CONDITIONS
PARTICIPATION
1. This competition (“Competition”) is conducted by PZ Cussons Australia Pty Ltd, ABN 13 004 164 827, Building A, Level 1, 13-15 Compark Circuit, Mulgrave VIC 3170 (“Promoter”).
2. Entry to the Competition constitutes acceptance of these conditions.
3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years or older as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
4. Competition entry opens at 00:00 hrs on 30/01/17 and closes at 24:00 hrs on 30/4/17 ("Entry Period"). All times and dates are times and dates in Melbourne which may be AEST or AEDT depending on the date. Where times are stated using the 24 hour clock, 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.
PROMOTIONAL PRODUCTS
5. In this Competition, a "Qualifying Product" is a 250mL ORIGINAL SOURCE Shower Gel that is packaged in a pack that refers to this Competition.
6. To enter, an Eligible Entrant must first purchase one Qualifying Product from any retail outlet in Australia that sells Qualifying Products. Only one entry may be submitted for each Qualifying Product purchased.
ENTRY
7. Entry can only be made by internet. To submit an entry, an entrant must, during the Entry Period, use a compatible browser to visit www.packmore.in ("Competition Website") and follow the directions there to:
(i) choose which one of the available Original Source Experience Prizes they would like to win; and
(ii) provide: (a) the 8 digit Competition code on the back of the Qualifying Product that they purchased; and
(b) all other details required at the Competition Website, including the entrant’s first and last names, postal address and e-mail address.
8. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
9. For each and every Qualifying Product that an Eligible Entrant uses to submit an entry, he/she MUST retain: (i) the original packaging of the Qualifying Product, and (ii) a copy of the receipt that was issued when that Qualifying Product was purchased.
10. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 9 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
(ii) An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
11. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 9 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.
12. An entry by more than one person (ie a joint entry) is invalid.
INTERNET ENTRIES
13. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
14. Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
PRIZES
15. There are 81 prizes in total (each a “Prize”) with a maximum total value of $34,079.26
16. The Prizes comprise:
(i) 1 x “Swim with the Sharks”;
(ii) 1 x “Bungee Jump”;
(iii) 1 x “Extreme Water Slide”;
(iv) 26 x Camera;
(v) 52 x One Years Supply of ORIGINAL SOURCE Shower Gel.
The details of each Prize are set out below.
17. The “Swim with the Sharks”, “Bungee Jump” and “Extreme Water Slide” Prizes are each an Original Source Experience Prize.
18. The Swim with the Sharks Prize is valued at a maximum of $5,500 and comprises:
(i) two (2) x return economy airfares from the winner's nearest Australian capital city to Port Lincoln (South Australia) for the winner and one guest aged 18 years, or older;
(ii) two nights accommodation (winner and guest sharing) in a 4 star Port Lincoln hotel of the Promoter’s choice ("Accommodation");
(iii) return transfers between the airport and the Accommodation;
(iv) two (2) tickets to participate in a one-day Shark Cage Dive Charter (Calypso Star Charter Pty Ltd);
(v) return transfers between the Accommodation and the Shark Cage Dive location; and
(vi) $500 spending money for the Winner only.
19. The Bungee Jump Prize is valued at a maximum of $4,000 and comprises:
(i) two (2) x return economy airfares from winner's nearest Australian capital city to Cairns (Queensland) for the winner and one guest aged 18 years, or older;
(ii) two nights accommodation (winner and guest sharing) in a 4 star Cairns hotel of the Promoter’s choice ("Accommodation");
(iii) return transfers between the airport and the Accommodation;
(iv) two (2) tickets to participate in a single Bungee Jump (AJ Hackett Pty Ltd);
(v) return transfers between the Accommodation and the Bungee Jump location; and
(vi) $500 spending money for the Winner only.
20. The Extreme Water Slide Prize is valued at a maximum of $4,000 and comprises:
(i) except where Brisbane is the Australian capital city closest to the winner’s place of residence, two (2) x return economy airfares from winner's nearest Australian capital city to the Gold Coast (Queensland) for the winner and one guest aged 18 years, or older;
(ii) two nights accommodation (winner and guest sharing) in a 4 star Gold Coast hotel of the Promoter’s choice ("Accommodation");
(iii) return transfers between the airport and the Accommodation;
(iv) two (2) tickets to Wet ’n’ Wild theme park (operated by Roadshow Theme Parks Pty Ltd (ABN 60 010 919 623) trading as Wet ‘n’ Wild Gold Coast of Pacific Motorway, Oxenford, Gold Coast, Queensland 4210);
(v) return transfers between the Accommodation and Wet ‘n’ Wild theme park; and
(vi) $500 spending money for the Winner only.
21. The participation of the winner and their guest in the activity in each Original Source Experience Prize is subject to the conditions imposed from time to time by the activity provider. These conditions vary between activities and include requirements such as health and minimum height. Winners will be notified of the conditions relevant to their activity prior to commencing travel.
22. Each Original Source Experience Prize winner must give the Promoter at least 30 days notice of proposed commencement of travel. All travel must be completed no later than 31st October 2017, with no travel to be booked during public school holiday periods in any Australian State or Territory. Each Original Source Experience Prize is subject to availability at the time of booking and, if any component of the prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which the prize will be booked.
23. Each Original Source Experience Prize does not (except as expressly stated) include any:
(i) transport between a traveller's residence and: (a) the departure airport (if Flights are provided); or (b) the Accommodation (if Fights are not provided);
(ii) overnight accommodation while travelling to the departure airport or destination;
(iii) other travel or accommodation;
(iv) meals;
(v) incidental accommodation charges (such as, telephone calls and video rentals);
(vi) insurance (such as travel or health cover);
(vii) vaccinations or other medical or health related services;
(viii) other ancillary costs which may be incurred by the winner or his/her guests in relation to the Prize.
24. Each Camera is a Digital Action Camera valued at $599.99 RRP.
25. Each One Years Supply of ORIGINAL SOURCE Shower Gel Prize comprises 24 x 250mL bottles of ORIGINAL SOURCE Shower Gel together valued at $95.76 RRP. Each winner of this Prize may choose which of the available variants they would like to be awarded.
PRIZE DRAWS – WEEKLY
26. Thirteen draws will be held to award the Camera and One Years Supply of ORIGINAL SOURCE Shower Gel Prizes (each a “Weekly Prize Draw”). There will be one Weekly Prize Draw for each seven days of the Entry Period starting at 00:00 hrs on a Monday and ending at 23:59 hrs on a Sunday (each a “Week”).
27. The Weekly Prize Draw for each Week will be held on the first Tuesday after the Week ie the Weekly Prize Draws will be held on 7, 14, 21, 28 February; 7, 14, 21, 28 March; 4, 11, 18, 25 April; and 2 May 2017.
28. Each entry received during a Week will be allocated to the Weekly Prize Draw for the Week during which it was received by the Promoter and will NOT be included in any subsequent Weekly Prize Draw. An entry received exactly on the start of a Week will be allocated to the Week that is just commencing.
29. In each Weekly Prize Draw, the Eligible Entrants who submitted: (a) the first 2 valid entries drawn, will each win one Camera Prize; (b) the next 4 valid entries drawn, will each win one One Years Supply of ORIGINAL SOURCE Shower Gel Prize.
PRIZE DRAWS – ORIGINAL SOURCE EXPERIENCE PRIZES
30. Three draws to award the Original Source Experience Prizes will be held on 02/05/17.
31. Only entries in which the entrant nominated a particular Original Source Experience Prize as their preferred Prize will be included in the draw to award that Prize. Entries included in the Weekly Prize draws, including winning entries, will be included in the nominated Original Source Prize draw.
32. The Eligible Entrant whose valid entry is the first valid entry drawn in:
(i) the Swim with the Sharks prize draw, will win that Prize;
(ii) the Bungee Jump prize draw, will win that Prize;
(iii) the Extreme Water Slide prize draw, will win that Prize.
PRIZE DRAWS – GENERAL
33. All Prize draws will be held at 15:00hrs at Level 2, 106 Parramatta Road, Stanmore, NSW 2048.
34. Subject, where relevant, to any directions given under the legislation regulating the Competition, if any Prize is not claimed by a winner by 8/8/17 the Prize will be awarded to another Eligible Entrant in a redraw commencing at 15:00hrs on 9/8/17 at Level 2, 106 Parramatta Road, Stanmore, NSW 2048.
PRIZES GENERALLY
35. The Prizes are valued as at 13/07/16. The Promoter takes no responsibility for any variations in value of a Prize.
36. If a Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a Prize is unavailable for any reason.
37. Except as provided in these conditions, a right to receive a Prize is not transferable or exchangeable and cannot be taken as a monetary payment. Subject to the written consent of the Promoter (which will not be unreasonably withheld), the winner of an Original Source Experience Prize may transfer their prize to a friend or relative, provided that the transferee agrees to comply with these conditions.
38. Unless expressly stated in these conditions, all expenses incurred in relation to enjoyment of a Prize are the responsibility of the winner.
WINNERS
39. Each winner, whenever determined, will be notified in writing sent by e-mail to the e-mail address indicated in the entry. So far as practicable, the notifications will be sent to winners within two days of their determination. The notification will include instructions as to how the winner is to claim the Prize and establish his/her entitlement to it.
40. The names of the prize winners in each draw (including, if required, the condition 34 redraw) will be published on the Competition Website no later 7 days after the draw for a period of at least 28 days.
41. In order to be entitled to any Prize, each winner must, if requested by the Promoter, agree to and sign and return an eligibility form confirming their compliance with the Conditions and eligibility to accept the Prize. The winner will forfeit his/her Prize if he/she fails to ensure that all documents relating to the Prize are signed and returned in accordance with this condition, as and when required by the Promoter
GENERAL
42. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
43. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
44. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
45. All of the Promoter’s decisions are final and no correspondence will be entered into.
46. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
47. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
48. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
49. Each winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
50. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a Prize.
