THIS IS A GAME OF SKILL. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE
DOES NOT INCREASE THE CHANCES OF WINNING.
1. Eligibility: This Campaign is open only to those who sign up at the competition link available
at youi.com.au/makeitcount and who are 18 years of age as of the date of entry. The
Campaign is only open to Australian and New Zealand residents, and is void where prohibited
by law. Employees of Youi and Youi NZ Pty Limited, its affiliates, subsidiaries, advertising and
promotion agencies, and suppliers, (collectively the “Employees”), and immediate family
members and/or those living in the same household of Employees are not eligible to
participate in the Campaign. The Campaign is subject to all applicable federal, state, and local
laws and regulations.
2. Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully
unconditionally bound by these Rules, and You represent and warrant that You meet the
eligibility requirements. In addition, You agree to accept the decisions of Youi as final and
binding as it relates to the content of this Campaign.
3. Campaign Periods: the Campaign is promoted for seven (7) weeks and there are seven (7)
promotional periods. Entries will be accepted online during each of the promotional periods
as follows:
a. First Promotional Period: starting 24 May 2017 at 00:01 AEST and ending on 31 May
2017 at 20:00 AEST. All online entries for the first promotional period must be received
by 20:00 AEST on 31 May 2017.
b. Second Promotional Period: starting 1 June 2017 at 03:00 AEST and ending on 8 June
2017 at 03:00 AEST. All online entries for the second promotional period must be
received by 03:00 AEST on 8 June 2017.
c. Third Promotional Period: starting 8 June 2017 at 03:00 AEST and ending on 15 June
2017 at 03:00 AEST. All online entries for the third promotional period must be received
by 03:00 AEST on 15 June 2017.
d. Fourth Promotional Period: starting 15 June 2017 at 03:00 AEST and ending on 21 June
2017 at 20:00 AEST. All online entries for the fourth promotional period must be
received by 20:00 AEST on 21 June 2017.
e. Fifth Promotional Period: starting 22 June 2017 at 03:00 AEST and ending on 29 June
2017 at 03:00 AEST. All online entries for the fifth promotional period must be received
by 03:00 AEST on 29 June 2017.
f. Sixth Promotional Period: starting 29 June 2017 at 03:00 AEST and ending on 6 July
2017 at 03:00 AEST. All online entries for the sixth promotional period must be received
by 03:00 AEST on 6 July 2017.
g. Seventh Promotional Period: starting 6 July 2017 at 03:00 AEST and ending on 12 July
2017 at 20:00 AEST. All online entries for the first promotional period must be received
by 20:00 AEST on 12 July 2017.
4. How to Enter: The Campaign must be entered by submitting an entry using the online form
provided at youi.com.au/makeitcount or Youi’s Facebook page. Specific entry requirements
will be outlined on the online form each week of the Campaign. The entry must fulfil all
Campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete
or do not adhere to the rules or specifications may be disqualified at the sole discretion
of Youi Insurance. You may enter only once. You must provide the information requested. You
may not enter more times than indicated by using multiple email addresses, identities, or
devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise
attempt to circumvent the rules, your submission may be removed from eligibility at the sole
discretion of Youi.
5. Prizes: The Winners of each week of the Campaign (the “Winners”) will receive 2 Gold
Category tickets to the Holden State of Origin 2017 game 2 or 3. Actual/appraised value may
differ at the time each prize is awarded. The specifics of the prize shall be solely determined
by Youi. No cash or other prize substitution shall be permitted except at Youi‘s discretion. The
prize is non-transferable. Any and all prize-related expenses, including without limitation any
and all federal, state, and/or local taxes, and/or travel/accommodation expenses shall be the
sole responsibility of each Winner. No substitution of prize or transfer/assignment of prize to
others or request for the cash equivalent by Winners is permitted. Acceptance of prize
constitutes permission for Youi to use each Winner’s name, likeness, and entry for purposes of
advertising and trade without further compensation, unless prohibited by law. Use of the
ticket/s or access to the game may be subject to terms and conditions of the NRL and/or
ARLC, which are beyond the control of Youi.
6. Odds: The odds of winning depend on Your skill and the number of eligible entries received.
7. Winner Selection and Notification:
a. One Winner will be selected for each Promotional Period solely at the discretion of a
Wishpond employee under the supervision of and based on criteria provided by Youi,
including:
i. where the game of skill is a multiple-choice question and answer, the Contestant
who selects the correct answer. Where multiple Contestants select the correct
answer, the first entry will be selected as the winner;
ii. where the game of skill is based on 25 words or less answer, the best answer
submitted.
b. Winners will be selected on:
i. First Promotional Period: 2 June 2017 at 08:00 AEST.
ii. Second Promotional Period: 9 June 2017 at 08:00 AEST.
iii. Third Promotional Period: 16 June 2017 at 08:00 AEST.
iv. Fourth Promotional Period: 23 June 2017 at 08:00 AEST.
v. Fifth Promotional Period: 30 June 2017 at 08:00 AEST.
vi. Sixth Promotional Period: 7 July 2017 at 08:00 AEST.
vii. Seventh Promotional Period: 14 July 2017 at 08:00 AEST.
c. Winners will be notified by email within five (5) days following selection of the
Winners. Youi shall have no liability for Winner’s failure to receive notices due to spam,
junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise
non-functioning contact information.
d. If Winner cannot be contacted, is ineligible, fails to claim the prize within 2 days from the
time award notification was sent, or fails to timely return a completed and executed
declaration and release as required, the prize may be forfeited and an alternate Winner
selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon
compliance with any and all federal, state, and local laws and regulations.
e. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT YOUI’S SOLE
DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE
CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY
TERMINATED.
8. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You
understand and agree that Youi, anyone acting on behalf of Youi, and Youi’s licensees,
successors, and assigns, shall have the right, where permitted by law, to print, publish,
broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity
and throughout the World, without limitation, your entry, name, portrait, picture, voice,
likeness, image, statements about the Campaign, and biographical information for news,
publicity, information, trade, advertising, public relations, and promotional purposes. without
any further compensation, notice, review, or consent. By entering these contents, You
represent and warrant that your entry is an original work of authorship, and does not violate
any third party’s proprietary or intellectual property rights. If your entry infringes upon the
intellectual property right of another, You will be disqualified at the sole discretion of Youi. If
the content of your entry is claimed to constitute infringement of any proprietary or intellectual
proprietary rights of any third party, You shall, at your sole expense, defend or settle against
such claims. You shall indemnify, defend, and hold harmless Youi from and against any suit,
proceeding, claims, liability, loss, damage, costs or expense, which Youi Insurance may incur,
suffer, or be required to pay arising out of such infringement or suspected infringement of any
third party’s right.
9. Other Terms & Conditions: Youi reserves the right, in its sole discretion, to cancel, terminate,
modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud,
or other cause beyond Youi’s control corrupt or affect the administration, security, fairness, or
proper conduct of the Campaign. In such case, Youi may select the Winner from all eligible
entries received prior to and/or after (if appropriate) the action taken by Youi. Youi reserves the
right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with
the entry process or the operation of the Campaign or website or violates these Terms &
Conditions. Youi has the right, in its sole discretion, to maintain the integrity of the Campaign,
to void votes for any reason, including, but not limited to: multiple entries from the same user
from different IP addresses; multiple entries from the same computer in excess of that allowed
by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering.
Any attempt by an entrant to deliberately damage any website or undermine the legitimate
operation of the Campaign may be a violation of criminal and civil laws. Should such attempt
be made, Youi reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering and where permitted by law, You agree to release and hold
harmless Youi and its subsidiaries, affiliates, advertising and promotion agencies, partners,
representatives, agents, successors, assigns, employees, officers, and directors from any
liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or
indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the
Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion
thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any
computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the
unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv)
unauthorized human intervention in any part of the entry process or the Promotion; (v)
electronic or human error in the administration of the Promotion or the processing of entries.
11. Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF Australia AND Queensland,
WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in
this Campaign, participant agrees that any and all disputes that cannot be resolved between
the parties, and causes of action arising out of or connected with this Campaign, shall be
resolved individually, without resort to any form of class action, exclusively before a court
located in Queensland having jurisdiction. Further, in any such dispute, under no
circumstances shall participant be permitted to obtain awards for, and hereby waives all rights
to, punitive, incidental, or consequential damages, including reasonable legal fees, other than
participant’s actual out-of-pocket expenses (i.e. costs associated with entering this
Campaign). Participant further waives all rights to have damages multiplied or increased.
12. Non-Excludable Guarantees: nothing in these Terms and Conditions limit, exclude or modify
or purports to limit, exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under
the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
13. Privacy Collection Statement:
a. By submitting an entry into this Campaign, You consent to receive promotional and
other marketing messages from Youi (including messages sent electronically for an
unlimited period of time). You will be able to opt-out at any time by following
instructions included in each message sent by Youi.
b. Youi and its related entities collect Your personal information for the purpose of
conducting and promoting this Campaign (including but not limited to determining and
notifying Winners). Youi may disclose personal information collected to Wishpond or
another third party who is engaged to conduct the Campaign draw and/or prize
fulfilment. Youi may also disclose personal information collected to Australian
regulatory authorities, such as regulators of trade promotions. Youi will otherwise
handle your personal information in accordance with its Privacy Policy available at
youi.com.au. You may request access to or update your personal information or lodge
a complaint in writing to The Privacy Officer, Youi Pty Ltd of 10-24 Lake Kawana
Boulevard, Birtinya, Queensland 4575.
14. Promoter: The Promoter of the Campaign is Youi Pty Ltd (ABN 79 123 074 733) of 10-24 Lake
Kawana Boulevard, Birtinya, in the State of Queensland, Australia.
15. Facebook: The Campaign hosted by Youi is in no way sponsored, endorsed, administered by,
or associated with Facebook.
16. By participating in the contest, You, the Contestant, have affirmatively reviewed, accepted,
and agreed to all of the Official Rules & Regulations.
