PROMOTIONAL TERMS & CONDITIONS:
Promotional Terms and Conditions are to be read in conjunction with the General Terms and Conditions. If there is any conflict between the Promotional and General Terms and Conditions, the Promotional Terms and Conditions apply.
Entry is open to residents of Australia, aged 18 years and over, who are Velocity Frequent Flyer members. Employees & the immediate families of the Promoter (ASOS Global Limited), Velocity Frequent Flyer, and any of the Promoter?s Agencies or affiliates, are ineligible to enter. How to Enter To enter: Log on to www.asos.com/au/NYCtrip to access the promotional entry form. Please note that there are 2 stages of the entry process as further described below and both must be completed for your entry to be valid. Stage 1: Complete all mandatory sections of the entry form: name, email address, date of birth, gender. Entrants will be asked to input their Velocity Frequent Flyer number in a non-mandatory field. If the entrant is not a Velocity Frequent Flyer member, they must become one before the competition closes in order to be eligible to win. (to become a member follow instructions available here). All entrants who have not registered as Velocity Frequent Flyer members at the time of the competition closing will not be counted in the prize draw and will not be eligible to win. Optionally, select the checkbox to indicate that you would prefer not to receive email communications from ASOS. Click ?SUBMIT?. Once you have clicked SUBMIT, you will receive a unique URL. You need to share this URL with one or more friends (subject to the restriction detailed at clause h below) either by email, Facebook send, Facebook share, Tweet, or any other means. Your friend(s) must then follow stage 2 below to complete your entry into the competition and separately enter themselves into the competition for a chance to win. Stage 2: When your friend/s receive the unique URL they must navigate to the entry form using your unique URL. They will see a message informing them that you have just submitted a form and that they need to complete all mandatory sections of the entry form, as detailed in clauses 2b, 2c and 2d above to complete both your entry and their entry to the competition. When your friend clicks ENTER, both entries (i.e yours and your friend?s entry) will be placed in the draw. Please note that your friend must also be resident in Australia and be over 18 to be eligible (for both yours and their entry) to be entered in the prize draw. Submission of the entry form by an entrant and a friend are classified as 2 separate entries (one entry each). However, single entries (i.e. entries submitted by the original entrant only) where a friend does not submit a valid entry via the original entrant?s unique URL will not be eligible and will not be counted. Once the friend has completed the entry form they will then also be given the opportunity (optional) to enter again (by way of separate entry) by nominating a friend of their choice to receive a new unique URL and to then follow out the instructions as per stage 2 above. Because each entry generates a unique URL ASOS are able to identify which entries relate to which entrants and which friends. Please note that the maximum number of entries per person per day is 2 and that this is monitored by various means including the number of entries connected to a particular email address. This limit on daily entries applies regardless of whether entries are submitted as part of an original entrant?s entry (stage 1) or if someone is nominated as a friend (stage 2)). If an email address is entered into the draw more than twice in one day then any additional entries above that maximum amount will be disqualified and will not be counted.
Please also note that if ASOS has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the promotion (for example by use of multiple email addresses relating to the same natural person), choice of prize winner(s) or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity. There is no purchase or payment of any kind necessary to enter. A purchase or payment will not increase your chances of winning Although, a friend needs to complete stage 2 of the entry process there is no obligation on the ultimate winner to pick the friend that they nominated to complete stage 2 of the process, to share the prize with them. It is at the winner?s discretion to pick their nominated travel companion to enjoy the prize (their ?Nominated Travel Partner?). ASOS will have no liability or involvement in the event of a disagreement between the winner and any friend who completed stage 2 of the form to complete the winner?s entry and is not selected as the winner?s Nominated Travel Partner, nor between a stage 2 entrant who does not select the original entrant who completed stage 1 to be their Nominated Travel Partner. Incomplete, incorrect or bulk entries (above the daily maximum limit of 2) will be disqualified and will not be counted. Opening and Close times The competition commences on 27th January 2014 at 9am AEDST and closes on 10th March 2014 at 11.59pm AEDST. Prize Draw One winner will be chosen at random on 12th March 2014 at 10am AEDST. The draw will be conducted by an independent person and will take place at ASOS, Suite 402, 50 Holt Street, Surry Hills NSW 2010. Prize Details The prize consists of a trip to New York City including: return Virgin Australia economy airfares for two adults (for the winner and their Nominated Travel Partner) departing from the winner?s nearest major commercial airport in Australia to Los Angeles, United States of America; return economy airfares for two adults departing from Los Angeles, United States of America, to New York, United States of America; seven night?s standard accommodation for two adults in one double or twin room at a three star hotel in New York selected by Promoter at their discretion (room and related taxes only); return airport transfers in a private sedan in New York; during their trip, two standard tickets to a New York City music festival of the winner?s choice (valued at up to $550 each) (all subsidies including travel to the festival shall be at the winner and Nominated Travel Partner?s own cost); two $1000 ASOS gift vouchers; The total prize pool is valued at up to RRP $11,645 depending on the point of departure. Winners and their Nominated Travel Partner are responsible for all ancillary charges associated with the enjoyment of the prize which include, but are not limited to: spending money; food and beverage (including hotel meals); taxes (including federal, state, provincial or local but excluding airline and airport taxes); insurance; transport to and from departure point (except as expressly included as part of the prize); transport to and from the selected music festival; passports; visas; items of a personal nature; in-room charges; any additional luggage fees incurred; any vaccinations required (if necessary); and any other incidental costs including spending money. Any other costs or expenses associated with prize acceptance and/or use that are not expressly included in the prize, are excluded and will be the sole responsibility of the winner and Nominated Travel Partner. The winner and their Nominated Travel Partner must hold a valid passport and insurance as well as any relevant travel immunizations and ASOS shall have no liability in this regard. Winner Notification The Winner will be notified by email within 48 hours of the draw. The name of the winner will be published in The Australian newspaper on 19th March 2014. The Winner will have until the 17th June 2014 to respond to the email and confirm their eligibility in order to claim their prize. If the Winner is un-contactable or unable to accept the prize for any reason, a second chance draw will be conducted in the same format and location as the original draw on 19th June 2014 at 10am AEST. Second chance winner will be notified by email within 48 hours of the draw and will have until 21st September 2014 to claim their prize. The name of the second chance winner (if any) will be published in The Australian newspaper on 26th June 2014. Prize Booking and Restrictions Return Virgin Australia economy airfares for two adults departing from the winner?s nearest major commercial airport in Australia to Los Angeles, United States of America, will be awarded in the form of a Virgin Australia prize certificate. The prize certificate will be provided to a travel agent (selected by ASOS), who will arrange the flight booking on behalf of the winner, using the prize certificate. The return flights on Virgin Australia are from the winner?s nearest commercial port within Australia. The flights are non-redeemable for cash. Travel is on confirmed space but is subject to availability at the time of booking. Tickets are non-transferable. Prize cannot be taken during Australian and American school holidays, public holidays or other peak periods. Prize must be used within 12 months from date of issue of the Prize Certificate. Travel on Virgin Australia flights is subject to Virgin Australia?s Conditions of Carriage, which are available at http://www.virginaustralia.com/au/en/about-us/legal-policies/conditions-of-carriage/ and are subject to change. Bookings are subject to the Fare Rules applicable to the fare and are available at http://www.virginaustralia.com/au/en/plan/fare-types/. Passengers who do not notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight will forfeit the prize tickets. Tickets are valid on flights marketed and operated by Virgin Australia and not code share flights. Redemption of the Virgin Australia flight prize certificate is subject to any other terms and conditions specified on the vouchers. Travel insurance is compulsory and at the expense of the winner. Prize must be booked within 12 months of receiving the prize certificate. Winners must book at least 60 days prior to travel. The prize is subject to specific room category availability with the participating accommodation provider?s booking and reservation policies, with the accommodation provider reserving the right to restrict bookings at any time. Any third party terms and conditions, including those of Virgin Australia and the selected hotel, will apply to the prize where applicable. The Winner and their Nominated Travel Partner may be required to provide a credit card imprint at check-in that will be used to charge for incidentals and/or will be used as a bond in case of damage to the property. The winner and his/her Nominated Travel Partner are responsible for ensuring they have valid passports and any requisite visas, vaccinations and travel documentation, as applicable. The winner and his/her Nominated Travel Partner must depart from and return to the same departure point and travel together. This competition is valid in Australia only.

We may ask for proof of age or identity at the finalist stage, just to be sure. Using false details will result in disqualification.
There is no purchase or payment of any kind necessary. A purchase or payment will not increase your chances of winning.
As this is an online competition, it is necessary for you to have access to the internet and to have an active email address.
It is possible to enter the competition more than once, but please be aware that you cannot win more than one prize within each competition. By submitting your entry, you warrant that your entry is an original work, belongs to you and has not been copied from others, and does not violate the rights of any other person or entity.
JUDGING:
If we run a competition where the entries will be judged, and a winner is then chosen, the entries will be judged by an independent judge, or a panel including one independent judge.
If we run a competition with a prize draw, then winners will be selected from all the valid qualifying entries by a random draw, in Australia.
ASOS? decision is final and no correspondence will be entered into. The prize only includes what is expressly stated to be part of the prize and is not transferable. No cash alternative is available.
WINNERS:
You are responsible for providing us with accurate and up-to-date contact details. We will not be liable for any failure, delay or inability to contact you. In some circumstances you will need to provide a valid delivery address in order to receive your prize.
If you are a potential winner, we will contact you at the email address you provided, or we will contact you through other means, which are specified in the Promotional Terms and Conditions. We will contact you within 48 hours of the competition closing and we may ask you to verify your personal details.
If you have not replied within 3 months, or you don?t meet the eligibility requirements we mentioned above, we reserve the right to withdraw a potential prize.
PRIZES:
Prizes cannot be exchanged or substituted for a cash alternative, except at the sole discretion of ASOS.
Prizes are subject to availability and may be subject to a sponsor?s or supplier?s terms and conditions, which will be communicated in the Promotional Terms and Conditions. We reserve the right to amend prizes or the terms of the competition if the need arises, subject to the approval of the state and territory regulatory authorities.
In the case where event tickets are awarded as a prize, it is not possible to sell or give these on to a third party. Unless otherwise stated, travel and/or accommodation will not be provided for the event. If you are unable to attend, the prize will be forfeited and retained to be distributed to the next placed entry.
If your prize involves travelling to another country, it is your responsibility to arrange visas if necessary. We do not have any information on travel visas, nor will we become involved in the arrangement of these.
If your prize involves attending an event, be aware that unless otherwise stated we accept no responsibility for the organisation or monitoring of the event. We shall not be liable for any event that is cancelled by a third party. If you do attend an event as part of a prize, you are attending it in your personal capacity and not as an employee, agent, or representative of ASOS Global Limited.
If you are awarded ASOS vouchers as a prize, you will need to sign up to an ASOS.com account (if you don?t already have one), so that we can credit you with the voucher amount. Please note that although this is an international competition the vouchers will be allotted in Pounds Sterling.
