2. Instructions on how to enter and other details contained within promotional, electronic and print materials form part of the terms and conditions. By participating in this competition entrants shall be deemed to agree to abide by these terms and conditions. These terms and conditions prevail to the extent of any inconsistency with the terms and conditions set out in any such materials.
3. To be eligible to enter (?Eligible Entrant?), you must: a. be an Australian resident; b. be 18 years of age or over; and c. not be an employee (or an immediate family member of an employee) of Kleenheat Gas, its agencies or any organisation associated with the promotion. For the purposes of the promotion, ?immediate family member? includes spouse, de facto spouse, parent, and natural, adopted or step child or sibling, whether or not they live in the same household as the employee. You do not have to be a current Kleenheat Gas customer to participate in the competition, but, if you are not already a Kleenheat customer, you must become an LPG or natural gas customer of Kleenheat Gas in order to redeem a prize.

We may (in our absolute discretion): a. verify entrant?s identity, age and the validity of entry; b. disqualify entrants who submit an entry that is not in accordance with these terms or who tampers with the entry process; c. disqualify entrants who enter using multiple aliases; d. accept or reject entries that contain errors or omissions; and e. deem incomplete, plagiarised, defamatory or indecipherable entries invalid.
5. The competition commences at 11:00am (AEST) on 22/04/14 and concludes at 01:59am (AEST) on 04/08/2014 (?Entry Period?). Entering 6. To enter the competition, an Eligible Entrant must: a. Capture a photo or choose from photos you have already taken that you think answers the question, ?What do you love about winter?? b. Logon to the URL of the promotional website: www.lovewinter.kleenheat.com.au and complete the online Entry Form at any time within the Entry Period, with your full name, contact number and email address. c. Upload the photo and enter a description in no more than 25 words that answers the question, ?What do you love about winter??
7. You must own the photograph used in your entry and own or control the rights to the subject matter. By submitting the photo, you consent to Kleenheat Gas using, reproducing or publishing the photo for the purposes of the competition.
8. Entries must be received during the Entry Period.
9. When your photo is successfully entered for the competition, it will be uploaded to the Kleenheat Gas promotional website for review and approval by Kleenheat Gas. You will receive an email. Your entry is not valid unless Kleenheat Gas has approved your image.
10. Multiple entries are allowed but each entry must be a unique submission.
11. Upon receipt, entries become the property of Kleenheat Gas. Prizes 12. There is a prize (?Minor Prize?) to win each week for fifteen (15) weeks.
13. Each Minor Prize comprises, at the Minor Prize winner?s election, either: a. 12 months? supply of 45kg LPG vapour cylinders; or b. 12 months? supply of natural gas on a Standard Form Contract with Kleenheat Gas (only available to Eligible Entrants who reside in Western Australia), at the Minor Prize winner?s residential address, up to the maximum value of $1,000 (inclusive of GST). Please note: ? For Minor Prize winners who elect to take up the LPG option, the Minor Prize also includes a 12 month no rental (no facility fee) deferral for 45kg LPG vapour cylinder/s. An installation/connection fee may apply to LPG customers with dwellings not already on LPG and this cost is not included in the Minor Prize. ? For Minor Prize winners who elect to take up the natural gas option and who are not already connected to natural gas, the Minor Prize does not include the cost of extending the gas mains to your home, meter installation or costs of engaging a gasfitter. ? Minor Prizes only extend to supply of LPG or natural gas for ordinary household or domestic use at the Minor Prize winner?s residential address, and excludes commercial or industrial applications or resupply to other persons or premises.
14. Minor Prize winners must become a Kleenheat LPG or natural gas customer or be an existing customer to redeem the prize. (Note: Natural gas option only available to Eligible Entrants who reside in Western Australia.)
15. All entries received during the Entry Period will go into the draw to win 12 months? worth of their household utility bills paid in full for the residential address at which the winner resides (?Major Prize?), up to the maximum value of $20,000 (inclusive of GST). There is only one (1) Major Prize to win, and Kleenheat Gas accepts no responsibility for any variation in the value of the Major Prize arising from the Major Prize winner?s individual circumstances.
16. The Major Prize winner must become a Kleenheat LPG or natural gas customer or be an existing customer to redeem the prize. (Note: Natural gas option only available to Eligible Entrants who reside in Western Australia.)
17. The household utility bills covered by the Major Prize are water, electricity, land-line telephone, cable or satellite television service and internet service at the Major Prize winner?s residential address. 18. Payments will be made directly to the Major Prize winner?s billing retailer. The Major Prize winner must present a copy of their household utility bills within 14 days of issue for payment. The 12 month period will commence on the date on which the Major Prize winner responds to Kleenheat Gas claiming the prize. Kleenheat Gas will pay eligible household utility bills received by the Major Prize winner during that 12 month period, excluding any balance brought forward from earlier bills, overdue amount(s) or fines, or prepayments. 19. The total maximum prize pool is $35,000 (inclusive of GST), comprising fifteen (15) Minor Prizes with a maximum value of $15,000 (inclusive of GST) in aggregate, and one (1) Major Prize with a maximum value of $20,000 (inclusive of GST).
20. Prizes must be taken as offered and are not transferable or exchangeable and cannot be taken as cash. If a prize is not available, we may (in our absolute discretion) substitute the prize for another item of equal or higher value as determined by us (in our absolute discretion).
21. If, for any reason, the winner is not able to participate in or accept any part of a prize or the winner does not take the prize at the time stipulated by the promoter, the prize will be forfeited. 22. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize. Selecting a winner 23. 24. The Minor Prize competition is based on a game of skill. The winners will be selected from the pool of eligible entries which comply with these terms and demonstrate the most interesting, original and creative commentary (as determined by us in our absolute discretion).
25. You may submit as many entries as you like but every Entrant in the competition is only eligible to win one Minor Prize.
26. Minor prize winners will be notified via phone or email, and the winner?s details will be published on the website by 2:00PM (AEST) on the date of selection. All reasonable steps to notify the winner will be taken by Kleenheat Gas. In order to redeem the prize, winners must respond with verification of their details by 12:00PM (AEST) 14 days from the day of notification to claim his or her prize (?Notification Period?).
27. All entries will go into the draw to win the Major Prize.
28. The Major Prize winner will be drawn at 12:00PM (AEST) on 6/08/2014. The first valid and eligible entry randomly drawn from all entries received from Eligible Entrants during the Entry Period will receive the Major Prize. The Major Prize winner will be notified via phone or email, and the winner?s details will be published on the website by 2:00PM (AEST) on the date of selection. All reasonable steps to notify the winner will be taken by Kleenheat Gas. In order to redeem the prize, the winner must respond with verification of their details by 12:00PM (AEST) 3 months from the day of notification to claim his or her prize (?Notification Period?).
29. Details of all Prize winners will be published in The Australian within 10 business days from the end of the Entry Period.
Alternative winner 30. In the event of a prize winner failing to or being unable to satisfy these terms and conditions (including the requirement that the prize winner become a Kleenheat customer) or forfeiting or not claiming the prize within the Notification Period, an unclaimed prize draw will be conducted at Wesfarmers Kleenheat Gas, Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 at 4pm (AEST) on 4 November 2014. In this eventuality the alternative winner will be notified via phone or email within 2 business days of the unclaimed prize draw taking place, and the winner?s details will be published on the website. 31. In the event of a dispute regarding these terms and conditions, the decision of the General Manager of Kleenheat Gas will be final and binding and no correspondence will be entered into. All entries remain the property of Kleenheat Gas. Changing the competition 32. If any act, omission, event or circumstance occurs which is beyond the reasonable control of Kleenheat Gas and which prevents it from complying with these terms and conditions, Kleenheat Gas will not be liable for any failure to perform or delay in performing its obligations and Kleenheat Gas reserves the right (subject to compliance with regulatory requirements) to cancel, terminate or modify or suspend this promotion. Liability 33. We (and our officers, employees and agents) are not liable for any loss, expense, damage or liability suffered or incurred by you in connection with the competition, including: a. any late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected entries; b. any technical difficulties or equipment malfunction; c. any theft, unauthorised access or interference by another person; d. any entry or prize claim that is late, lost, altered, damaged or misdirected; e. any variation in prize value to that stated in these terms; f. any tax liability incurred by you; g. use of, or taking of, a prize; or h. participation in the competition. ? Privacy 34. The Entrants? personal information will be collected by or on behalf of Kleenheat Gas to enable it to administer the competition and publicise the Prize winners and to enable it to inform you of products and services that may be of interest to you including by way of direct marketing. If we do not collect your personal information then we will not be able to process your entry in the competition. The personal information of: a. the Prize winners may be provided to others assisting in the conduct of the competition, including but not limited to the competition administrator and to regulatory authorities. Kleenheat Gas will disclose the Prize winner's first initial, surname, suburb and State/Territory of residence online, and will publish these details at www.lovewinter.kleenheat.com.au at the conclusion of the competition. An Entrant also agrees that Kleenheat Gas may, in the event the Entrant is the winner, publish or cause to be published the entrant?s name and postcode in any media, as required under the relevant State or Territory lottery legislation; and b. Entrant details may be provided to external agencies or persons bound under confidentiality agreements including market research businesses, advertising agencies and other businesses that assist us with the promotion of our products and services (including via direct marketing by any permitted means including telephone, email or SMS).
35. In participating in the competition, winners consent to Kleenheat Gas using the photo used for their entry, and their (and their companions) name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times and agree to grant Kleenheat Gas a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use for the purpose of promoting this competition and Kleenheat Gas.
36. All personal information collected by Kleenheat Gas under this competition is handled in accordance with Kleenheat Gas? Privacy Policy which can be found at www.kleenheat.com.au/privacy. Details on how to: a. gain access to your personal information in our possession; b. correct personal information in our possession; or c. make a complaint about Kleenheat Gas? handling of your personal information, is contained in that Privacy Policy. Should you wish to be removed from Kleenheat Gas? direct marketing database, or stop receiving direct marketing material from Kleenheat Gas, you can contact Kleenheat Gas on 13 21 80 or (in the case of email or SMS communications) unsubscribe using the method set out in the relevant message.
