Eligibility 6. This Promotion is only open to Australian residents aged 18 years or older who are not contractors of the Promoters, or the immediate family members of any such directors, franchisees or contractors. 7. Immediate family includes any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), brother, sister, parent, step-parent. 8. To be eligible, entrants must complete the tasks stipulated within the Gleam widget on Quest Apartment Hotels’ website [ https://www.questapartments.com.au/campaigns/quest-x-brown-brothers-giveaway/] (“the Tasks”). 9. Entrants will qualify for additional entries during the Promotion Period by: i. Visit Brown Brothers official Instagram page = one additional entry; ii. Like Brown Brothers official Facebook page = one additional entry; iii. Visit Quest Apartment Hotels official Instagram page = one additional entry; and iv. Like Quest Apartment Hotels on Facebook = one additional entry. v. signing up to Quest Apartment Hotels email marketing list. vi. signing up to Brown Brothers email marketing list vii. referring friends to the competition. 10. The prize draw is open to any eligible entrant who complete the Tasks within the Promotion Period. 11. Entries in any other form will not be accepted.
Entrant consent 12. By entering the Promotion, each entrant agrees that: i. the Promoters may publish the entrant’s name as a winner of a Prize in any forum that the Promoters choose; and ii. the entrant will participate in any publicity accompanying or resulting from this Promotion in printed and/or online formats for an unlimited period of time without remuneration for the purpose of promoting the Promotion, the Promoters or the products and services of the Promoters.
Determining and notifying winners 13. This Promotion is a game of chance, and 1 winner will be drawn at random. Winner of the Prize will be selected by the Promoters using an online random number generator. 14. The Promoters’ decision concerning any aspect of the Promotion is final and no correspondence will be entered into. 15. The draw will take place at Quest Serviced Apartments Pty Ltd (ABN 25 119 523 483) of Level 21, 390 St Kilda Road, Melbourne 3004, Victoria on Monday 12 July 2021 at 11:00:00 (AEDST). 16. The winner will be contacted via email on Monday 12 July 2021 and provided with details of how to redeem the Prize. 17. Winner will be published on Quest Apartments Instagram Account (https://www.instagram.com/questapartments/?hl=en) and Brown Brothers Instagram Account (https://www.instagram.com/brownbrothers/?hl=en) on Monday 12 July 2021 18. The Promoters take no responsibility where they are unable to contact a Prize winner who has not provided correct or complete contact details. If an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify the Promoters. A request to modify any entry information should be directed to the Promoters. 19. If the Prize is not claimed within 72 hours of the Promoter contacting the winner, the relevant winner’s entry will be deemed invalid and the Promoter will be entitled to reselect the winning entry.
Prize 20. The winner will receive: i. One (1) two-night stay in a one-bedroom apartment at Quest Wangaratta (“Quest Wangaratta”) (“Quest Prize”); and ii. One 750ml bottle of Brown Brothers Prosecco NV on arrival; and iii. One wine and food adventure experience for 2 people at Brown Brothers winery from Quest Wangaratta to Brown Brothers (“Brown Brothers Prize”), (together “the Prize”). 21. The total Prize pool as at the commencement of this Promotion is approximately $1,000. 22. The Prize must be taken as stated. The Prize or any unused portion of the Prize is not transferable or exchangeable and cannot be redeemed for cash. The Prize is not valid in conjunction with any other offer. No compensation will be payable if a winner is unable to use the Prize as stated. 23. If the Prize is unavailable, for whatever reason, the Promoters reserve the right to substitute the Prize for a prize of equal or greater value and/or specification, subject to relevant laws. The Promoters accept no responsibility for any variation in prize value (including between advertising of the Promotion and redemption of the Prize). 24. Once a Prize has been awarded and claimed by the respective winner, the Promoters will not be responsible for any prize that has been lost, stolen, forged, damaged, or tampered with in any way.
Claiming the Brown Brothers Prize 25. The Brown Brothers’ Prize must be redeemed by 30 November 2021. 26. The winner agree not to sell, offer to sell or use the Prize for any commercial or promotional purposes (including placing the Prize on an internet auction site). 27. The Brown Brothers’ Prize can be redeemed Thursday through to Monday, subject to availability.
Claiming Quest Prize 28. The Quest Prize must be redeemed by 30 November 2021. 29. The Quest Prize can be redeemed on any night of the week, subject to availability and any other conditions imposed by Quest Wangaratta, including blackout dates for bookings. 30. The winner will be required to provide their credit card details upon making their accommodation booking as a means of confirming the reservation. 31. Upon arrival at Quest Wangaratta, the winner will be required to: i. provide reception with a current driver’s licence or passport to verify identity; ii. provide reception a valid credit card for security purposes; and iii. sign Quest Wangaratta’s registration form and accept Quest Wangaratta’s terms and conditions of stay. The check-in time will be 2pm unless otherwise arranged with Quest Wangaratta. Should the winner intend to arrive at Quest Wangaratta after 5pm, after-hour arrangements must be made with reception prior to arrival. On check-in, a security bond of up to $300 will be put on hold on the provided credit card to indemnify Quest Wangaratta in the case of any breakage or damage during the stay. 32. The winner of the Prize will be responsible to pay for any ancillary or incidental costs which may arise or are incurred as a result of winning the Prize including but not limited to any costs related to transport and car parking costs, food and beverages, entertainment and activities, and Wi-Fi internet access.
Limitation of liability and variation of promotion 33. Except as otherwise required by law, if any act, omission, event or circumstance occurs, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, pandemic or government imposed travel restrictions, which is beyond the reasonable control of the Promoters and which prevents or significantly hinders the Promoters from complying with these Terms and Conditions, the Promoters will not be liable for any failure to perform or delay in performing its obligations. The Promoters reserve the right (subject to any applicable law) to cancel, terminate, modify or suspend this Promotion and these Terms and Conditions. 34. Except for any liability that cannot be excluded by law, the Promoters, its related bodies corporate and their respective officers, employees, contractors, franchisees and agents will not be liable for any losses (including loss of opportunity), damages, expenses, costs or personal injuries arising out of or in connection with this Promotion, or the use of any Prize and the entrants release and indemnify the Promoters from and against all actions, claims and liabilities, that the entrant now has or in the future may have against the Promoters for any loss, damage or injury (including any special or consequential loss) suffered as a direct or indirect result of the entrant’s participation in the Promotion.
Privacy 35. The collection and disclosure of any personal information provided in connection with this Promotion will be handled by the Promoters in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
General 36. The Promoters will not be responsible for any entries that are not received for any reason within the Promotion Period whether lost, delayed, corrupted or otherwise due to any technical difficulties or malfunctions. 37. The Promoters may in their absolute discretion not accept a particular entry or may disqualify an entry without giving reasons and without liability to any entrants. Without limiting this the Promoters reserves the right to verify the validity of entries, Prize claims and entrants and disqualify any entrant who submits an entry that is misleading or not in accordance with these Terms and Conditions or who manipulates or tampers with the entry process. In the event the winner breaches these Terms and Conditions, the winner will forfeit the Prize in whole and no substitute will be offered. Verification is at the discretion of the Promoters, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 38. The Promotion and these Terms and Conditions will be governed by the laws of Victoria, Australia.
