Vitamix Game of Skill Competition Terms and Conditions for Facebook
This game of skill competition is conducted by Vita-Mix ANZ PTY Limited hereafter referred to as the Promotor.
Entry to the Competition constitutes acceptance of these terms and conditions.
ELIGABLE ENTRANTS
The Competition is only open to Eligible Entrants.
An "Eligible Entrant" is an individual who, at the time of entry:
1. is a resident of Australia aged over 18 years; 2. is not an employee of the Promoter or any of its related corporations or any of their agencies
associated with the Competition; and 3. is not a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by
adoption) of such an employee.
ENTRY CONDITIONS
Competition entry opens at time and date specified, and closes at time and date specified ("Entry Period"). All times and dates are times and dates in Sydney, Australia.

To enter, an Eligible Entrant must have a current Facebook account and follow the entry instructions in these conditions.
To enter the competition via Facebook, an entrant must:
1. follow @VitamixAUNZ on Facebook during the Entry Period; 2. like the Vitamix Facebook post that references this competition (“Facebook Post”); 3. answer the question or statement made in the Facebook post from Vitamix AU NZ.
There is a Limit of one (1) entry per person by completing all three (3) steps mentioned above.
Eligible Entrants will need to ensure their account’s privacy post settings are set to ‘public’ otherwise the entry cannot be counted.
The winner will be announced via a post on the Vitamix Facebook accounts account and notified via direct message on Facebook. The winner will be announced within thirty (30) working days of the conclusion of the competition.
From the Eligible Entrant’s one (1) winner will be selected and will win a Vitamix Ascent Series A2300I
This is a game of skill in determining the winners. Chance plays no part in determining the winner. The winner will be selected based on the originality and creativity of their entry.
An Eligible Entrant must ensure that their entries are posted online during the Entry Period. All Eligible Entrant must follow @VitamixAUNZ in their post.
The Promoter takes no responsibility for any late entries or for any delays or failures in any telecommunications service or equipment.
Eligible Entrants must abide by the Community Guidelines of Facebook.
PRIZES
The prize will be a Vitamix Ascent Series A2300I valued at $895.
Prizes are non-transferable, with no cash redemptions, equivalents or substitutions except at Promotor’s sole and absolute discretion.
All Prize details not specified in these terms and conditions will be determined in Promotor’s sole and absolute discretion.
Prize details and availability are subject to change and are subject to prize provider’s restrictions, and in the event that Promotor is unable to provide the Winner with part or all of their prize, the Promotor may elect to provide the Winner with the approximate value of such item in cash or award an alternate prize of comparable or greater value.
FACEBOOK
The Competition is in no way sponsored, endorsed, administered by, or associated with, Facebook.
By entering the Competition, each entrant releases Facebook from any and all liability to the entrant arising in any way from the conduct of the Competition.
All information provided by a Promotion entrant is provided to the Promoter and not to Facebook.
ODDS
The Odds of winning will depend upon the total number of eligible entries received.
PUBLICITY
Subject to applicable law, Winner(s) irrevocably grant to the Promotor and its licensees, successors, assigns and sub-licensees, the right and permission to use their name, voice, likeness, biographical material, and/or entry for advertising, promotional and/or publicity purposes in connection with the competition, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the Prize(s) to the Winner(s).
LIABILITY LIMITATION
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non- Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
PRIVACY
The information you are asked to provide in this game of skill may be personal information and is protected by the Privacy Act 1988. The Promoter will not disclose this information to other parties other than in accordance with the Privacy Act 1988.
UNCLAIMED PRIZE
The Promoter will take all reasonable steps to identify and notify the Winner to ensure they receive a Prize. However, if the Winner cannot be identified or does not claim the Prize within three months of the date on which the winners are determined, their Prize is forfeited and will be awarded to the next best entry.
COSTS
Any cost associated with accessing the promotional website(s) is the entrant’s responsibility and is dependent on the Internet service provider used.
LAWS
The laws of the commonwealth of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of NSW.
