You’ll get to spend 6 glorious days on the Gold Coast, where your flights and accommodation, as well as your food, the cost of getting around the place, and a week’s pay is all covered. Not bad, eh?
To enter, all you gotta do is follow the steps below.
PEDESTRIAN.TV PRESENTS GOLD COAST TRAVEL EDITOR ROLE (“Competition”)
1. The promoter is Pedestrian Group Pty Limited ACN 112 839 568 of Level 5, 60-64 Reservoir Street, Surry Hills NSW 2010 (“Promoter”).
2. By entering this Competition, entrants agree to be bound by these Terms and Conditions. Information on how to enter and prize form part of these Terms and Conditions. All times are Australian Eastern Daylight Savings Time (AEDST) unless otherwise advised.
3. Entry is open to Australian residents aged 18 years and over. Entrants must not have a criminal record. Employees of Promoter and the suppliers and agencies associated with this Competition, and the immediate family of all such employees are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Competition starts at 10:00 hours on 9 January 2018 and ends at 11:59 hours on 28 February 2018 (“Promotional Period”). This Competition will be conducted during the Promotional Period. Entries must be received by the Promoter during the Promotional Period. Entries received after the Promotional Period will not count towards the Competition.
5. To enter, individuals must during the Promotional Period, undertake the following steps:
· Visit the https://gleam.io/5hJHP/win-the-all-inclusive-pedestrian-travel-editorship-role-based-in-gold-coast;
· Locate the promotional editorial and follow the prompts to the competition entry page;
· Input the requested details and either
a) Upload a 60 second video outlining why they deserve the Pedestrian Gold Coast Travel Editor role (“Video”); or
b) Upload their CV (resume) and answer the question “What You Could Bring To The Pedestrian Team And Why in 25 words or less (in the space provided); and then
· Submit the fully completed online entry form.
6. Only one (1) entry is permitted per person per email/mailing address.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
8. Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10. The judging will take place at the Promoter’s office from 11:00 hours on 2 March 2018. The judges may select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the answer to the promotional question provided. The Promoter may also consider an entrant’s resume (and their suitability to the role) if one is provided at the time of entry. The winner will be notified in writing by email and the winner must claim the prize as per the instructions provided by no later than 9 March 2018.
PRIZE PACKAGE:
11. The best valid entry, as determined by the judges will win the prize of a seven (7) day paid travel editor role, working from a Gold Coast location (to be determined by the Promoter in its absolute discretion) valued at up to $10,000 AUD Prize includes:
· Payment of $1200 AUD for completion of seven (7) days work during the taking of the prize (see Clause 14 below for further details);
· Return economy class airfares from the winner’s nearest Australian capital City to Gold Coast, QLD (only provided if the winner resides outside of QLD). If the winner resides within QLD however outside of the Gold Coast, the Promoter may in its absolute discretion award the winner regional flights (if available depending on the winner’s location) or a Visa Pre Paid Card to be used towards travel costs with getting to and from the Gold Coast.
· Six (6) nights minimum 4 Star single room accommodation on the Gold Coast in QLD;
· Return hotel to airport transfers as well as additional transfers as required to undertake employment tasks; and
· Breakfast, lunch and dinner up to the value of $110 AUD per day
12. The winner acknowledges that by taking the prize they will need to complete a number of employment tasks on behalf of the Promoter. The winner will be required to sign an agreement outlining their responsibilities and accept the terms of engagement prior to accepting the Gold Coast Travel Editor Role. The winner also acknowledges that they license and grant the Promoter, Gold Coast Tourism Corporation and their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display any work produced (including but not limited to work completed and/or images taken during the prize) whilst under their employment for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without additional compensation, restriction on use, attribution or liability.
13. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken between 8 March 2018 and 26 March 2018, with the exact dates to be determined by the Promoter in its absolute discretion and is subject to booking and flight availability. The Promoter will notify the winner of the exact dates of travel once the winner has been selected and notified. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in. Travel is subject to the standard terms and conditions of individual prize and service providers.
14. Prize includes a seven (7) day paid travel editor role, with the Promoter with payment of $1200 AUD. Hours of work will be determined upon employment (up to a maximum of 38 hours) over 7 days. Unless otherwise indicated by the Promoter, the winner will be required to attend activities on the Gold Coast, QLD. Any expenses incurred during the performance of the role during the scheduled activities will be negotiated with the winner and outlined in the winner’s letter of engagement. The responsibilities under the winner’s letter of engagement will include but are not limited to:
Assisting and leading social content curation
Assisting and capturing content for editorial purposes
Exact schedule of activities will be determined by the Promoter in its absolute discretion. The Promoter reserves the right to negotiate changes to the terms outlined herein with the winner once he/she is selected, however, is under no obligation to do so. Full terms of engagement including payment rates will be outlined in the winner’s letter of engagement offered to the winner once he/she is selected. The Promoter makes no representations or guarantees regarding future employment beyond the engagement offered herein.
15. If the winner is unable to comply with these Terms and Conditions and/or does not claim the prize by the time indicated by the Promoter, the Promoter reserves the right to award the prize to the next best valid entry in accordance with clause 11 above.
16. Prize is subject to the standard terms and conditions of individual prize and service providers.
17. The Promoter’s decision is final and no correspondence will be entered into.
18. The Prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash.
19. The value of the prize is correct as at the start of the Competition.
20. If the prize becomes unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the prize with a prize of equal or greater value and/or specification .
YOUR INFORMATION:
21. Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to Videos, comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(b) their Content shall not contain viruses or cause injury or harm to any person or entity;
(c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
(d) the Content is the original artistic/literary work of the entrant that does not infringe the rights of any third party;
(e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
22. As a condition of entering this Competition, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
23. The Promoter collects personal information ("PI") in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.pedestrian.tv. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
24. The Promoter may also disclose PI to Gold Coast Tourism Corporation (ABN 75 009 935 184), who may use the information for their own marketing purposes. For details on how PI will be handled by Gold Coast Tourism Corporation, entrants should view their privacy policy, which is available at https://www.destinationgoldcoast.com/dgc-privacy.
RISK AND LIABILITY:
25. The winner participates in this Competition, and uses the prize, at his or her own risk.
26. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize and/or participation in the prize.
29. The laws of Australia apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
30. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
31. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the Competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
