Terms and Conditions
PARTICIPATION
Information on how to enter the "White Wings 120 Days of Cash Giveaways" Promotion (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions. Promotion is not valid in conjunction with any other special, discount or promotional offer unless indicated otherwise.
The promoter is Goodman Fielder Consumer Foods Pty Limited (ABN 35 000 024 546) of Level 5, 40 Mount Street, North Sydney NSW 2060 (Promoter).
Entry is only open to Australian residents aged 18 years or over (Entrants).
Employees (and the immediate families) of the Promoter, participating retailers of White Wings products and agencies associated with this Promotion are ineligible to enter.
The Promotion commences on 1 May 2018 at 12:01am AEST and entries close at 11:59pm AEST on 28 August 2018 (Promotional Period).
ENTRY
To enter the Promotion, Entrants must, during the Promotional Period:
Purchase any one (1) pack of White Wings, during the Promotional Period, at any Coles, Woolworths or independent supermarket (Qualifying Purchase);
Retain your original purchase receipt; and then
submit a valid entry form in accordance with clause 7 below.
To submit a valid entry form, Entrants must visit the promotional entry platform at www.WW120.com.au (Promotional Entry Platform). Entrants must then fully complete the entry form on the Promotional Entry Platform as requested including but not limited to entering their details and the last six (6) digits of the eligible product barcode, upload a copy of their receipt, and follow the prompts to submit the entry form online so that it is received during the Promotional Period.
Multiple entries permitted, subject to the following: (a) only one (1) entry submission and entry permitted per Qualifying Purchase; (b) each online entry form must be submitted separately and in accordance with the entry requirements; and (c) unrecognised barcodes will be deemed invalid; and (d) limit five (5) entries per Entrant per day.
All entries must be received by the Promoter during the Promotional Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will not count towards the Promotion and will be regarded as invalid. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
Entrants can only enter in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion, or otherwise than in accordance with the spirit of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
For each entry, Entrants must retain the original purchase receipt(s) for each White Wings product used to enter the Promotion. The original purchase receipt(s) must clearly show each product was purchased during the Promotional Period but before the date of entry, and the participating retail outlet where each product was purchased. Failure to produce the original purchase receipt for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize.
Instant Win Prizes
There will be a total of one hundred and sixty seven (167) prizes to be won instantly during the Promotional Period (Instant Win Prize). Instant Win Prizes will be awarded randomly during the Promotional Period. Entrants will be notified in writing immediately on screen, upon submitting a valid entry form whether they have won an Instant Win Prize. Winners will also be published at www.WW120.com.au on 4 September 2018.
Each Instant Win Prize will consist of AU$120 cash, to be transferred via EFT into each Instant Win Prize winner's nominated bank account. If an Instant Win Prize winner does not have a bank account, the AU$120 cash will be awarded in the form of a cheque in the Instant Win Prize winner's name as it appears on the winning entry form.
Total Instant Win Prize pool value is AU$20,040.00.
The Promoter will not, to the fullest extent permitted by law, take any responsibility for any Instant Win Prizes being lost and/or transferred to an inaccurate/incorrectly provided bank account or cheque sent to an inaccurate/incorrectly provided address.
If any Instant Win Prizes are not awarded during the Promotional Period or remain unclaimed then a draw for those remaining Instant Win Prizes will take place at 12:00pm AEDST on 28 November 2018 at The Round Table, 9 Middlemiss Street, Lavender Bay NSW 2060 subject to any directions from a regulatory authority. The winner/s, if any, will be notified in writing by email within two (2) business days of the draw and also published at www.WW120.com.au 4 December 2018.
By participating in this Promotion, Entrants consent to the Promoter making a payment into their nominated bank account by EFT transfer. The Promoter, in its discretion, reserves the right to refuse the award of an Instant Win Prize if an Instant Win Prize winner declines to provide their bank account details, or the details required to enable the Promoter to deliver the Instant Win Prize by cheque.
General
The Promoter's decision is final and no correspondence will be entered into.
Prizes are not transferable or exchangeable, unless otherwise specified.
If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with entering the Promotion, or accessing the Promotional Entry Platform is the Entrant's responsibility.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all Instant Win Prize claims in excess of the advertised total prize pool will be honoured.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

As a condition of participating in a Promotion, each winner indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with the Promotion against all claims, damages, liabilities, costs and expenses (including legal fees on a solicitor and client basis) which the Promoter may incur arising out of the winner's participation in the promotion and/or participation in a Prize, howsoever caused.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at www.goodmanfielder.com/privacy-policy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant's personal information to any entity outside of Australia.
