1. Information on how to enter and prizes form part of these Terms and Conditions. Submission of an entry into this competition is deemed acceptance of these Terms and Conditions. Entry is via Internet and on Facebook and Instagram only.
2. Entry is open to all Australian residents aged 18 years and over (Entrants). Employees, management and directors (and their immediate families) of the Promoter and its related entities, printers, suppliers, providers and agencies associated with this competition are ineligible to enter.
3. COMPETITION DATES: The Competition will be held across the Competition Period:
Friday, 13th January at 3:00PM AEST until Friday, 17th February at 1:59pm AEST. There will be 4 scheduled judgings during the campaign period to select finalists, followed by a public vote to determine a grand-prize winner. Only entries received before 1:59pm AEST on the day prior to judging will be considered during the Competition Period.
4. HOW TO ENTER: To enter, entrants must, during the Competition Period, share an original photo that represents the week’s campaign colour with corresponding campaign hashtag

For the entry to be valid, the Entrant must tag their photo with the campaign hashtag. No other entry method will be eligible for judging.
Each week’s colour and campaign hashtag will be released in accordance with the commencement times listed above.
5. Facebook and Instagram entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, incomprehensible, or illegible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly in the entry email by an Entrant will deem an entry invalid.
6. Multiple unique entries may be submitted provided they are each different. All entries must adhere to all Terms and Conditions.
7. This competition is set to run across both Facebook and Instagram, each with its own entry requirements set out below, as well as with its own technical requirements, terms and conditions and fair usage policies.
The Promoter accepts no responsibility in the event of an entrant failing to follow the applicable requirements.
Instagram – the entrant’s account must be set to public and not private.
Facebook – the entrant’s account must be set to public and not private.
8. This competition is a game of skill and chance plays no part in determining the identity of the winner. All valid entries received during the Competition Period will be individually judged by a panel of appropriately qualified judges based on creative merit & quality of the response. The judges’ decision is final and no correspondence will be entered into.
9. The judging will take place in accordance with the dates above. There will be one (1) finalist selected for each of the four campaign weeks for a total of four (4) finalists. A public vote will be held in the final week of the competition to determine the grand prize winner from the four finalists. During this voting period, Sony Mobile Australia will post each of the four finalist photos to the Sony Mobile Australia Facebook page. The finalist entry as posted by Sony Mobile Australia that achieves the most likes and reactions will be determined to be the grand prize winner.
10. Finalists found to be doing any of the three points below will be considered to be cheating and will be disqualified from the competition:
· Participants having acquired a high number of votes via vote exchange websites / groups or proxy server
· Participants found to be creating multiple Facebook accounts to vote for an entry
· Participants found to have been using vote farms, or purchased votes
11. Each finalist will be notified within 2 days of judging being finalised via their social media account provided the appropriate account settings are activated (refer to point 7 above) with their entry and will be requested to provide their contact number and address details to Sony Mobile Australia. This will confirm your acceptance of the prize. It is the Entrant’s responsibility to provide these details to Sony Mobile Australia by 3:00pm AEST Friday 17th March 2017. If the finalist does not contact the Promoter by private Facebook or Instagram message by these times, another winner will be selected and notified.
12. The prize cannot be redeemed for cash or used in conjunction with any other competition offer. The prize is not transferable or exchangeable. This prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value.
13. Prize winners:
There will be one (1) major prize winner, who will win one (1) Sony Xperia™ XZ handset, valued at $999.00 AUD.
The total prize pool value is $999.00 AUD
The prize will be sent to the independent address supplied by the winner within (14) working days from the date they have supplied their address details. Prize cannot be redeemed for cash or used in conjunction with any other competition offer. Prize is not transferable or exchangeable. Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
14. All entries submitted become the property of the Promoter. As a condition of entering into this competition, each Entrant agrees to assign all of his or her rights, title and interest (including copyright) in and to their entry to the Promoter. Each Entrant warrants to the Promoter that each entry submitted is an original work of the Entrant that does not infringe the rights of any third party. Each Entrant also warrants to the Promoter that they have the authority and all permissions necessary to submit their entry into the competition, including but not limited to obtaining any required written consents and releases to reference or identify any third party in their entry (if applicable). The Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of any of these warranties. Entrants consent to any use of their entry, which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
15. By entering the competition, each entrant agrees to the use of their entry statement for printing, broadcast, publicity and promotional purposes, including but not limited to the Sony Mobile Australia Facebook Page and the Promoter’s website/s without compensation, and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material. It is a condition of accepting any prize that the winner acknowledges that the Promoter acquires the entry for use for its commercial purposes and agrees not to object to any such use on the basis of any moral right.
16. As a condition of entering this competition, an Entrant consents to the Promoter publishing the Entrant's name on the Promoter's Facebook and Instagram page.
17. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the competition, and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes.
18. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the Promoter's sole discretion, is considered to be offensive or inappropriate in any way (including any objectionable content, profanity, potentially insulting, inflammatory or defamatory statements) or that the Promoter considers, may infringe any intellectual property rights or other rights of any person, corporation or entity. This includes, but is not limited to, any entry which the Promoter considers to be disparaging to its products and/or services.
19. Any cost associated with accessing the Facebook or Instagram page is the Entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
20. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Facebook Page and/or competition or the information on the Facebook Page and/or Instagram page, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; (f) the acceptance or use of a prize; and (g) any act or omission of the Promoter or its associated agencies.
22. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information in order to conduct the competition, to include the Entrant in the competition and, where appropriate, award prizes. The Promoter may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the competition. If the personal information requested is not provided, the Entrant cannot participate in the competition and is deemed ineligible. Entrants should direct any request to access, update or correct information to the Promoter. All personal information will be stored at the office of the Promoter. 23. This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook and Instagram and Facebook and Instagram shall not be liable in any way whatsoever to the Entrants. Furthermore, any questions, comments or complaints regarding the Competition will be directed to the Promoter, not Facebook or Instagram.
