Instructions on how to enter the competition and prize information forms part of these Terms and
Conditions. Participation in any competition is deemed as acceptance of these Terms and Conditions.
The competition is being held by Petbar Pty Ltd.
Petbar has conducted a competition in the form of ‘chance’. This means that winners are selected
randomly. Petbar operates in accordance with the Victorian Commission for Gambling
and Liquor Regulation (VCGLR) regulations. Petbar has created this competition to abide by the
Australian Privacy Principles under the Privacy Act.
Entry is open to Australian residents aged eighteen years and over. Any participants under eighteen
years old who win the price, will firstly need to seek permission from their parents or legal
guardian. Employees of Petbar and their immediate families, suppliers, associated companies and
agencies are ineligible to enter. If a winner is discovered to be under eighteen years old and their
parents or legal guardian deny them permission to win the prize, they will automatically be disqualified,
and a new winner will be drawn from the remaining eligible entries.
Entry is free and open to all global citizens, who compete in the competition and enter during the
promotional period.
The competition will commence on the 4th May at 9am AEST (Australian Eastern Standard Time)
and end on 31st May 5pm AEST (Australian Eastern Standard Time). All eligible participants
names will be drawn from a hat, and only the winner will be notified by email once the prize has
been drawn.
The winner will be drawn by a Petbar representative on 31st May 5pm AEST (Australian Eastern
standard Time) at 124 Exhibition street Melbourne. The winner will be notified by email within 24
hours of the prize being drawn. Names of the winner, including their first name, last name, and
city and state of residence will also be announced and will be published on www.petbar.tv and via
our social networks.
In the event that the prize notification email is returned as undeliverable, the prize will be forfeited
and an alternate winner will be selected from all remaining (non-winning) eligible entries.
The drawing of the prize will be filmed and posted on our Facebook, Twitter and Instagram social
media channels. These posts will be uploaded on the 1st June and if the winner has shared with
us their social media details, we will tag them accordingly.
The winner must respond within five days or the prize may be re-allocated. Relocation will be
based on remaining competition entrants. Petbar promises to attempt to get in contact with the
winner through various platforms, including email, social media and telephone. If these methods
are exhausted and the winning participant still hasn’t responded or made contact with us within
five business days, Petbar has the right to draw a new winner, based on the remains entrants.
The prize is valued at $1579 and Petbar accepts no responsibility for any variation in the prize
value. The prize is a Silver 64GB iPhone X. The iPhone X comes with EarPods with Lightning
Connector, Lightning to USB Cable, 5W USB Power Adapter and Lighting to 3.5-mm Headphone
Jack Adapter. The iPhone does not come with a mobile data plan or any additional extras or accessories.
The prize will be purchased in Australia, therefore the adapter and charger will both be
made to suit Australian requirements. Petbar will not purchase supplementary adapters or chargers
if you live outside of Australia.
The prize will be purchased from Apple. Winners cannot ask to change the colour, size, or GB of
the phone. If they wish to do so they can visit their nearest Apple store, however, Petbar will not
cover any additional costs or charges that are created.
The iPhone is not transferable or exchangeable and cannot be taken as cash. If the iPhone is broken,
damaged or lost after it has been gifted to the winner, Petbar holds no accountability or responsibility.
To be eligible, entrants must be registered on Petbar and can only enter the competition in their
own name. Entrants must refer three people to Petbar and share with them their referral code
which will be their username. Only entrants who invite three non-existing users will be eligible to
win. Incomplete or automated entries will be disqualified.
Entrants who post illegal, sexually explicit or morally or racially offensive content will be ineligible
to win. No responsibility will be taken for lost or late entries.
Participants can enter as many times as they wish, however, they must share their code with three
different non-existing Petbar users every time. If an entrant attempts to share their code with the
same person or people more than once, they may be disqualified.
Petbar is not liable for any loss (including loss of opportunity) or damage (including, but not limited
to, direct, indirect or inconsequential loss) or personal injury in relation to this competition or
the use of, or participation in, the prize.
Entrants are responsible for any and all expenses that they incur in entering the competition and
that they will not be reimbursed regardless of whether or not they win the competition.
The prize will be shipped accordingly to an address provided to us from the winner. If the winner
has provided us with a fake or false address, Petbar holds no accountability. In an event that the
iPhone is damaged or lost after we have shipped it, Australia Post will be the most appropriate
contact. However, in this event we will work with the participant to form an appropriate solution.
Information will not be stored or sold to a Third Party. When an entrant enters the competition,
their username is automatically generated onto a spread sheet which will then be used to compile
a list of eligible participants. From this list, a winner will be drawn.
Petbar reserves the right to, at any time, verify an entry or entrant and disqualify an entrant if they
have reason to believe they haven’t submitted an entry in accordance with these Terms and Conditions.
Petbar reserves the right to modify, suspend or terminate the competition without notice.
All entries and any copyright subsisting in the entries become and remain the property of Petbar.
Petbar collects contact information about entrants in order to contact them about the competition
and where appropriate award prizes.
If you do not provide the relevant information required, you cannot participate or will be ineligible
to win.
