Eligibility
The promotion is open only to:
Australian residents*
Those who are 18 years of age or older as of the start of the promotion period (defined below);
Employees of My Glow 2 (“Participating Parties”) and their parent companies, affiliates, partners, subsidiaries, related companies, advertising and promotion agencies, and all others associated with development and execution of this promotion, as well as immediate family members (defined as spouse, parents, children, siblings, step-sibling, step-child, in-laws and spouse of any of the foregoing, regardless of where they reside) and those living in the same household of each (people who have shared the same residence at least three months over a period of one year prior to the start of the promotion period), whether or not related, are not eligible to participate or win.
My Glow 2 may contact you to verify your identity, age or place of residence to confirm your eligibility to enter.
My Glow 2 may disqualify you if we reasonably believe that you have breached these Terms or have compromised the fair conduct of this promotion by acting unlawfully or improperly.
Entry Conditions
In case of dispute over who submitted a winning entry, the authorised account holder of the email address provided at the time of entry will be deemed to be the entrant.
“Authorised account holder” is defined as the natural person who is assigned to the email account by the provider and/or email address by an Internet access provider, on-line service provider, or other organisation (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e- mail address.
Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, accounts or any other methods may void entries and that entrant may be disqualified, and any potential prize may be forfeited.
Each potential winner may be required to show proof of being the authorised account holder.
Entries generated through a third-party My Glow 2 website or software in any way other than the manner set forth in these official rules are prohibited, and My Glow 2 reserves the right to disqualify any entrant(s) using such methods if discovered by My Glow 2.
Prize
One (1) winner will receive the following:
WhitSundays Escape
Accommodation at 4+ hotel TBD (Number of night TBC)
1 x Flight Voucher up to the value of $2000
*Winner to be selected at random by My Glow 2.
Actual value of prizes may vary and My Glow 2 will not award the difference between aggregate and actual values.
Prize fulfillment is based on availability and prize may differ from promotion images.
My Glow 2 reserves the right to substitute a prize of equal or greater value for the prize in its sole discretion, unless such substitution is prohibited by law.
Prizes are non-transferable and My Glow 2 need not substitute a prize based on the winner’s request.
Claiming Prize
Prizes for tier two and three will be sent to the winners within thirty (30) days from the date the winners are confirmed.
The tier one willner will be contacted directly to confirm all bookings regarding the prize within thirty (60) days from the date the winners are confirmed.
Please allow 4 weeks for prize delivery from the time a winner provides delivery information to My Glow 2
All federal, state and local taxes on prizes, if any, and all costs and expenses related to the acceptance and use of the prize not specified herein as being provided are solely the responsibility of the winner.
Winners may be required to provide their Social Security number or tax ID for tax reporting purposes if My Glow 2 is required to file an IRS Form 1099 with the Internal Revenue Service for the fair market value of a prize awarded and accepted.
My Glow 2 recommends that you consult with your tax advisor if you have further questions.
My Glow 2 may disqualify a winner and select an alternate winner if any prize is returned undeliverable.
Winner Selection
One (1) winning entrant will be selected for each prize via random drawing conducted by My Glow 2 on or about Tuesday 14th February 2022 at 12:00pm AEDT.
Potential winning entrants will be contacted via email associated with entry to verify eligibility and confirm the entrant as a winner.
If a potential winning entrant is determined by the My Glow 2 to be ineligible, unqualified to participate in this promotion, in violation of these official rules, or does not respond to My Glow 2’s correspondence within twenty-four (24) hours, the potential winning entrant may be disqualified and a new potential winning entrant will be selected from the pool of eligible entries, if time permits.
A potential winner may be required to sign and return, each in the form provided by My Glow 2, an Affidavit of Eligibility and Release (“Affidavit”), within seven (7) calendar days of receipt.
Any entrant who fails or refuses to sign and return the required documentation within the time period as specified by My Glow 2 may be disqualified.
Once the winners eligibility is verified, they will be confirmed as a winner.
All decisions of My Glow 2 on all matters relating to this giveaway campaign, including, without limitation, decisions related to its selection and determination of potential winners of this Sweepstakes shall be final and binding and not subject to challenge or appeal.
General Conditions
My Glow 2 may need to suspend or cancel the promotion if My Glo 2 becomes unable to conduct it as reasonably anticipated due to any reason beyond our reasonable control.
My Glow 2 reserves the right at its sole discretion to cancel, terminate, modify or suspend the promotion.
Nothing in these Terms limits, excludes or modifies the consumer guarantees provided the Competition and Consumer Act.
Except for any liability that cannot by law be excluded, My Glow 2 excludes all liability for any loss or damage whether direct, indirect, or consequential, arising in connection with the promotion.
My Glo 2 will also use and handle your personal information in accordance with our Privacy Policy (https://www.myglow2.com.au/policies/privacy-policy)
My Glow 2 is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an entrant’s ability to participate in the promotion, even if caused by My Glow 2’s negligence.
Entries generated by a script, macro or other automated means or with the intent to impair the integrity of the promotion will be void.
My Glow 2 is not responsible for changes to entrant’s contact information.
Release
As a condition of participating in the promotion, entrants release My Glow 2, Instagram, and participating parties and their respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all of their officers, directors, shareholders, members, employees, and agents (collectively, the “promotion entities”) from liability for loss, harm, damage, injury, cost or expense whatsoever including property damage, personal injury and death that may occur in connection with, preparation for, travel to, or participation in the promotion, or possession, acceptance or use of prizes or participation in any promotion-related activities and claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy and merchandise delivery.
Disputes & Governing Law
Except where prohibited by law, each entrant agrees that any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or the prize awarded, shall be resolved individually, without resort to any form of class action.
Winner publicity
-The Promoter reserves the right to publish each Winner's name and Entry on the Promoter’s official social media accounts, including Twitter, Instagram and Facebook and on its website found at www.myglow2.com.au
-By entering the giveaway, if you are a Winner you agree to your Entry being published and to take part in and co-operate fully with all reasonable publicity accompanying or resulting from this Giveaway without further recompense.
Entry requirements
-Any Entry that is deemed by the Promoter, in its sole discretion, to be unlawful, obscene, vulgar, pornographic, hateful, threatening, discriminatory, offensive or which may otherwise bring the Giveaway or Promoter into disrepute will be excluded from the Giveaway and the Promoter reserves the right to take any further action in respect of such Entry that it deems appropriate.
-The Promoter will fully co-operate with any law enforcement authorities or court order requesting or directing the Promoter to disclose the identity of or to locate anyone posting or linking any content to its Twitter or Instagram pages which infringes any third party rights or is in breach of any of these Terms and Conditions or any applicable law.
Use and display of Entries and copyright
-The copyright subsisting in the Entry must belong to the entrant. Entrants will retain copyright in the Entries they submit. Entrants must not have infringed the rights of any other party or breached any laws when submitting their Entries. If an Entry contains reference to or images of a person, the consent of that person (or their parent or guardian if they are under 18) must have been obtained.
By submitting an Entry:
-You licence and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display such content for any purpose in any media including, but not limited to the Promoter’s website, social media accounts, marketing materials, newsletters and promotional material without further compensation, restriction on use, attribution or liability;
-You waive any moral rights or similar rights in respect of your entry to which you may be entitled (at the time of submission or in the future) under the Copyright, Designs and Patents Act 1988 as amended time to time or under any similar applicable laws in force from time to time in force anywhere in the world;
-You acknowledge that third parties will have access to and will be able to republish your Entry in accordance with the terms of use of the social media platform through which your Entry is submitted.
Liability
-Except for death or personal injury caused by negligence of the Promoter or its agents or representatives or for fraud or fraudulent misrepresentation, neither the Promoter, nor its agents or representatives assume responsibility for:
-any Prize that is not redeemed;
-any personal property;
-any loss of enjoyment or wasted expenditure;
-any system failures or malfunctions of any third party websites;
-any incomplete, lost, delayed or late Entries;
-any failure to fulfil obligations of any third parties involved in this Giveaway;
-any fault, malfunction, damage, loss or disappointment suffered by the participants in the Giveaway howsoever arising from participating in the Giveaway;
-communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Giveaway;
-inaccessibility or unavailability of the internet, or any website (including without limitation any social media web sites) or any combination thereof through dial up, broadband, mobile internet or WAP connections;
-any injury or damage to a participant which may be related to or arising from the Giveaway or the Prize;if for any reason the Giveaway or any website in connection with the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer, virus, tampering, unauthorised intervention, fraud, technical failures or any other causes which may corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion; and/orany other matter outside of their reasonable control.
-Nothing in these Terms and Conditions affects your statutory rights.
-To the extent permitted by law, all conditions, warranties and other terms which might otherwise be implied by statute or common law are expressly excluded from these Terms and Conditions.
-The Winners agree to indemnify and keep indemnified the Promoter, its group of companies and their officers, employees and agents from and against all liabilities, losses, damages and expenses (including legal and other professional fees) arising out of or in connection with any allegations or claims resulting directly or indirectly from:
-their Entry into this Giveaway; and/or
-their receipt and use of any Prize.
