses and grants the Promoter, its affiliates and sub-licensees a
non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable right to use, broadcast,
reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to
future promotional, marketing or publicity purposes, in any media, without compensation, restriction on
use or liability and without notice.
18. Furthermore, Eligible Entrants consent to:
a. conduct, which would constitute an infringement of their moral rights as defined in section 189
of the Copyright Act 1968 (Cth); and
b. the Promoter using their name, likeness, image and/or voice, including photograph, film and/or
recording of the same (‘the Eligible Entrant Material’) in any media, including on any social media
platform, for an unlimited period without remuneration for the purpose of promoting this
competition (including any future competitions), and promoting any product associated with,
manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant releases the
Promoter from all liability whatsoever related to the use of the Eligible Entrant Material in any
media including any social media platform. The Promoter, its sponsors and partners may use the
Eligible Entrant Material in any form, in whole or in part, and in any medium including in print, on
the internet or other multi-media uses.
19. Incomplete, indecipherable or ineligible entries will be deemed invalid. The Promoter reserves the right
to verify the validity of entries and entrants (including the entrant’s identity, age and address) and to
disqualify any entrant who submits an entry that is not in accordance with or breaches these conditions
of entry, who tampers with the entry process or who submits an entry that the Promoter, in its sole
discretion deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of
the competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights. The Promoter reserves its legal rights to recover damages and/or other
compensation from a person whom is in breach of these conditions of entry or whom engages in any
unlawful or improper conduct calculated to jeopardise the fair and proper conduct of the competition.
20. If the competition is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the
right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions
from a regulatory authority, to modify, suspend, terminate or cancel the competition as appropriate.
21. Each Eligible Entrant represents and warrants to the Promoter that neither the entry (nor its submission)
nor the photographs provided or arranged by the entrants will breach any law or regulation or the rights
of any third party (including any privacy or intellectual property law).
22. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify
the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as
well as any other implied warranties under the Australian Securities and Investments Commission Act
2001 (Cth) or similar consumer protection laws in the various States and Territories of Australia (“NonExcludable
Guarantees”). Except for any liability that cannot by law be excluded, including the NonExcludable
Guarantees, the Promoter (including its respective officers, employees and agents) excludes
all liability for any personal injury or any loss or damage (including loss of opportunity) whether direct,
indirect, special or consequential, arising in any way out of the competition. The exclusions under this
clause 23 do not extend to any negligent acts or omissions of the Promoters (including its respective
officers, employees and agents).
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) is not responsible for, and excludes all
liability for, any personal injury or any loss or damage (including loss of opportunity) whether direct,
indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment
malfunction; (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim
that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter)
due to any reason beyond the control of the Promoter; (d) any variation in prize value to that stated in
these Terms and Conditions; (e) if the competition is cancelled or postponed for reasons beyond the
control of the Promoter, (f) any tax liability incurred by a Winner or Eligible Entrant or (g) any use of a
Prize. The exclusions under this clause 24 do not extend to any negligent acts or omissions of the
Promoters (including its respective officers, employees and agents).
25. The Promoter collects personal information (‘PI’) in order to conduct the promotion and may, for this
purpose, disclose such PI to third parties, including but not limited to agents, contractors, and service
providers for the purposes of the promotion and/or future promotions. Entry is conditional on providing
this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed by
following the prompts at http://www.defencejobs.gov.au/global/copyrightandprivacy.aspx. In addition
to any use that may be outlined in the Promoter’s Privacy Policy, if the Eligible Entrant opts in at the time
of entry, the Promoter may, for an indefinite period, use the PI for promotional, marketing, publicity,
research and profiling purposes, including sending electronic messages or telephoning the Eligible
Entrant. The Privacy Policy also contains information about how Eligible Entrants may opt-out, access,
update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy
Principles, or any other applicable law, and how those complaints will be dealt with. All entries become
the property of the Promoter. The Promoter will not disclose Eligible Entrant’s PI to any entity outside of
Australia.
26. Winners (and their parents or legal guardian, where applicable) acknowledge that the Prize may include
activities that may result in personal injury, and participate at their own risk. The Winners (and their
parent or legal guardian, where applicable) acknowledge that they are able to opt out of any element of
the Prize at any stage. The Winners (and their parent or guardian, where applicable) must: (a) attend,
undergo and pass any appropriate briefings, required medical tests and other requirements of the
Promoter needed to be completed before completing certain Prize related activities; (b) advise the
Promoter of any medical conditions that would make it dangerous to participate in certain Prize related
activities; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the
Promoter; and (e) wear all safety and other equipment required. The Promoter in their absolute
discretion, at all times reserve the right to: (a) prevent any Winners (and their parent or guardian, where
applicable) from participating in a Prize related activity if, at any time, they reasonably believe that the
Winner (or their parent or guardian where applicable) poses a safety risk or for any other reason; or (b)
cancel the Prize related activity if the conditions are deemed dangerous.
27. This competition, and the conduct thereof, is governed by the laws of the Australia.
