Win an amazing trip for a family of 4 to New York! - Terms & Conditions 1. Information on how to enter, mechanics of entry and the prize details, form part of these Terms and Conditions. Participation in this promotion, including the taking of any prize, is deemed acceptance of these Terms and Conditions. In the event an entrant is under the age of 18, the entrant must have their parent's/legal guardian's approval before accepting the prize. 2. The promotion commences at 12.01am AEDST on 15 November 2014 and closes at 11.59pm AEDST on 16 January 2015 ("Promotional Period"). 3. Entry is only open to residents of Australia aged 16 years or older who: a) have a valid personal Visa Debit card or a valid Visa Credit card ("Visa card") issued by any Participating Financial Institution, to view full list of Participating Financial Institutions go to cuscal.com.au/natm3. Commercial/business Visa Debit or Visa Credit cards are not eligible; and b) are able to travel to New York (USA) from between 20 February 2015 and 31 July 2015. Individuals who obtain a Visa Card from a Participating Financial Institution during Promotional Period will still be eligible to enter. 4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. 5. Employees (and their immediate families) of the Promoter, participating and non-participating financial institutions, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 6. Entrants must not have overdue monies owing on their Card account and their account must not be in arrears as at 12.00noon AEDST on 20 January 2015 in order to be eligible to claim the Prize in the event they are drawn as the winner. 7. To enter into the promotion, individuals must complete the following steps during the Promotional Period: a) make an eligible purchase/payment using their Visa Card as payment tender ("Qualifying Transaction"). Visa Debit cardholders must select the ¿credit' button in-store at the time of making their Qualifying Transaction to be eligible. An eligible purchase/payment refers to any purchase/payment (of any value) using contactless technology, making a purchase online, or making a purchase over the phone but excludes balance inquires, transfers, deposits takings and change of PIN; and then b) complete the online entry form by visiting www.cuscal.com.au/natm3 providing all of the requested details and submitting the completed form. 8. Each individual will be eligible to receive one (1) entry for every Qualifying Transaction they make during the Promotional Period. Each entry must be submitted separately by way of an additional entry form and in accordance with the entry requirements. 9. Incomplete transactions and transactions that are reversed or cancelled are ineligible for entry. Balance inquires, transfers, deposit takings, change of PIN or transactions that are a result of any fraudulent activity on the entrant's account will also not be considered an eligible transaction for entry into this promotion. 10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 12. The draw will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004 on 20 January 2015 at 12:00pm AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by telephone within two (2) business days of the draw and in writing, and his or her name will be published in The Australian on 30 January 2015. All reasonable steps to notify the winner of the results of the promotion will be taken by the Promoter. 13. The Promoter's decision is final and no correspondence will be entered into. 14. The first valid entry drawn will win a trip for two (2) adults and two (2) children (aged between 6 and 11 years old, on the dates of travel) to New York City, USA valued at up to AU$25,500 depending on date and point of departure. Prize includes:     Four (4) x return economy airfares from the winner's nearest capital city to New York City, USA;     Three (3) nights accommodation in a family room in a. 4 star rating accommodation in New York City, USA (includes continental breakfast daily);     Return airport transfers from JFK to Manhattan, including a meet and greet service upon arrival at the airport;     AU$5,000 spending money; and     one (1) night's sleepover at a world famous New York museum (sleepover available on Friday or Saturday subject to availability) based on two (2) adults and two (2) children (children must be aged between 6 and 11 years) and includes:     - Evening snack and light breakfast o Fossil fact-finding mission by flash flight     - IMAX film or space show     - Live animal special exhibition (seasonal) or live animal presentation     - Return transfers to the New York museum 15. The winner and his/her travel companions must bring the following items to their sleepover event: i. Sleeping bags ii. Pillows iii. Flashlight iv. Warm comfortable clothing to sleep in v. Toiletries vi. Ear plugs and night mask (optional) vii. Water and snacks 16. The following conditions apply to the Prize holiday:     If the winner is under the age of 18, winner must be accompanied by an adult over the age of 18.     It is the winner's responsibility to provide a car/booster seat wherever appropriate.     The Prize and all elements of the Prize, including flights are non-changeable, non-refundable & non-transferable & all elements of the Prize must be taken at the same time.     Once booked the Prize cannot be amended or altered.     Winner will be required to sign & complete a winner information & Prize acceptance form & to submit copies of their passports in order to enable IMS to book their Prize trip.     Winner's requested departure date must have a minimum of 30 days advance notice of travel after completion of their winner form unless stated otherwise.     Prize (or any portion of the Prize) are not transferable unless specified otherwise.     The Prize winner is solely responsible for their entry and the entry of their travel companions into, New York USA at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel (if applicable).     Winner must have access to a personal email account.     The winner and his/her travel companions must depart from and return to the same departure point and travel together.     Winner will need a credit/ debit card in order to check-in at the hotel for a security deposit.     Prize is subject to the standard terms and conditions of individual prize and service providers.     The Prize travel must be completed by 31 July 2015, and is subject to booking and flight availability. The trip booking must include a stay on a Saturday night unless stated otherwise. Taking the Prize is subject to any prevailing terms and conditions of any accommodation/transport/services/ transfers/travel insurance/tour or ticket providers (as applicable), and in particular, any health, behaviour, and age and safety requirements. No compensation will be payable if the winner or their travel companions are unable to use any element of the Prize as stated for whatever reason, including ejection, refusal of entry into or departure from New York, USA or the New York museum or participation in certain activities for health, age, and behaviour or safety reasons. 18. Additional costs that do not form part of the Prize, but which may be incurred, are the responsibility of the winner and their travel companion(s) and are NOT included in the Prize. Such additional costs include, but are not limited to additional spending money, additional meals, taxes (excluding airline and airport taxes), mini bar items, laundry services, insurance, and transport to and from airport departure and arrival points, additional transfers, non-scheduled transportation. Winner may be required to present a credit card at time of accommodation check-in in the absolute discretion of the management of the accommodation. 19. The Promoter and IMS reserves the right to determine the final itinerary and may reject any travel supplier, hotel, mode of transport or any other element of the Prize requested by the Prize winner if they deem it to be inappropriate for any reason. 20. Frequent flyer points will not form part of the Prize 21. AU$5,000 spending money will, subject to condition 13, be transferred via EFT to the Prize winner's account held at the Participating Financial Institution and not an account in the name of another person or another Financial Institution. 22. During the entire duration of the Prize, a nominated parent/guardian must accompany any person under 18 years of age. If the Prize winner is aged under 18 years, the AU$5,000 spending money will be awarded to the winner's nominated parent/legal guardian, on the winner's behalf, and the AU$5,000 spending money will be transferred via EFT to the parent or legal guardian's account held at a Participating Financial Institution. In the event that the winner's nominated parent/legal guardian does not have an account at a Participating Financial Institution, the Promoter will provide the parent/legal guardian with a $5,000 cheque (made payable in the winner's nominated parent/legal guardian's name). 23. Total prize pool value is at up to AU$25,500. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. 24. The Prize value is the recommended retail price including GST, depending on point of departure. 27. If the Prize winner is under the age of 18 years, the Prize will be awarded to the winner's nominated parent or guardian on the winner's behalf. 28. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited. 29. A draw for the Prize, if unclaimed, may take place on 20 April 2015 at the same time and place as the original draw, from all entries received during the Promotional Period, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone within two (2) business days of the draw and in writing, and their name will be published in The Australian on 30 April 2015. 30. If the winner of the unclaimed prize draw, if any, does not take the Prize by the time stipulated by the Promoter, then the Prize will be forfeited and will not be redeemable for cash. 31. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 32. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the Prize, subject to any written directions from a relevant regulatory authority. 33. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the following; (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) if an event is cancelled or postponed for any reason beyond the reasonable control of the Promoter; or (f) taking/use of and/or participating in the Prize. 37. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.cuscal.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant's personal information to any entity outside of Australia. The winner's details may be provided to entities located in countries outside of Australia, e.g. the USA in order to organise the Prize trip. 38. As a condition of accepting the Prize, the winner and his/her companion (or their parent/legal guardian where the winner or their companion is under 18 years of age) must sign any legal documentation as in the form required by the Promoter and/or Prize suppliers in the absolute discretion, including but not limited to a legal release and indemnity form. 39. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 40.
